Attachment 1 - Performance Work Statement (PWS) Naval Special Warfare Command (NSWC)
Joint Terminal Attack Controller (JTAC) Personnel
1. BACKGROUND
1.1 Naval Special Warfare Command (NSWC) requires Joint Terminal Attack Controller (JTAC) and Close
Air Support (CAS) training program support services. Naval Special Warfare (NSW) plans, coordinates, schedules, and executes JTAC and CAS training for Navy SEAL and Special Boat Teams (SBTs) prior to deployment. JTAC operators earn initial qualification after attending a Joint Fire Support Executive Steering Committee (JFS ESC) accredited JTAC training course. The qualifications must be sustained with continued unit level training events. This contract seeks to obtain JTAC sustainment training and management of training records.
2. OBJECTIVES
2.1 The objective of this requirement is to establish a Firm Fixed Price (FFP) Indefinite Delivery Indefinite
Quantity (IDIQ) type contract for part-time equivalent (PTE) and full-time equivalent (FTE) JTAC personnel support to provide programmatic training, program management, curriculum development support, as well as, academic instruction, to include practical field exercises that result in operators that are qualified and certified to conduct SOF JTAC operations as detailed at the task order level.
3. SCOPE
3.1 The Contractor shall provide the personnel, management, materials, and supplies (not otherwise provided by the Government) necessary to plan, schedule, execute and document JTAC training, as well as capture and report lessons learned. The Contractor shall assist in training scheduled by NSW that develops JTAC accredited Controllers and Pilots. The training consists of a number of tactical scenarios for service members that direct and engage in close air support and offensive air operations. The scenarios, identified herein, identify cases where the contractor shall assist in training Navy SEAL Team personnel and Navy =SBT’s personnel to integrate highly accurate, time synchronized, custom tactical and technology solutions in combat scenarios.
3.2 This is a "non-personal services contract" as defined in FAR 37.101. It is, therefore, understood and agreed that Contractor and/or Contractor's employees: (1) shall perform the services specified herein as independent contractors, not as employees of the Government; (2) shall be responsible for their own management and administration of the work required and bear sole responsibility for complying with any and all technical, schedule, or financial requirements or constraints associated with performance of this contract; (3) shall be free from supervision or control by any Government employee with respect to the manner or method or performance of the services specified; but (4) shall, pursuant to the Government's right and obligation to inspect, accept or reject the work, comply with such general direction of the Contracting Officer (KO), or the duly authorized representative of the KO as is necessary to ensure accomplishment of the contract objectives.
4. REQUIREMENTS
4.1 General Requirements
4.1.1 The Prime Contractor shall possess, at a minimum, a Secret Facility Clearance at time of proposal submission
4.1.2 All contractor PTE and FTEs shall, at a minimum, possess an active Secret Clearance.
4.1.3 Contractor personnel shall be able to work in an environment that is fast paced while completing multiple tasks and meeting stringent timelines.
4.1.4 Contractor personnel shall perform data entry on computers utilizing current versions of
Microsoft Windows, and Microsoft Office applications like Excel, Word, PowerPoint and other related programs.
4.1.5 Contractor personnel shall travel multiple times to various CONUS locations for periods up to two weeks.
4.1.6 Contractor shall provide proof in Automated JTAC Academic Currency Tracking System (AJACTS) of current JTAC-Instructors and Evaluators (JTAC-I & E) qualifications to facilitate government initiation of Letters of Designation.
4.1.6.1 If Contractor member is not an active user or registered in AJACTS, they shall

provide their JTAC Evaluation Folder with the last 24-months of CAS currency.
4.1.6.2 Currency shall include but are not limited to
4.1.6.2.1 USSOCOM IMT 43 SOF JTAC Certification of Evaluation
4.1.6.2.2 AF Form 8 Certificate of Aircrew Qualification
4.1.6.2.3 AF IMT 3827 Terminal Attack Control Evaluation and
Certification
4.1.6.2.4 Other service equivalent JTAC evaluation forms.
4.1.7 Contractor personnel shall have current JTAC Instructor qualification (2 points) OR current JTAC Evaluator qualification.
4.1.8 Contractor personnel shall have SOF training experience OR SOF combat experience.
4.1.9 Contractor personnel shall have JTAC deployed experience.
4.1.10 Contractor personnel shall be a subject matter expert (SME) in 3-09.3 Joint Tactics Techniques and Procedures for Close Air Support and the J-Fire Multi-Service Tactics, Techniques and Procedures for the Joint Application of Firepower.
