About this file

This is a Certification of Apprenticeship Programs document related to New York Labor Law §816-b, specifically for the Schenectady City Hall Clock Tower Restoration project. The document requires bidders/contractors to certify they have entered into appropriate apprenticeship agreements registered and approved by the New York State Commissioner of Labor. The certification mandates that all work performed under the contract must be executed by the contractor, its affiliates, or subcontractors who possess a NY State Labor Department apprenticeship program certificate of compliance for the specific trade required.

The document outlines specific requirements for apprenticeship programs, with pre-identified trades including Laborers and Operating Engineers. For projects valued at $300,000 or more, contractors must provide proof of applicable apprenticeship program approvals to the City Engineer as a requisite component of the bid. The certification form allows bidders to list affiliates/subcontractors and specify their respective work to be performed, ensuring transparency and compliance with labor training and workforce development standards for the restoration project.

CERTIFICATION OF APPRENTICESHIP PROGRAMS

In accordance with the provisions of the New York Labor Law §816-b, the Bidder/Contractor hereby certifies that it (or any subcontractors and/or affiliates) has entered into apprenticeship agreements appropriate for the type and scope of work to be performed, and specified below, that the same have been registered with and approved by the Commissioner of Labor of the State of

New York. Any bid submitted by a contractor intending to rely upon the services of an affiliate company or sub-contractor must identify the affiliate or sub-contractor and identify those aspects of the bid that will be performed by that affiliate or subcontractor. The award of any contract will be premised and specifically conditioned upon the Contractor’s representation that it could not perform all elements of the contract itself and that the use of an affiliate or subcontractor was required to perform all services required by the contract.

The Bidder/Contractor by executing this certification represents, acknowledges and agrees that all work required to be performed in the execution and completion of the contract shall be performed by the Contractor or by its affiliate or subcontractor and that all aspects of the contract will be performed by the company possessing the NY State Labor Department apprenticeship program certificate of compliance for the trade required to perform that aspect of the contract and utilizing the labor and equipment of that company as specified below. Bidder/Contractor further warrants, represents and agrees that it will at all time ensure compliance with this requirement of the contract and that the applicable apprenticeship programs will remain in full force and effect through the completion of the contract.

The Bidder/Contractor shall provide proof of all applicable approvals to the City Engineer for projects $300,000.00 or more appropriate for the scope of the work as determined by the City

Engineer. Such approvals shall be filed as a requisite component of the bid. See requirements below:
