SECTION 101

DEFINITIONS AND TERMS

101-1.01 GENERAL. The following terms and definitions apply in these Specifications. If a term is not defined, the ordinary, technical, or trade meanings for that term shall apply, within the context in which it is used.

Titles and headings of sections, subsections, and subparts are intended for convenience of reference and will not govern their interpretation.

Cited publications refer to the most recent issue, including interim publications, in effect on the date of the Solicitation, unless specified by year or date.

These Specifications are written to the Bidder or Contractor. Unless otherwise noted, all actions required by the Specifications are to be performed by the Bidder, the Contractor, or the Contractor's agent.

Beginning in Division 200 we use imperative mood and active voice to communicate the Contractor's responsibilities in a direct and concise manner. Omission of words or phrases such as “a,” “an,” “the,” “the Contractor shall,” “unless otherwise specified,” or “unless otherwise directed” is intentional. Interpret the Contract as if they were included.

Beginning in Division 200 whenever anything is, or is to be, done, if, as, or, when, or where “acceptable, accepted, approval, approved, authorized, determined, designated, directed, disapproved, ordered, permitted, rejected, required, satisfactory, specified, submit, sufficient, suitable, suspended, unacceptable, unsatisfactory, or unsuitable,” the expression is to be interpreted as if it were followed by the words “by the Government” or “to the Government.”

101-1.03 DEFINITIONS.

ADDENDA. Clarifications, corrections, or changes to the Plans, Specifications, or other Contract documents issued graphically or in writing by the Government after the advertisement but prior to bid opening.

AGREED PRICE. An amount negotiated between the Government and the Contractor after Contract award for additional work performed or additional materials supplied under the Contract.

ALASKA TEST METHODS MANUAL. The materials testing manual used by the Government. Contains Alaska Test Methods, WAQTC Test Methods, WAQTC FOPs for AASHTO Test Methods, and Alaska Standard Practices for evaluating test results, calibrating testing equipment.

AWARD. Acceptance of the successful Proposal by the Government. The award is effective upon execution of the Contract by the Contracting Officer.

BASE COURSE. One or more layers of specified material placed on a subbase or subgrade to support a surface course.

BID. The bidder’s offer, on the prescribed forms, to perform the specified work at the prices quoted.

BID BOND. A type of bid guaranty.

BIDDER. An individual, firm, corporation, joint venture, or any acceptable combination of individuals and entities submitting a bid for the advertised work.

BID GUARANTY. The security furnished with a bid to guarantee that the bidder will enter into a contract if the Government accepts the bid.

CALENDAR DAY. Every day shown on the calendar, beginning and ending at midnight.

CHANGE ORDER. A written order by the Government to the Contractor making changes to the Contract, within its general scope, and establishing the basis of payment and time adjustment, if any, for the work affected.

COMPLETION DATE. The date on which all Task Order work is specified to be completed.

CONSTRUCTION. Physical activity by the Contractor or any Subcontractor using labor, materials or equipment within the Project, or within material sources planned for use on the Project.

CONTRACT. The written agreement between the Government and the Contractor setting forth the obligations of the parties for the performance and completion of the work.

CONTRACTING OFFICER. The person authorized by the Government to enter into and administer the Contract on its behalf. The Contracting Officer has authority to make findings, determinations, and decisions with respect to the Contract and, when necessary, to modify or terminate the Contract. The Contracting Officer is identified on the Solicitation.

CONTRACT ITEM (PAY ITEM). A specifically described item of Contract work listed on the Bid Form or in the Task Order.

CONTRACTOR. The individual, firm, corporation, joint venture, or any acceptable combination of individuals and entities contracting with the Government for performance of the Contract.

CONTRACT TIME. The time allowed under the Contract, including authorized time extensions, for the completion of all work by the Contractor.

CONTROLLING ITEM. Any feature of the work considered at the time by the Government: (1) essential to the orderly completion of the work and (2) a feature which, if delayed, will delay the time of completion of the Task Order (such as an item of work on the critical path of a network schedule).

COST. Amounts actually incurred by the Contractor in the performance of the Contract that are:

1. actually reflected in contemporaneously maintained accounting or other financial records, and

2. supported by original source documentation. Costs are to be stated in U.S. dollars.

CULVERT. Any structure not classified as a bridge that provides an opening under the embankment.

DAY. Calendar day unless preceded by the word “working”.

DIRECTIVE. A written communication to the Contractor from the Government enforcing or interpreting a Contract requirement or ordering commencement or suspension of an item of work already established in the Contract.