4.1.11 Contractor personnel shall maintain state and OF-346 Government driver's license to allow for operation of light vehicle through 1 1/4 ton and passenger through 12 passenger government vehicles
4.1.12 Specific requirements will be assigned at the task order level for each respective Group.
4.2 JTAC PROGRAM ADMINISTRATION ASSISTANT RESPONSIBLITIES
4.2.1 Contractor shall maintain Training Records.
4.2.1.1 Contractor shall create a six-part training folder for each trained JTAC operator that conforms to COMNAVSPECWARCOMINST 3000.6 series and USSOCOM M 350-5.
4.2.1.2 Contractor shall review and validate each training record for currency and accuracy on a quarterly basis.
4.2.1.3 Contractor shall update training records for each operator upon completion of a training event.
4.2.1.4 Contractor shall conduct data entry into AJACTS to include CAS calls logging, individual JTAC proficiency, and Controller Read Files (CRF) in accordance with USSOCOM M 350-5, chapter 8.
4.2.1.5 Contractor shall ensure that all records include operational controls, deployed JTAC operational training and a prescriptive program to recertify NSW personnel upon returning from deployments before the 90-day requalification deadline.
4.2.2 Contractor shall incorporate, Government provided, lessons learned into training scenarios.
4.2.3 Contractor shall submit the following reports:
4.2.3.1 Submit Monthly Status Reports (MSR) to include Command Mission Readiness (CMR) and training plan for deficiencies.
4.2.3.2 MSR meeting minutes.
4.2.3.3 Contractor shall generate, on request, AJACTS reports that list current Individual, Group and Team JTAC qualification and continuation training compliance status.
4.2.3.4 Contractor shall generate, on request, AJACTS reports that list statistics to support
JTAC program trend analysis on qualification levels and program health.
4.2.4 Contractor shall coordinate training in conjunction with Government JTAC program representatives.
4.2.4.1 Contractor shall assist government personnel in scheduling Government range reservations, planning training events and developing training schedules.
4.2.4.2 Contractor shall coordinate CAS training trips for all NSWC units, maximizing the number of NSW personnel to attend any given CAS training event.
4.2.4.3 Contractor shall plan training events that prioritize based on deployment rotation schedules and training certification expirations, ensuring that each and every trip maximizes aircraft and sorties used by NSW personnel.
4.2.5 Contractor shall provide recommendations in the development and implementation of JTAC Qualification Development Program. The Contractor shall conduct an annual program review of their assigned NSW’s JTAC training and qualification program that produces multiple levels of skilled JTACs, JTAC-Instructors and JTAC-I & E, JTAC Program Managers, Program Administrators and produce a report of recommendations for improvement to the NSW’s JTAC PM 30 days before the end of the period of performance.
The report shall address the following program elements:
4.2.5.1 Improvements to pipeline and career progression for personnel who wish to be or are current JTAC qualified personnel.
4.2.5.2 Effectiveness of the NSW JTAC Evaluation and Training Program for JTAC-Is
& Es.
4.2.5.3 Recommendations for developing an “individual” JTAC skill progression as each individual operator progresses through career, rank and skill as outlined in the JTAC Qualification Development Program.
4.2.5.4 Suggestions for design and execution of a JTAC Evaluation and Training program that incorporates JTAC training into existing ULT events to maintain sufficient JTAC qualification levels in conjunction with all other WARCOM individual skills.
4.2.6 Contractor shall recommend changes to the 40-hour NSW JTAC Refresher Course in AJACTS when technical data, techniques and procedures are updated.
4.2.7 Contractor shall update instructor, student and media materials.
4.2.8 Contractor shall update JTAC training syllabi development based on the annual program review.
4.2.9 Contractor shall participate in courseware validation of updated training materials as part of the government team conducting JTAC training.
4.3 JTAC PROGRAM ADMINSITRATION ASSISTANT QUALIFICATIONS:
4.3.1.1 Secret Security Clearance is required for this position.
4.3.1.2 Contractor shall have a minimum of three (3)-years of JTAC-I SOF experience.
4.3.1.3 Contractor shall have JTAC deployed experience within the last seven (7) years.
4.3.1.4 Contractor personnel shall have experience performing data entry on computers utilizing current versions of Microsoft Windows, and Microsoft Office applications like Excel, Word, PowerPoint and/or other related programs.
