About this file
This document is Amendment #2 to RFB #28348-HK for Court Reporter Services and Transcription Services, dated June 21, 2021. The amendment was issued by a state government entity in response to bidder inquiries received outside the formal Q&A process regarding cancellation and postponement procedures for authorized users.
The contract covers court reporter and transcription services, with the amendment specifically modifying section 3.2.9 to establish mutual cancellation and postponement requirements. Both contractors and authorized users must provide three business days' notice to cancel or postpone scheduled hearings or depositions. When proper notice is not given, the party failing to provide notice must pay the other party a maximum of one day's appearance fee upon request, unless the contractor has an excusable reason under applicable law such as Chapter 103 Employment Regulations. This amendment clarifies the financial responsibilities and notice requirements for both parties when services need to be cancelled or rescheduled.

3.2.9 Cancellations and Postponements By Contractor
The Contractor shall be required to give the Authorized User a three (3) business-day notice either to cancel or postpone a scheduled hearing/deposition. In cases where the Contractor is not able to give the Authorized User at least a three (3) business-day notice, and the Authorized User procures services from another contractor, the Contractor shall pay the Authorized User (upon the Authorized User’s request) a maximum of a one (1)-day appearance fee unless the Contractor provides an excusable reason described by law (for example, Chapter 103 Employment Regulations).
The Authorized User will provide the Contractor with a three (3) business-day notice to either cancel or postpone a scheduled hearing/deposition. If the Authorized User does not provide such notice, the Authorized User will pay the Contractor (upon the Contractor’s request) a maximum of a one (1)-day appearance fee.
