About this file
This is a Commercially Useful Function (CUF) Evaluation and Determination Worksheet used by the California Arts Council to assess compliance of Small Business (SB) and Disabled Veteran Business Enterprise (DVBE) suppliers for RFP-26-015 Reasonable Accommodation, Ergonomics and Training Services. The worksheet is completed for each certified SB and/or DVBE identified on the Bidder Declaration, whether serving as a prime contractor or subcontractor. The evaluation determines whether a supplier meets CUF requirements prior to contract award. The solicitation RFP-26-015 is for a single-award agreement with a three-year term for comprehensive professional services in reasonable accommodation, ergonomics, and training. Bids must be submitted by email to Procurement@arts.ca.gov by October 22, 2026, at 5 PM, with all key action dates referenced in Attachment 20.
The worksheet evaluates five core CUF compliance criteria: whether the supplier is responsible for executing a distinct element of work; whether the supplier actually performs, manages, or supervises the work; whether the work is normal for the supplier's business functions; whether the supplier is responsible for negotiating price, determining quality and quantity, ordering, and making payment for required products or materials; and whether subcontracting levels are consistent with normal industry practices. The California Arts Council accepts proposals from California independent contractors, sole proprietors, partnerships, certified SB and DVBE entities, 501(c)(3) organizations, private for-profit organizations, and joint powers agreement organizations based in California. A supplier is deemed CUF compliant only if all five evaluation questions receive affirmative responses or "N/A" designations; any "no" response results in non-compliance determination.