ENGINEER. An authorized representative of the Government’s Contracting Off icer. The Engineer is responsible for day-to-day management of the Contract.

EQUIPMENT. All machinery, tools, apparatus, and supplies necessary to preserve, maintain, construct, and complete the work.

EQUITABLE ADJUSTMENT. An increase or decrease in Task Order price or time calculated according to the terms of this Contract.

EXTRA WORK. An item of work not provided for in the Task Order as awarded but found essential by the Government for the satisfactory completion of the work within its intended scope.

GOVERNMENT. The Contracting Officer or his designated representative.

HIGHWAY, STREET, OR ROAD. A general term denoting a public way used by vehicles and pedestrians.

HOLIDAYS. Federal legal holidays are:

1. New Year's Day - January 1

2. Martin Luther King, Jr. Day - Third Monday in January

3. Presidents' Day - Third Monday in February

4. Memorial Day - Last Monday in May

5. Independence Day - July 4

6. Labor Day - First Monday in September

7. Indigenous Peoples Day – Second Monday in October.

8. Veteran's Day - November 11

9. Thanksgiving Day - Fourth Thursday in November

10. Christmas Day - December 25

11. Every day designated by public proclamation by the President of the United States or the base commander as a legal holiday.

If a holiday listed above falls on a Saturday, Saturday and the preceding Friday are both legal holidays. If the holiday falls on a Sunday, except (11) above, Sunday and the following Monday are both legal holidays.

INSPECTOR. The Government’s representative authorized to make detailed inspections of Task Order performance and materials.

MATERIALS. Substances specified for use in the construction of the project.

NOTICE TO PROCEED. Written notice to the Contractor to begin the Contract or Task Order work.

ORIGINAL GROUND (OG). The ground surface prior to the start of work.

PATHWAY. A paved or unpaved path for multiple uses.

PAVEMENT STRUCTURE. The combination of subbase, base course, and surface course placed on a subgrade to support the traffic load and distribute the traffic load to the roadbed.

PAYMENT BOND. The security furnished by the Contractor and the Contractor’s Surety to guarantee payment of all persons who supply labor and material in prosecution of the work provided for in the contract.

PERFORMANCE BOND. The security furnished by the Contractor and the Contractor’s Surety to guarantee performance and completion of the work provided for in the contract.

PLANS. The Government’s Task Order: drawings, profiles, typical cross sections, standard drawings, and supplemental drawings or reproductions showing the location, character, dimensions, and details of the work.

PRECONSTRUCTION CONFERENCE. A meeting between the Contractor and the Government to discuss the project before the Contractor begins the work.

PROFILE. The vertical elevation of the surface of the layer at the location indicated. On a roadbed it is typically indicated at the longitudinal centerline of the top layer of pavement. On a material or fabrication it may be used to indicate a thickness of material or thickness of a coating.

PROJECT. (a) The specific section of the highway or other property and related facilities on which construction under each Task Order is to be performed, or (b) the work that is to be performed under the Contract or Task Order whether completed or partially completed.

RESOURCES. Labor, equipment, materials, supplies, tools, transportation, and supervision necessary to perform the work.

ROADBED. Graded portion of a highway within top and side slopes, prepared as a foundation for the pavement structure and shoulders.

ROADSIDE. A general term denoting the area adjoining the outer edge of the roadway. Extensive areas between the roadways of a divided highway may also be considered roadside.

ROADWAY. Portion of a highway including shoulders, for vehicular use.

SHOULDER. Portion of the roadway adjacent to the traveled way for accommodation of stopped vehicles for emergency use, and for lateral support of base and surface courses.

SIDEWALK. Portion of the project constructed for the exclusive use of pedestrians.

SPECIFICATIONS. General term applied to all Contract terms, conditions, directions, provisions, and requirements.

STANDARD DRAWING (STANDARD DETAIL). Drawing approved by the Government for repetitive use, showing details to be used where appropriate.

STANDARD SPECIFICATIONS. A book or electronic file of specifications approved by the Government for general application and repetitive use.

STATION. A distance of 100 feet measured horizontally, usually along centerline.

SUBBASE. Layer of specified material between the subgrade and base course.

SUBCONTRACTOR. Individual or legal entity to whom or to which the Contractor sublets part of the Contract.

SUBGRADE. The soil or embankment upon which the pavement structure is constructed.

SUBSIDIARY. Work or material not measured or paid for directly. Compensation for such work is included in the payment for other items of work.

SUBSTANTIAL COMPLETION. The point at which the project (1) can be safely and effectively used by the Government without further delays, disruption, or other impediments; and (2) pavement structure, shoulder, drainage, sidewalk, permanent signing and markings, guardrail and other traffic barrier, safety appurtenance, utilities, and lighting is complete.

