About this file
This is a Federal Excise Tax Exemption Certificate issued by the State of New Hampshire's Department of Administrative Services, Bureau of Purchase and Property, in support of Request for Bid #2614-23 for fuel supply contracting across state agencies. The certificate, effective November 15, 2022, exempts fuel products (gasoline, diesel, and kerosene) purchased under various state contracts and purchase orders from federal excise tax. The exemption applies exclusively to fuel procured for use by New Hampshire state agencies and covers ten counties: Belknap, Carroll, Cheshire, Coos, Grafton, Hillsborough, Merrimack, Rockingham, Strafford, and Sullivan. The bid closing date for the associated fuel contract is November 22, 2022, at 2:00 PM EST, with the contract term running from December 1, 2022, through November 30, 2025, and potential extension for up to two additional years. The state requires vendors to deliver fuel within 48 hours of order placement, seven days a week, 365 days per year, and submit monthly consumption reports to the Fuel Distribution Manager.
Pricing is structured as index-based markups over OPIS "Oil Price Daily" postings, with markups varying between $0.0642 and $0.1442 per gallon by county and fuel type, limited to four decimal places and inclusive of all delivery, taxes, and fees. The state guarantees a maximum of 85 percent of estimated annual fuel quantities, which range from approximately 70,500 to 548,000 gallons annually by county, and reserves the right to convert index-based contracts to fixed pricing. Bidders must register with the New Hampshire Secretary of State, maintain general liability insurance of at least $1,000,000 per occurrence and $2,000,000 aggregate, and comply with RSA 21-I:11-c debarment certifications. The State of New Hampshire explicitly waives any right to claim credit or payment for gasoline, diesel, or kerosene fuel covered by this exemption certificate, with fraudulent use of the certificate subject to fines of up to $10,000, imprisonment for up to five years, or both, plus prosecution costs.