4.3.1.5 Contractor shall be familiar with all governing JTAC Instructions and Regulations.
4.3.1.6 Contractor shall be familiar with JTAC tracking programs.
4.3.1.7 Contractor shall have a thorough working knowledge of the Automated JTAC
Academic Currency Tracking System (AJACTS).
4.3.1.8 Contractor shall have a complete USSOCOM Records Review 797.
4.4 JTAC INSTRUCTOR/EVALUATOR RESPONSIBILITES:
4.4.1 Provide instruction for Pre-IQT, MQT, and ongoing CT currency throughout the IDTC.
4.4.2 Provide written recommendations to NSWC SOF JTAC government personnel in the development/update of Academic Classroom/Computer-Based Courses of Instruction (COI) when SOF JTAC techniques/procedures change. Train NSWC personnel in the following:
4.4.2.1 United States Special Operations Command (USSOCOM) JTAC Joint
Publications and Read Files.
4.4.2.2 Joint Service Air Platform Capabilities
4.4.2.3 Sea-to-Surface Fires Integration
4.4.2.4 Fixed Wing Fighters and Rotary Wing Aircraft
4.4.2.5 Weapons, Fuses, and Weaponeering
4.4.2.6 Command and Control Networks
4.4.2.7 Marking and Signaling Devices
4.4.2.8 Close Air Support (CAS) Scenario Generation Special Instructions
4.4.2.9 Mixed Force Integration
4.4.2.10 Range and Military Operating Airspace (MOA) Specific Target Sets
4.4.2.11 Airspace Control Measures
4.4.2.12 Operational Task Link (OPTASKLINK) and Tactical Datalink
4.4.2.13 Conduct of Pre and Post Mission Briefs
4.4.3 Contractor shall provide training that complies with policies, regulations, and procedures outlined in paragraph 18 Applicable Government Documents.
4.4.4 Contractor shall provide all training materials outlined in Paragraph 5 Special Material
Requirements.
4.4.5 Practical Exercises and Field Training. Conduct Practical Training in Tactics, Techniques and Procedures (TTPs) for the following:
4.4.5.1 Controlling live air assets with contractor providing real-time feedback on JTAC performance
4.4.5.2 Types 1 and 2 CAS Controls
4.4.5.3 Command and Control Networks Simulations
4.4.5.4 Unmanned Aerial Systems (UAS) Integration
4.4.5.5 Video Downlink (VDL) and Datalink Operations
4.4.5.6 Authorized Digital CAS Platform
4.4.5.7 Digital Close Air Support (DCAS)
4.4.6 SMEs shall provide training that conforms to policies, regulations, and procedures outlined in Paragraph 19 Applicable Government Documents.
4.4.7 Contractor shall engage in continuing education of communication equipment required for CAS to include, but not be limited to, courses of instruction and qualification from Sierra Nevada, Viacom, or other organizations that certify JTACs in the use of Link-16 and other Low Probability of Intercept / Low Probability of Detection (LPI/LPD) communications. Continuing education is required to ensure NSWC SOF JTACs receive training support that aligns with evolving TTPs and mission requirements.
4.4.8 Contractor shall maintain JTAC currency. Should Contractor have a lapse in JTAC currency, Contractor shall remedy the deficiency to ensure SOF JTAC oversight and training support conforms to applicable publication and instruction requirements.
4.4.9 Contractor shall engage in continuing education of CAS; TTPs for the Joint Application of Firepower; Surface-to-Surface and Sea-to-Surface Fire Support.
4.5 JTAC INSTRUCTOR/EVALUATOR QUALIFICATIONS:
4.5.1 Secret Security Clearance is required for this position.
4.5.2 Contractor shall have a minimum of three (3)-years of JTAC-I SOF experience.
4.5.3 Contractor shall have JTAC deployed experience within the last seven (7) years.
4.5.4 Contractor shall provide proof in AJACTS (current electronic record system) of current
JTAC-I and/or JTAC-E qualifications to facilitate government initiation of Letters of Designation. Contractor shall qualify as a SOF JTAC-I or SOF JTAC-E as required.
4.5.5 Contractor shall demonstrate familiarity with SOF JTAC TTPs.
4.5.6 Contractor shall possess extensive familiarity with JTAC TTPs in post-9/11 CAS employment during counterinsurgency (COIN) and counter violent extremist organization (CVEO) combat operations.
4.5.7 Contractor shall possess familiarity with SOF JTAC operations and TTPs applicable to Major Combat Operations and the Strategic Competition context, to include equipment required for tactical communications in denied environments.