For projects that will not be opened to the traveling public or are being built in phases, the work is substantially complete when it is ready for the subsequent project.

SUPERINTENDENT. The Contractor's authorized representative in responsible charge of the work.

SURETY. Corporation, partnership, or individual, other than the Contractor, executing a bond furnished by the Contractor.

SURFACE COURSE. Top homogenous layer of the pavement structure. It is designed to withstand the wear of traffic and the disintegrating effects of climate. Sometimes called the wearing course.

TASK ORDER. A contract for services under the IDIQ Contract which specifies an estimated quantity of materials and services to be provided by the Contractor during the period of the IDIQ Contract.

TRAFFIC CONTROL PLAN (TCP). One or more project-specific plans detailing the routing of vehicular or pedestrian traffic through or around a construction area including the location of all traffic control devices.

TRAIL. An unpaved path for multiple uses.

TRAVELED WAY. Portion of the roadway designed for vehicle use, excluding shoulders.

UTILITY. Line, facility, or system for producing, transmitting, or distributing communications, power, electricity, light, heat, gas, oil, crude products, water, steam, waste, storm water not connected with highway drainage, or other similar commodity, including a Government owned fire or police signal system, street lighting system, or railroad which directly or indirectly serves the public. Also means a utility company, inclusive of any subsidiary.

WORK. Depending on the context, (a) The act of furnishing all resources for the project and performing all duties and obligations required by the Contract or (b) the physical construction, facility or end–product that is contemplated under the Contract, whether completed or partially completed.

WORKING DAYS. Calendar days, except Saturdays, Sundays, PACAF Family Days, and holidays.

WORKING DRAWINGS. Shop drawings, erection plans, falsework plans, framework plans, cofferdam plans, bending diagrams for reinforcing steel, wiring diagrams and schematics, traffic control plans, night work lighting plans, or any other supplementary plans or similar data which the Contractor is required to submit to the Government for approval.

101-2.01 CODES. References to standards, codes, specifications, recommendations and regulations refer to the latest edition/printing issued on the date of the Task Order, unless specified by year or date.

These Construction Documents, and the joint and several phases of construction hereby contemplated are to be governed, at all times, by applicable provisions of the Federal Law(s), including but not limited to, the latest amendments of the following:

1. Williams-Steiger Occupational Safety and Health Act of 1970, Public Law 91-596.

2. By agreement between the US Department of Labor, Occupational Safety and Health Administration (OSHA) and State Department of Labor, Division of Occupational Safety and Health (DOSH), and HQ 11th Air Force, applicable OSHA regulations are enforced for Contractors and Contractor personnel only by DOSH. At no time will the level of protection afforded the worker be less than the strictest of either the Federal or State regulations.

3. Code of Federal Regulations, Title 29, Parts 1910 (Occupational Safety and Health Standards) and 1926 (Safety and Health Regulations for Construction).

4. Federal Standard 313B, as it pertains to the procurement, identification, marking and control of potentially toxic or hazardous materials, and to the reporting of information concerning these materials.

5. International Building Code, International Mechanical Code and International Plumbing code.

6. National Electric code (NEC).

7. NFPA 101, Life Safety Code.

8. Applicable portions of standards listed in the Specifications that are not in conflict with Contract Documents or with the Federal Acquisition Regulations (FAR).

9. All Department of Defense, Air Force, 11th Air Force, 673rd Wing, and JBER Regulations as they pertain to construction, safety, fire, health and associated activities are part of this contract, which includes WINGI 31-203 JBER Traffic Regulations.

SECTION 102

EXECUTION OF CONTRACT

102-1.01 PROJECT LOCATION. All work areas under this contract will be performed within the geographical boundaries of Joint Base Elmendorf – Richardson (JBER), Alaska. Work areas will be identified on the issued Task Orders.

102-1.02 TASK ORDER PROCESS. When the need for work covered by this Contract arises, the Engineer will develop design documents for the project. At a minimum the design documents will include the following:

A written Scope of Work, Plan view of the work, Typical sections if needed, Pavement structural section, Details as needed, and A Bid Form which contains estimated pay item quantities to be used on the project.

Once the Contracting Officer receives the required documents from the Engineer, he will issue the Contractor a Task Order for review. The Contracting Officer will then schedule a site visit with the Contractor and Engineer to review the site and discuss the scope of the Task Order.

Any questions regarding the Task Order shall be submitted in writing to the Contracting Officer.

Within seven calendar days after the site visit, the Contractor shall return to the Contracting Officer a completed Bid Form using the form provided by the Government. The Bid Form will contain the Pay Items estimated by the Engineer, the Contractor’s estimated quantities to be used on the project, the unit bid price, total Pay Item price, and, if needed, additional Pay Items the Contractor believes are necessary to complete the work. For each Pay Item that the Contractor adds or deletes from the Engineer’s estimated list, the Contractor shall write a statement which explains why the item is needed, or not needed, and calculations showing how the quantity was derived.

The Contractor shall also include a statement and calculations which explains any Pay Item quantity deviation of 10% or more from the Engineer’s estimated Pay Item quantity.

The Contracting Officer will then forward the Contractor’s submitted documents to the Engineer for evaluation.

Upon receipt, the Engineer will either:

1. Accept the Contractor’s completed Bid Form and explanations for any additional items or quantities listed by the Contractor, or

2. Reject all or portions of the Contractor’s Bid Form. The Engineer will provide a written explanation for any rejections.

The Engineer will then submit the evaluation to the Contracting Officer. The Contracting Officer may schedule a meeting to clarify the scope of the work if necessary.

For any accepted Pay Item of which the Engineer’s and Contractor’s estimated quantity deviates by 10% or more, the Engineer will include in the evaluation a statement which justifies why the deviated quantity is acceptable.

102-1.03 ISSUING OFFICE. The following office is authorized to place Task Orders and will be responsible for the administration of placed orders:

The point of contact for this contract is the Contracting Officer. All direction and contract requirements will be determined by the Contracting Officer.

The “Contracting Officer” as used in this contract is defined as the “Contracting Officer or his/her designated representative”.

102-1.04 NOTIFICATION OF WORK START. The Contractor shall give at least 7 working days advance notice in writing to the Contracting Officer, unless approved otherwise, prior to starting any work under this Contract and prior to starting on-site work on each Task Order. Provide an “on-site start work” notice to the Contracting Officer for establishing the on-site construction start and completion dates.

102-1.05 AGENCY COORDINATION. Coordinate with the appropriate agencies, including JBER Communications Cable Maintenance (Item 7 through 17 of 673rd Wing Form 3). Notify JBER Communications Cable Maintenance at least 48 hours in advance, before actual construction/ excavation commences, to ensure proper on-site monitoring of Red Zone Areas as defined in Eleventh Air Force Regulation 700-5. Red Zone Areas are defined in Eleventh Air Force Regulation 700-5, as the distance from communication lines within which excavation will be by hand-digging or other approved methods around the communication cables.

102-1.06 FACILITY MANAGER. The Contractor shall notify each affected Facility Manager of the work schedule at 7 days and 3 days prior to starting work. In housing areas, each housing unit and the housing manager shall be notified.

102-2.01 WORK SCHEDULE. The Contractor shall submit a work schedule for each Task Order. Construction work hours are limited to Monday through Friday from 0600 to 1900 hours, excluding federal holidays, unless approved otherwise in writing by the Contracting Officer. Work hours for airfield work are similar, but may be subject to mission requirements. The Airfield Manager will be the final authority for airfield work.

The general work hours apply to work activities which require government inspection to ensure compliance with the technical specifications. This does not include heavy equipment maintenance/repairs, plant mobilizations/demobilizations, crushing operations, driving to the job site or borrow pit, field surveying, field and lab testing, and similar activities. When performed, heavy equipment maintenance/ minor repairs shall be performed in the borrow pit unless approved otherwise.

Construction work hours in Military Family Housing areas and Dorm areas are limited to Monday through Friday from 0700 thru 1900 hours, excluding federal holidays, unless approved otherwise in writing by the Contracting Officer.

Should the Contractor desire to work other than these hours, the Contractor must request approval of deviation in writing at least 24 hours prior to the period of the intended deviation, but not later than Friday 0900 hours for working on the weekend. The Contractor shall not accomplish the deviation in work hours unless approved by the Contracting Officer.

Schedules for Task Orders are independent of each other and may run concurrently. Airfield work will typically take priority over non-airfield work. Schedules for Task Orders will be approved by the Government and coordinated with the Contractor to ensure that an attainable work schedule is given.

The Contractor may be required to use multiple different work crews at the same time in different work areas to complete Task Orders based on mission essential requirements or being substantially behind schedule from the approved on-site construction schedule strictly due to the Contractor’s own fault.

Upon completion of this contract (100% completion of all Task Orders), the Contractor shall demobilize the crushing plant, asphalt plant, heavy equipment, materials, etc. from the Base within 30 calendar days unless approved otherwise by the Government.

