About this file
The document is a Certification Pursuant to Section 103-g of the New York State General Municipal Law for Iranian Energy Sector Divestment, applicable to bidders and proposers engaging in state and local contract opportunities. This certification requires bidders to confirm they are not on a list of entities with investments in Iran's energy sector, specifically focusing on investments made after April 12, 2012. Bidders must certify under penalty of perjury that they do not have ongoing or expanded investments in Iran, with provisions for potential exemptions if investment activities were initiated before the specified date or if the goods and services are deemed essential for the political subdivision's functions.
The document outlines two primary scenarios where a bid might still be considered: first, if investment activities in Iran occurred before April 12, 2012, have not been expanded, and the bidder has a formal plan to cease such investments; second, if the political subdivision determines the goods or services are necessary to perform its functions and cannot be obtained without the specific bid. The certification form requires bidders to provide their signature, printed name, title, company name, and date, creating a formal attestation of compliance with New York State's Iranian Energy Sector Divestment requirements for state and local contract opportunities.