4.5.8 Contractor shall have experience instructing in current theater Special Instructions
(SPINS).
4.5.9 Contractor shall have expertise in building mission products for scenario development.
4.6 JTAC PILOT/WEAPONS SYSTEM OFFICER (WSO) SUBJECT MATTER EXPERT (SME)
REQUIREMENTS:
4.6.1 Contractor shall operate handheld Link-16 equipment.
4.6.2 Contactor shall operate with tactical JTAC radios.
4.6.3 Contractor shall operate JTAC targeting equipment.
4.6.4 Contractor shall attend equipment expos and equipment related conferences.
4.6.5 Contractor shall participate in the testing and evaluation of emerging JTAC equipment.
4.7 JTAC PILOT/WSO SME QUALIFICATIONS:
4.7.1 Secret Security Clearance is required for this position,
4.7.2 Contractor shall be a graduate from the USAF Weapons School, USN TOPGUN, MAWTS-1, or equivalent training.
4.7.3 Contractor shall have Pilot/Weapons Systems Officer (WSO) experience with no less than 500 hours performing CAS missions and task with the last five (5) years in a tactical aircraft, to include attack helicopters, United States Air Force (USAF), United States Marine Corps (USMC), or United States Navy (USN).
4.7.4 Contractor shall be a Pilot/WSO/Sensor Operator SME in 3-09.3 Joint Tactics Techniques and Procedures for Close Air Support and the J-Fire Multi-Service Tactics, Techniques and Procedures for the Joint Application of Firepower.
4.7.5 Contractor shall have experience with post-9/11 combat CAS operations or FAC-A qualified.
4.7.6 Contractor shall be familiar with CAS operations and TTPs applicable to Major Combat Operations and the Strategic Competition context, to include equipment required for tactical communications in denied environments.
4.7.7 Contractor shall have prior programmatic experience managing or tracking JTAC qualifications, or SOF inspection experience.
4.7.8 Contractor shall have prior experience with AJACTS records management.
4.8 Confirmation of Certifications and Licensing of Contractor Employees
4.8.1 Documentation providing proof of licensing/certification is required to be provided to the COR within 10 days of the initial request.
5. SPECIAL MATERIAL REQUIREMENTS:
5.1 Contractor shall provide their personnel who support NSWC training with:
5.1.1 Personal Protective Equipment (PPE) to include, but not limited to, range specific items required to conduct “live” ordnance CAS operations: ballistic plates/body armor, helmet with NVGs, cold weather gear, helicopter deck retention, individual first aid kit (IFAK), hydration system, ballistic eye protection, laser eye protection, and other equipment as may be required to ensure safety during “live” fire ranges.
5.1.2 Accessory components included antennas, push-to-talk, headsets and other communications ancillary gear as may be required. This is gear essential to enable Contractor personnel to communicate with SOF JTACs, aircraft, RSOs, Range Control, and other points of contact necessary to ensure the safety of all personnel involved in CAS and Fires training.
5.1.3 Marking Equipment to include IR strobes, daytime visual signal marking panels, and signal mirrors.
5.1.3.1 Government Provided Communications equipment to include:
5.1.3.1.1 Non-Crypto Radios and accessory components that are compatible with PRC-148, PRC-152, PRC-161, PRC-163, and other tactical radios as may be required for the training scenarios.
5.1.3.1.2 ATAK or approved device and accessory components.
5.1.3.1.3 The applicable equipment shall be provided to each contract instructor or as required by scenario.
5.1.4 Contractor shall provide SEAL and SBT Operator trainees with appropriate instructional materials. Such materials may include, but not be limited to, printed student handouts or other applicable electronic media. Instructional aids shall be provided to trainees prior to the training to allow adequate read ahead.
5.1.4.1 Seventy-two hours prior to training shall be the standard for providing trainees with appropriate instructional materials.
5.1.4.2 Should circumstances preclude delivery of materials 72 hours prior to training, then Contractor shall provide materials no less than 24 hours prior to the intended training.
6. KEY PERSONNEL REQUIREMENTS
6.1 Certain experienced technical personnel are essential for successful accomplishment of the work to be performed under this contract. Such personnel are defined as “Key Personnel”. These individuals will be handled in accordance with the provisions contained in SOFARS 5652.237-9001 – Key Personnel Requirements.
6.1.1 The following positions are identified as Key Personnel:
6.1.1.1 JTAC Program Administration Assistant
6.1.1.2 JTAC Instructor/Evaluator
6.1.1.3 JTAC Pilot/WSO SME
6.2 The Government reserves the right to request, and review resumes. Additionally, if requested, the Contractor shall provide verification of compliance with any certification requirements identified in the PWS no later than 14 calendar days of the request.
6.3 The Government may seek consideration for Key Personnel vacancies in excess of 15 consecutive workdays.
7. WORK HOURS/HOLIDAYS
7.1 Work may occur only Monday – Friday, excluding all federal holidays. No services or deliverables shall be performed on Saturdays, Sundays or Federal legal holidays. Deliverables due on a Saturday, Sunday, or Federal holiday shall be due on the following business day.
7.1.1 Observance of Federal Holidays:

7.1.2 If the date falls on a Saturday, the Government holiday is the preceding Friday. If the date falls on a Sunday, the Government holiday is the following Monday.
7.1.3 In addition to the days designated as holidays, the Government observes the following days:
Any other day designated by Federal Statute Any other day designated by Executive Order Presidential Inauguration Day Any other day designated by the President’s Proclamation
7.1.4 It is understood and agreed between the government and the contractor that observance of such days by government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation except as set forth within the contract. In the event the contractor’s personnel work during the holiday, they may be reimbursed. This provision does not preclude reimbursement for authorized overtime work if applicable to this contract.
7.1.5 When the Federal, State, Local or other Government entity grants excused absence to its employees, assigned contractor personnel may also be dismissed. The contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled and must be guided by the instructions issued by the Contracting Officer or COR.
7.1.6 If government personnel are unavailable due to furlough or any other reason, the contractor must contact the Contracting Officer or the COR to receive direction. It is the government’s decision as to whether the contract price will be affected. Generally, the following situations apply:
7.1.6.1 Contractor personnel who are able to continue contract performance (either on-site or at a site other than their normal workstation), must continue to work and the contract price shall not be reduced or increased.
7.1.6.2 Contractor personnel who are not able to continue contract performance (e.g., support functions) may be asked to cease their work effort. This may result in a reduction to the contract price.
8. RIGHTS IN DATA
8.1 The contractor will be prohibited from copyrighting, publishing or disseminating information resulting from work performed under this contract, and/or, using data produced or obtained under this contract, and/or any other information or products provided by the Government, or which the contractor develops, for any purpose other than performance under this contract without prior written approval from the Contracting Officer.
8.2 Ownership of Documents, Materials and Records: All documents, materials (including any computer code) or records provided to the contractor, developed or maintained by the contractor in the performance of this contract are deemed to be property of the Government.
8.3
9. LIMITED USE OF DATA
9.1 Performance of this effort may require the contractor to access and use data and information proprietary to a government agency or government contractor which is of such a nature that its dissemination or use, other than in performance of this effort, would be averse to the interests of the government and/or others.
9.2 Contractor and/or contractor personnel shall not divulge, or release data or information developed or obtained in performance of this effort, until made public by the government, except to authorized government personnel or upon written approval of the Contracting Officer. The contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort. Nothing herein shall preclude the use of any data independently acquired by the contractor without such limitations or prohibit an agreement at no cost to the government between the contractor and the data owner which provides for greater rights to the contractor.
10. PARTICIPATE IN POST AWARD CONFERENCE.
10.1 This meeting shall provide an introduction between the Contractor personnel and Government personnel who will be involved with the contract. The meeting will provide the opportunity to discuss technical, management, and security issues. The Post Award Conference will aid both the Government and Contractor in achieving a clear and mutual understanding of all requirements and identify and resolve any potential issues. The Contractor shall be prepared to discuss any items requiring clarification and gather information as necessary to support each deliverable. The Contractor shall provide a written summary of the Post-Award Conference.
10.2 Contractor Facilities:
10.2.1 Contractor shall abide by all applicable regulations, and procedures in accordance with
NSWC Range Safety Procedures, RSO Job Qualifications COMNAVSPCWARCOM
INSTRUCTION 3591.1C.
10.2.2 Contractor shall abide by OPNAVINST 1500.75C Policy and Governance for High-Risk Training. All prospective high-risk instructors (military, civilian, or contractor) shall be screened for suitability per this instruction prior to assuming their duties, at a minimum.

10.3 Professional Standards:
10.3.1 The Contractor shall exhibit professional conduct and comply with all applicable Federal, DoD, Navy, and USSOCOM regulations, instructions, directives, and policies in performance of this contract.