102-3.01 FIRE, SAFETY, AND OTHER REGULATIONS. The Contractor shall comply with all national, state, local, and Air Force Fire and Safety Regulations. A copy of Air Force Fire and Safety Regulations can be reviewed at the Contracting Officer’s office.

Prior to using any open flame devices, welding equipment and other similar operations, the Contractor and subcontractor personnel performing this type of work shall be certified to issue AF Form 592, USAF Welding, Cutting and Brazing Permit. Certification training is provided by appointment and can be scheduled by contacting Technical Services at 552-2620/3267. Compliance with the requirements of NFPA Standard No 241 (Standard

1910.252 (Welding, Cutting, and Brazing) is mandatory.

102-3.02 TRAINING OF CONTRACTOR EMPLOYEES. Contractor shall ensure that all their employees, including the employees of subcontractors receive an initial Fire Prevention Orientation briefing prior to beginning any work under the scope of this contract. This briefing is given by the JBER Fire Department. To attend, send a written request to Fire Station #2, 5126 Arctic Warrior Dr.

The Contractor shall submit a written record to the Contracting Officer indicating that all employees and subcontractor employees have received this briefing. As new employees of the Contractor and subcontractor are added during the performance of this contract, update the written record to the Contracting Officer. The Contracting Officer shall retain the right to spot check employees to verify if they have been provided the briefing.

102-3.03 CONTRACTOR FIRE PREVENTION RESPONSIBILITY. It is the inherent responsibility of the Contractor to practice good fire prevention measures while working on JBER. The following represents the minimum standard of care that the Contractor shall follow:

1. The Contractor shall provide a “firewatch” person during all welding performed, which includes any welding work on heavy equipment anywhere on-JBER, including, in the borrow pits.

2. Contractor personnel shall confine smoking to designated smoking area(s).

3. Flammable paints, oil, varnishes, etc., shall be stored in a metal storage cabinet or in outside storage in a controlled area. All containers shall be labeled correctly in accordance with all Federal, State, Local, and Air Force requirements. Flammables being used outside of these areas are limited to a one day supply.

4. Temporary wiring must be in compliance with Article 305 of the National Electric Code.

5. The Contractor will be responsible for notifying the JBER Fire Department and 773rd CES Alarm Shop prior to any alarm or sprinkler system shutdowns at least 48 hours in advance.

6. Welding, cutting or brazing will only be done after a valid AF Form 592 has been issued by an individual certified by the JBER Fire Protection Flight to issue welding permits. Daily permits are required.

7. Fire extinguishers required during performance of this contract will be supplied by the Contractor.

Questions concerning fire prevention can be referred to the Technical Services Section at 552-2620/3267.

102-3.04 DD FORM 1354. The Contractor shall be responsible for preparing a draft, interim, and final DD form 1354. The draft will be available prior to scheduling and conducting a final inspection. The Contractor shall work with the Government’s Project Inspector to ensure all capital improvements are accounted for and recorded prior to invoicing for final payment.

SECTION 103

ENVIRONMENTAL PROTECTION/ HAZARDOUS MATERIALS ON JBER

103-1.01 APPLICABLE LAWS AND DIRECTIVES. The Contractor and all subcontractors, in performance of this contract, shall comply with all Federal, State and local laws, regulations, orders and ordinances concerning environmental quality and environmental pollution abatement and control.

103-1.02 TECHNICAL ASSISTANCE. Technical assistance for complex environmental problems will be coordinated with:

1. The Base Environmental Coordinator, 673 CES/CEIEC 552-2440.

2. Bioenvironmental Engineering, 673 AMDS/SGPB, 384-3985.

Work shall be accomplished within the guidance and limitations established by the following, based on the most current changes and amendments thereto:

1. Title 40, Code of Federal Regulations.

a. Parts 260-279, Hazardous Waste Management Regulations.

b. Part 61, subparts A (General Provisions) and M (Asbestos).

2. 673 ABW Instructions.

103-2.01 PROTECTION OF LAND RESOURCES. The Contractor shall furnish all labor, materials and equipment required to protect environmental quality and prevent environmental pollution as a result of work performed in accordance and/or in violation of the Technical Provisions of these specifications. Environmental pollution is defined as any activities, actions or consequences of Contractor activity that produce an undesirable effect on the human environment, including environmental resources such as land, water, air or sound. Land and water resources within the project boundaries and any other location visited by the Contractor shall be preserved or referred to conditions existing prior to this contract. The Contractor shall confine construction activities to areas allowed by the plans and specifications.

103-2.02 EXISTING STRUCTURES AND UTILITIES. No excavation shall be performed until site utilities have been field located. The Contractor shall take the necessary precautions to ensure no damage occurs to existing structures and utilities. Damage to existing structures and utilities, including monitoring wells and remediation systems, resulting from the Contractor’s operations shall be repaired at no additional cost to the Government.

Utilities encountered that were not previously shown or otherwise located shall not be disturbed without written approval from the Contracting Officer.

103-2.03 LANDSCAPE PRESERVATION. The Contractor shall not remove, disturb, injure or destroy trees, shrubs or any other surface vegetation without written authority from the Contracting Officer.

The Contractor shall protect all trees adjacent to or within the contract work area which are not specifically designated for removal in the Task Order. Protection shall include erection of sturdy barriers installed at a minimum distance of 10’ from each tree. Barriers shall be maintained intact until all grading, construction and landscaping work are completed, with exception of such contouring as is required after removal of the barriers.

All slopes shall be contoured by hand digging and hand raking to blend the protected areas into the final grade, after barrier removal.

Location of Temporary Field Offices and/or Storage Facilities: The Contractor shall obtain written permission from the Contracting Officer for locating any temporary office, storage or other buildings on Air Force controlled property. The Contractor shall request location of said facilities by submitting a letter and location drawing to the Contracting Officer. Any ground surface change or defacement caused by the location of said buildings shall be restored to the condition that existed before the contract by the Contractor, at no expense to the Government.

103-2.04 LANDFILL DISPOSAL. All non-regulated waste including asbestos materials shall be disposed in an off-base state approved site.

103-3.01 PROTECTION OF AIR QUALITY.

Emissions. Identify air pollution generating equipment or processes that may require federal, Alaska, or local permits under the Clean Air Act. Determine requirements based on any current installation permits and the

FA500019RA002 JBER Paving impacts of the project. Provide a list of all fixed or mobile equipment, machinery or operations that could generate air emissions during the project to the Installation Environmental Office (Air Program Manager).

Dust. As required by 18 AAC 50.045(d), control fugitive dust emissions. Fugitive dust emissions (airborne dust generated by vehicles operating on unpaved surfaces, transfer or transport of dust producing materials, etc.)

shall be controlled at the construction site, along haul routes and at staging areas. The Contractor shall be required to maintain all excavations and excavation activities, embankments, stockpiles, hauling activities and all other work areas free from airborne dust. Dust control shall be practiced as required for the term of the contract. The cost of any required dust control will be borne in full by the Contractor.

Open Burning. The Contractor shall not engage in any burning activities on Air Force controlled properties.

103-4.01 PROTECTION OF WATER QUALITY.

1. Surface and Groundwater.

a. The Contractor shall not operate equipment or machinery in any stream or lake without written permission from the Contracting Officer.

b. The Contractor shall prevent the deposit of any materials (including earth fill, vegetative waste, oils and grease) into any stream or lake. Any such accidental deposit will be immediately reported to the Contracting Officer.

c. The Contractor shall not directly discharge effluent from any process, including water-washing processes, into the sanitary sewer or storm drain system. Effluent and residues shall first be collected, sampled and tested for compliance with ADEC’s Alaska Pollutant Discharge Elimination System (APDES) regulations for discharge. Disposal shall be made in accordance with APDES requirements based on the test results. Sampling, testing and disposal costs shall be borne in full by the Contractor.

d. Any project which disturbs one acre or more is subject to regulations for storm water discharges. The contract will be responsible for submission of State of Alaska Department of Environmental Conservation (ADEC) (Notice of Intent (NOI) for Storm Water Discharges Associated with Industrial Activity under an APDES General Construction Permit. The contract will also be responsible for submission of stormwater pollution prevention plans (SWPPP) to ADEC or the Municipality of Anchorage, as applicable.

e. The Contractor shall not install, alter, or modify any underground injection control class V unless other options have been determined to be either technically cost prohibitive of would adversely impact mission requirements. Documentation of exceptions needs to be provided to the Environmental Quality Branch Chief before any installation, alterations, of modification may proceed in an effort to comply with the Safe Drinking Water Act, 40 CFR Part 144.

103-5.01 PROTECTION OF PERSONNEL FROM TOXIC OR HAZARDOUS MATERIALS. Reference: Title 29, Part 1910, Code of Federal Regulations, Alaska Statutes Section 18.60.010, and Federal Standard 313.

