About this file
This document is a Maryland Living Wage Requirements Affidavit of Agreement, part of a state procurement process effective July 2024. The affidavit requires bidders/offerors to confirm their compliance with Maryland's Living Wage Law under Title 18 of the State Finance and Procurement Article. Bidders must either certify exemption from the law based on specific criteria (such as being a nonprofit, public service company, or having a limited number of employees relative to contract value) or commit to paying covered employees at least the living wage rate for hours spent on state contract activities.
The document outlines conditions for exemption, including employee count and contract value thresholds, and requires contractors to ensure subcontractors also comply with wage rate requirements. Contractors must submit payroll reports to the Commissioner of Labor and Industry and agree to adjust wages automatically with any increases established by the commissioner. The affidavit provides additional exemption possibilities for employees working less than half-time on the contract, those 17 years or younger, or those working less than 13 consecutive weeks on the state contract. The Commissioner retains the right to request payroll records to verify these affirmations at any time.