10.3.2 The Government requires the Contractor to access classified information in performance of this contract. In the event the Contractor is involved with a potential spillage, security violation, or information technology violation, the Contractor shall cooperate in any related inquiry or investigation, which may include but not be limited to the Government securing Contractor property or Contractor employee personal property as determined necessary by the Government and/or conducting forensic analysis. 10.4 Training
10.4.1 The Contractor shall provide required training for employees to meet the performance requirements of the contract. The Government will not fund or provide required training.
It is expected that the Contractor as part of the performance of this contract will be required to take specified Government furnished training (e.g. Active Shooter Training).
The Contractor may perform these required training as part of the performance of this contract. The designated CORor Technical Representative will provide the required courses and completion deadlines. The Contractor shall complete these as part of the services completed under this contract.

12. CONTRACTOR MANPOWER REPORTING
12.1 The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for NSW’s N3 via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address:
http://www.sam.gov. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013. 13.2.38 The Government will solicit the Contractor’s quote for Travel prior to award of Orders. The
Contractor will be requested include within their quote the travel date(s), location(s) and number of travelers (if not dictated by the Government), and all associated Travel and Per Diem allowances. The Contracting Officer will review the Travel quote for price reasonableness, typically considering standard rates for lodging, meals, and incidental expenses as posted on http://www.ecmra.mil/ https://www.gsa.gov/travel/plan-book/per-diem-rates, and any other reasonable basis. The Contracting Officer will establish a firm-fixed price (FFP) not-to-exceed (NTE) amount for Travel under the Order. The Contractor shall invoice the Government for actual travel expenses incurred within the FFP NTE Travel amount. Increases to the FFP NTE Travel amount can only be authorized by a warranted Contracting Officer. Prior to invoice approval, the Contracting Officer Representative (COR) may request substantiating documentation for travel expenditures.
13.3 Failure to gain prior approval for travel may result in the disallowance of invoiced travel costs.
14. SECURITY
14.1 Security will be in accordance with the attached DD254. Contractor team individual(s) supporting this task will be cleared at the SECRET level at the start of the task. Contractors will require access to Communications Security (COMSEC) and Restricted Data (RD) in performance of this effort.
Contractor will require access to NIPRNET at government and contractor facilities and SIPRNET only at government facilities. Contractor will be authorized to courier classified information up to SECRET in performance of official duties upon approval of and designation by the COR. The sensitive information included in training products and the TTPs utilized during Full Mission Profile Scenarios necessitates Contractor have the requisite SECRET clearance to maximize support for desired training objectives.
14.2 The Contractor shall ensure requirements for safeguarding classified information and classified materials and for protecting government property. The Contractor's management system shall prevent unauthorized disclosure of classified and sensitive unclassified information. The Government shall be immediately notified of any security incident or any indication of a potential unauthorized disclosure or compromise of classified or sensitive unclassified information. The Contractor shall provide security management support. Typical efforts include, but are not limited to, performing classified document control functions, classified materials inventories, program access requests, preparing and monitoring personnel indoctrination and debriefing agreements, and maintaining and using security-related databases.
14.3 The Contractor shall establish appropriate administrative, technical, and physical safeguards to protect all nonpublic Government data to ensure the confidentiality, integrity, and availability of Government data.
14.4 MARKINGs: The Contractor shall refrain from using “Naval Special Warfare’ (NSW) or “Naval Special Warfare Command” (NSWC), reference to any NSWC personnel by title or position within NSWC, or this contract in any of its publications, websites, materials, media, or advertising media.
14.5 All Contractor personnel are required to be citizens of the United States.
14.6 The Contractor must be able to obtain personnel and vehicle access to military installations. Contractor is responsible for coordinating all necessary access through the local Military Pass and Decal Office.
14.7 The Contractor team individuals supporting specific requirements will be cleared at the SECRET level as soon as practicable following the start of the task. Contractors will require access to Communications Security (COMSEC), Restricted Data (RD) and Alternative Compensatory Control Measures (ACCM) material/information in performance of this effort. Contractor personnel will be cleared at the minimum SECRET level at the start of the task. Contractor will require access to NIPRNET at government and Contractor facility and SIPRNET and JWICS computer systems only at government facilities.
