SECTION M—EVALUATION FACTORS FOR AWARD

AWARD DETERMINATION

Nonprice evaluation factors, when combined, are of greater importance than price. An offer must be acceptable in order for the offeror to be eligible for award. The Government will not award a contract on the basis of an unacceptable offer. However, the Government will not select an offeror for award on the basis of a superior capability without consideration of the amount of its price. The relative influence that capability and price will have on the source selection authority will depend on the marginal differences among the competing offerors.

Award will be made to that offeror (1) whose proposal is technically acceptable and (2) whose technical/cost relationship is the most advantageous to the Government.

The Government reserves the right to make cost/technical trade-offs that are in the best interest and advantageous to the Government. The critical factor in making any cost/technical trade-off is not the difference between the technical evaluations but the significance of the difference. The significance of the difference between the technical evaluations will be determined on the basis of what the difference might mean in terms of performance and what it would cost the Government to take advantage of that difference.

The Government may reject any or all offers if such action is determined to be in the best interest of the

Government.

Options. The Government will evaluate the total price for the basic requirement together with any options exercised at the time of award. Evaluation of options shall not obligate the Government to exercise the option.

EVALUATION FACTORS

Acceptability of the Offer

The Government will determine the acceptability of each offer on a pass or fail basis. An offer is acceptable when it manifests the offeror's assent, without exception, to the terms and conditions of the

RFP, including attachments. If an offeror takes an exception to any of the terms and conditions of the

RFP, then the Government will consider its offer to be unacceptable.

Capability of the Offeror

The Government will assess the capability of each offeror on the basis of the following criteria which are of approximately equal value: (1) Organizational Past Performance, (2) Organizational Experience, and

(3) Understanding of the Government's requirements. The Government will not assess capability on a pass/fail basis, but will use its assessments of capability as a basis for comparing offerors to determine best value.

The technical proposals will be evaluated and ranked according to the following criteria. The contractor is responsible to submit documentation necessary to demonstrate capability for each criterion.

(1) Organizational Past Performance. Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with Federal, state, and local laws and regulations. The

Government will contact some of each offeror's customers to ask whether or not: (1) the offeror was capable, efficient, and effective; (2) the offeror's performance conformed to the terms and conditions of its contract (specifications); (3) the offeror finished within the contract time; (4) the offeror was reasonable and cooperative during performance; and (5) the offeror was committed to customer satisfaction. In evaluating past performance, the Government will contact some of the references provided by the offeror and other sources of information, including, but not limited to: Federal, state, and local government agencies, Better Business Bureaus, published media, and electronic databases.

The Government may evaluate the organizational past performance of the offeror's proposed key subcontractors. Note: In accordance with FAR 15.305, in the case an offeror is without an available record of relevant past performance, the offeror will not be evaluated either favorable or unfavorable in this area, but instead will receive a neutral rating in the area of past performance.

(2) Organizational Experience. Experience is the opportunity to learn by doing. The Government will evaluate each offeror's organizational experience on the basis of its breadth, its depth, and its relevance to the work that will be required under the prospective contract. The Government will not evaluate an offeror's organizational experience on the basis of the personal experience of the offeror's key personnel. However, the Government will consider the extent to which the offeror's key personnel

(including the offeror's proposed key subcontractors) have worked together in the past on similar projects. Key items that will be evaluated in this factor include: organizational experience of the

Contractor and subs with LEED certification and building commissioning: organizational experience with energy efficient components, products, and controls; and organizational experience with commercial/industrial type buildings within the price range of roughly $5,000,000 - $10,000,000.

The present project involves site improvements and construction to meet silver or gold LEED rating on federal property. As a part of addressing organizational experience, provide examples of experience with similar past projects within the last 10 years (experience within the past 5 years is more desirable) that were constructed as LEED certified and were fully commissioned. Include a short narrative describing the projects’ relevance and/ or similarity to the current project, particularly regarding LEED certification/commissioning. If available provide a photo of each project.

(3) Management Approach. The Government will evaluate each offeror's relative strength of their management approach on the basis of their written submittals addressing the following subfactors:

a) The extent to which the contractor understands the Government’s requirements, and is familiar with the site and the project.

b) The ability of the contractor to successfully manage the project and the budget by use of project management tools such as project scheduling software, change order protocol, communication plan, etc. ; also address how project safety will be managed .

c) The resources: identify key personnel including sub contractors (address qualifications), and equipment which are planned for use on the project.

d) Outline the time line for the project showing how it will be completed within the performance period and how realistic that plan is given any concurrent contracts.
