About this file
This is a federal contracting representation form regarding compliance with telecommunications and video surveillance equipment restrictions under Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019.
The form requires contractors to make two mandatory representations. First, contractors must declare whether they will or will not provide covered telecommunications equipment or services to the Government during contract performance. Second, contractors must represent whether they do or do not currently use covered telecommunications equipment or services, or use any equipment, system, or service containing such covered items, based on reasonable inquiry. If contractors respond affirmatively to either representation, they must provide detailed disclosure information including: the entity producing the covered equipment (name, unique entity identifier, CAGE code, and OEM or distributor status); descriptions of all covered equipment offered (brand, model number, OEM number, manufacturer part number, or wholesaler number); descriptions of covered services with Product Service Codes when applicable; and explanations of proposed use and factors demonstrating permissibility under the applicable prohibition. The prohibitions apply to executive agency procurements effective August 13, 2019 for direct agency purchases and August 13, 2020 for contracts with entities. The form includes carve-outs for third-party services such as backhaul, roaming, and interconnection arrangements, and for telecommunications equipment that cannot route or redirect user data traffic. Contractors must review the System for Award Management (SAM) exclusion list for entities barred from federal awards for covered telecommunications equipment or services. The form requires signature, typed name, date, member legal name, and Unique Entity Identifier (UEI).