14.8 The Contractor shall comply with applicable DoD, Navy, USSOCOM and NSWC cyber-security, information technology (IT) systems, network, and/or security applicable instructions and policies, and ensure all Contractor personnel have read and agree to comply with such instructions and policies. The Contractor shall especially be familiar with NSWC Acceptable Use Policies and provide training to its personnel as to appropriate practices when interacting with Government IT systems and networks.
14.9 PRIVACY ACT
14.9.1 The Contractor will have access, work with, and/or have to input personally identifiable information (PII) into Government Information Systems in performance of this contract.
The Contractor shall adhere to Privacy Act requirements and applicable DoD, Department of Navy (DoN), and USSOCOM regulations, instructions, directives, and policies regarding PII, including but not limited to NIST 800-122 “Guide to Protecting the Confidentiality of Personally Identifiable Information (PII).”
14.9.2 For PII the Contractor agrees to assume responsibility for protecting such information, using best practices, and compliance with applicable references.

14.10 During performance, this contract may involve IT, IS, and/or software that requires Government approvals in accordance with applicable DoD cybersecurity and/or information assurance regulations, policies and instructions. Compliance and/or efforts to obtain such approval shall be at no additional cost to the Government and shall be included in any firm-fixed prices. For performance that may involve outside information technology, information systems, or external software that requires approval via N6. Note, of course, it would require discussion with the customer as to whether fair to say all should be included and the effort may require more detailed discussion of requirements if an ATO is required.
15. SAFETY – JTAC training is High Risk Training.
15.1 Safety in all training events shall be paramount. The contractor shall comply with and maintain appropriate safety instructions and qualification standards in accordance with the PWS:
15.2 Government Responsibility
15.2.1 The COR will assign a Range Safety Officer (RSO), NSW High Risk Training Safety Officer, and NSW CQC Range Manager for each training event.
15.2.2 The assigned Government RSO will ensure that a range assessment is performed for all non-DoD live fire ranges IAW COMNAVSPECWARCOMINST 3591.1D prior to first-time use. Close Quarter Combat (CQC) Ranges will require an assessment by a team consisting of an NSW RSO, NSW High Risk Training Safety Officer, and NSW CQC Range Manager. Assessments will be conducted in accordance with enclosure (3) of the above referenced instruction.
15.2.3 The supported SEAL/Boat Team will conduct course monitoring to ensure the quality and safety of the exercise.
15.2.4 The Government shall provide the contractor with applicable safety doctrine as appropriate.
15.2.5 The Government will have the authority to stop any training being provided when he or she determines that the safety of students, contractor employees or other personnel are at risk.
15.3 Contractor Responsibility
15.3.1 The Contractor shall coordinated with RSO, NSW High Risk Training Safety Officer, and
NSW CQC Range Manager regarding concerns for safety of students, contractor employees or other personnel.
15.3.2 Nothing in the PWS, nor any Government action or failure to act in performance of the contract shall relieve the contractor of its responsibility for the safety of the contractor's personnel and property, the Government's personnel and property, and the general public.
Furthermore, nothing in this PWS shall relieve the contractor of its responsibility for complying with applicable Federal, State, and Local laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.
15.3.3 Mishap (as defined in OPNAVINST 5102.1D, Mishap Investigation and Reporting). If a mishap involving services under this contract results in an injury, the contractor shall promptly report the incident. If the Government conducts an investigation of the accident, the contractor shall cooperate and assist Government personnel until the investigation is complete. Contractors shall include a clause in subcontracts, if any, under this contract to require subcontractor cooperation and assistance in accident investigations. Contractors shall allow authorized Government representatives access to the contractors’ facilities, personnel and safety program documentation. See paragraph 15.5 for procedures regarding mishap reporting.
15.3.4 Non-Disclosure Agreement. All training scenarios and the names of participants/units in those scenarios, is confidential information. The Vendor shall not disclose to any third party the nature of training being conducted, or the names of individuals, names of units or home bases of those units who are participating in the training. Additionally, the vendor reflect will not use participating units for commercial representation or advertising.
15.4 Risk Controls
15.4.1 This training is categorized as High Risk in accordance with COMNAVSPECWARCOMINST 1500.1. As such, an Operational Risk Assessment and the implementation of risk controls are required for this training event.
15.4.2 Troop will insure a certified SOC-M medic is on station at each training event and there is a designated vehicle identified to support CASEVAC.
15.5 Mishaps
15.5.1 The Government process must be in place that will ensure any mishaps are reported, investigated, and recorded. This information will be input into the Risk Management Information (RMI) System by the Government.