1. General. All materials used by the Contractor, or removed or handled as a part of Contractor operations will be stored, handled, utilized and disposed of in a manner designed to prevent any reasonable possibility of exposures to both Contractor and non-Contractor personnel pollution or damage to Government property or facilities, or to the environment. "Exposure" is defined as levels exceeding 1/2 of the most stringent Federal, State, Air Force, or recommended industry standards.

2. Manufacturer Supplied and Product Safety Data Sheets. Any and all known or potentially toxic or hazardous materials to be brought by the Contractor onto the military installation and or job site will require the submission of a properly completed Safety Data Sheet (SDS) as directed by 29 CFR

1910.1200 (OSHA Hazard Communications Standard), Federal Standard 313E (Fed Std 313E, 2014), and Alaska Statutes Section 18.60.010. Guidance as to what constitutes a potentially toxic or hazardous material may be found in these references. These listings are for guidance only, and do not release the Contractor from his responsibility for identification, proper handling, use, storage and disposal of these materials.

a. A copy of each SDS shall be provided to the Contracting Officer a minimum of 10 working days prior to the materials being brought onto the installation. A second complete copy will be maintained on the job site at all times for employee and inspector reference IAW 29 CFR

1910.1200 and Fed Std 313E.

b. SDSs must contain complete information. SDSs must be available for review by the Bioenvironmental Engineering function and other authorized Medical Authorities IAW 29 CFR

1910.1200 and Fed Std 313E. Bioenvironmental Engineering is authorized to review SDSs containing proprietary information. All SDSs must be clearly marked to indicate the installation on which the project is being performed, the title of the project and the contract number for the project. Material lists must be updated every 90 days and submitted to the Contracting Officer and 673 LRS (Hazmart Pharmacy).

3. Hazardous Materials Listing. A listing of all known or potentially toxic materials under the Contractor's control and currently on the installation will be maintained at the job site. The listing will include the item description and the manufacturer's name as it appears on the SDS, the quantity on hand, and where the material is stored/located. This listing will be updated daily to account for usage and receipt of new or replacement materials. The total quantity used for each hazardous material must be recorded and submitted to Contracting Officer at end of the project or calendar year, whichever comes first. This information is required for EPCRA reporting.

4. Labeling of Products. All known or potentially hazardous materials as described in items 1 through 3 above will be transported and stored in the original manufacturer's containers. These containers shall be provided with manufacturer's labels meeting the information requirements of 29 CFR 1910.1200, Alaska Statues Section 18.60.010, and AFI 90-821. Bulk materials and materials that must be re-packaged or placed into different containers at the job site will be clearly labeled by the Contractor with durable labels, meeting the above requirements. Final use containers, such as paint pots, vats, solvent tanks, etc., shall be appropriately labeled with their contents. Materials without appropriate SDSs and proper, legible labeling will not be allowed on the installation. Any materials/containers belonging to or under the control of the Contractor found not meeting these requirements will have all deficiencies corrected within 24 hours or the materials will be removed from the installation by the Contractor within the same 24-hour limit. This time limit applies regardless of time of day or day of week, and includes holidays and weekends. All corrective action costs and/or removal costs will be borne by the Contractor.

Safety Data Sheets relating to Government supplied materials, and hazards presented by Government operations at or in the Contractor's job site may be obtained through the Contracting Officer. Requests for information must be provided to the Contracting Officer a minimum of 20 working days prior to the date this information is required.

103-6.01 HAZARDOUS COMMUNICATION. Reference: 29 CFR 1910.1200, Alaska Statutes Section 18.60.010, and Air Force Instruction 90-821 Hazard Communication Program.

The Contractor shall establish and implement a written hazard communication program meeting the requirement of 29 CFR 1910.1200 and Alaska Statutes Section 18.60.010 Subchapter 15. This program shall be complete and fully implemented prior to start of work and shall be updated as necessary to reflect changes in working conditions or materials used. A complete copy of the Contractor's program shall be submitted to the Contracting Officer for approval a minimum of 20 working days prior to the start of work.

The Contractor shall, at no cost to the Government, provide workplace hazard training to all non-Contractor personnel, including Government inspectors, who will be working at or on the Contractor's job site where known or potentially toxic or hazardous materials are to be used by the Contractor. Bioenvironmental Engineering shall be present when Government personnel receive hazard training. This training shall meet the requirements of 29 CFR 1910.1200. This training program shall be complete, and all affected personnel shall be fully trained prior to the start of work. Training shall be updated or re-accomplished as necessary to reflect changes in working conditions, materials used or new personnel requiring training. This training shall be separately documented for each individual in writing, and signed by the individual and the person providing the training.