15.5.2 Safety and training related problems or mishaps involving or observed by the contractor shall be addressed immediately to the COR. A formal written report shall be prepared and submitted to the COR within 2 working days of the incident.
16. GOVERNMENT FURNISHED PROPERTY/EQUIPMENT/INFORMATION (GFP/GFE/GFI)
16.1 All support equipment including workspace, computers, telephones, access to printer/copier/fax, and other reasonably necessary office supplies will be provided by the Government as required. The Contractor is responsible for the safe and secure storage of Government-furnished equipment; all Government property shall be returned at the conclusion of this effort.
16.2 Disclosure of Information
16.2.1 Information made available to the contractor by the government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer.
16.2.2 The contractor agrees to assume responsibility for protecting the confidentiality of government records, which are not public information. Each contractor or employee of the contractor to whom information may be made available or disclosed shall be notified in writing by the contractor that such information may be disclosed only for a purpose and to the extent authorized herein.
16.3 Physical Security: The Contractor shall safeguard all Government equipment, information, and property provided for Contractor use. At the close of each day, shift, or work period, Government facilities, equipment, and materials shall be secured.
17. QUALITY CONTROL PLAN
17.1 The contractor shall implement and maintain a Quality Control Plan (QCP) to ensure work performed conforms to the scope of work and meets the requirements under this PWS. The QCP shall, at a minimum provide a method for performing inspections; identifying, correcting and preventing problems/defective service; addressing customer complaints, and improving the quality of services over the life of the contract.
18. QUALITY ASSURANCE
18.1 The Government reserves the right to perform inspections and surveillance to evaluate the Contractor’s compliance to the contract terms and performance of the requirements in the PWS. The Government will assign a COR who will be responsible for monitoring performance in accordance with the requirements of the PWS. The COR will make every effort to ensure that the surveillance methods used are conducted in an objective, fair, and consistent manner.
18.2 Contract Discrepancy Report (CDR). In the event of unsatisfactory contractor performance, the Contacting Officer will issue a CDR that will explain the circumstances and findings concerning the incomplete or unsatisfactory service. The contractor shall acknowledge receipt of the CDR and respond in writing as to how he/she shall correct the unacceptable performance and avoid a recurrence. The Government will review the contractor's corrective action response to determine acceptability and will use any completed CDR as part of an overall evaluation of Contractor performance when determining present or future contractual actions.

20. PLACE OF PERFORMANCE
20.1 Primary place of performance shall be in Norfolk, VA, Imperial Beach, CA, or Pearl City, HI, based on which NSWC Group is supported and shall be identified at the task order level. Short term training locations are specified in paragraph 13.2.
21. PERIOD OF PERFORMANCE
21.1 This contract contains a five-year ordering period starting on the date of contract award.
22. COVID-19 CONSIDERATIONS: Contractor shall follow all CDC and DOD guidelines for COVID prevention, to include but not limited to vaccination and/or reoccurring testing as required by Government.
Contractor is responsible to provide all required Personal Protection Equipment (PPE). PPE includes: N95 masks, disposable nitrile gloves, and hand sanitizer for their employees. Contractor personnel may be subject to quarantine periods and shall comply with any federal, state, or local quarantine requirements. Contractor personnel may be subject to medical screening. Any personnel with a fever (temperature of 100F/37.8C or greater), cough, shortness of breath, or loss of smell will not be permitted on site. Contractor shall inquire and not utilize contractor personnel that have been exposed to any persons known to have been exposed to COVID- 19.
| 4. REQUIREMENTS |
| 4.1 General Requirements |
| 4.1.1 The Prime Contractor shall possess, at a minimum, a Secret Facility Clearance at time of proposal submission |
| 4.1.2 All contractor PTE and FTEs shall, at a minimum, possess an active Secret Clearance. |
| 4.1.3 Contractor personnel shall be able to work in an environment that is fast paced while completing multiple tasks and meeting stringent timelines. |
| 4.1.4 Contractor personnel shall perform data entry on computers utilizing current versions of Microsoft Windows, and Microsoft Office applications like Excel, Word, PowerPoint and other related programs. |
| 4.1.5 Contractor personnel shall travel multiple times to various CONUS locations for periods up to two weeks. |
| 4.1.6 Contractor shall provide proof in Automated JTAC Academic Currency Tracking System (AJACTS) of current JTAC-Instructors and Evaluators (JTAC-I & E) qualifications to facilitate government initiation of Letters of Designation. |