One copy will be provided to the individual, one to the individual's supervisor, one to the Contracting Officer and one maintained on-site for review by both Contracting and outside agency inspectors.

Hazard Communications information relating to Government supplied materials and hazards presented by Government operations at or in the Contractor's job site may be obtained through the Contracting Officer. The Contracting Officer may obtain this information from Bioenvironmental Engineering. Requests for information

FA500019RA002 JBER Paving must be made in writing to the Contracting Officer with sufficient lead time to allow Bioenvironmental Engineering a minimum of 20 working days to process the request.

103-7.01 HAZARDOUS NOISE. All equipment used by the Contractor that produces noise levels in excess of 84 dBA ("A" weighted decibels) must be identified as a hazardous noise source by the Contractor. This equipment will be used in a manner that precludes exposure of non-Contractor personnel to levels exceeding 84 dBA.

103-8.01 RADIOACTIVE MATERIALS PROCEDURES. Non-Air Force organizations, except DOE organizations and DOE prime Contractors, bringing radioactive materials to Air Force installations or using them there shall have an NRC or Agreement State license authorizing work on the installation and written approval from the installation commander’s appointed approval authority, normally the base Radiation Safety Officer

(RSO).

Civilian Contractors or any other agency bringing a radioactive device (including, but not limited to, soil or asphalt density meters) on Joint Base Elmendorf Richardson shall have prior approval by the Base RSO (673 AMDS/SGPB 580-4047). An application to bring a radioactive device on Joint Base Elmendorf Richardson shall be forwarded to the Base RSO at least 60 days prior to the anticipated use. The application package (two copies) shall include:

1. A copy of the NRC or Agreement State license authorizing use of the radioactive materials. The license must be current as shown by the expiration date or include a “deemed timely filed notice” from the issuing agency and either specifically list the base or grant approval for work at temporary job sites anywhere in the United States where the NRC or Agreement State has jurisdiction. EXCEPTION: DOE or DOE prime Contractors must give written certification of their exemption from NRC licensing and cite the applicable exemption of 10 CFR.

2. Copy of the operator’s qualifications and/or radiation safety training.

3. Statement of the expected start date and length of the contract.

4. A brief description of the proposed activities, to include safety precautions to be enforced.

5. A copy of that part of the Air Force contract describing work to be done at the base and the inclusive dates of the work.

6. The name, local address, and telephone number for the responsible local representative and the name, address, and telephone number of the RSO named on their license.

7. Statement of expected storage and security requirements or other particular needs of the Contractor.

8. Radiation dosimetry results for the operator for the prior calendar year, if applicable.

9. Copies of last two leak checks (if appropriate). Under no circumstances will an unlicensed radioactive device be used on Joint Base Elmendorf Richardson. Any questions on a Contractor’s responsibility, regarding this topic, shall be directed to the base RSO prior to the Contractor starting work.

10. Radiation dosimetry results for the operator for the prior calendar year, if applicable.

11. An acknowledgment that the base RSO can make periodic checks to ensure that Contractor personnel follow radiation safety practices to prevent exposure to Air Force personnel and avoid contamination of Government property. In addition, the base RSO shall have authority to suspend Contractor operations believed to be unsafe.

Agreement State licensees using NRC regulated materials must supply a copy of the NRC Form 241 approved by the base’s NRC Region according to 10 CFR 150.20. State licensees may not work on Air Force or other installations where exclusive federal jurisdiction exists for more than 180 calendar days per calendar year without first getting an NRC license 3.4.19.4. Non-Air Force organizations that don’t have an NRC or Agreement State License and who are not DOE or DOE prime Contractors exempted for licensing must contact AFMOA/SGPR for guidance and approval to use radioactive materials on an Air Force installation.

The Contractor shall notify the RSO immediately upon completion of use, and when the material(s) are removed from the installation.

Any and all accidents or incidents involving the radioactive materials, and any known or potential exposure of non-Contractor personnel to radiation shall be reported immediately to the RSO (673 AMDS/SGPB, 580-4047)

FA500019RA002 JBER Paving and the Contracting Officer, and operations shall be suspended until the circumstances have been evaluated by the RSO, and approval to re-start has been received by the Contracting Officer.

103-9.01 SPILLS. The Contractor shall immediately report any spill to the Fire Protection Flight at 911, the Contracting Officer and JBER 673 CEIEC Environmental section. The Contractor shall take steps to confine, contain, report and clean up any leak or spills that they cause. The Contractor shall comply with EPA and ADEC procedures. The Contractor shall ensure that items found currently leaking are drained, externally cleaned and contained prior to moving so that transporting them allows no further spillage.
