Solicitation # AG‐52KY‐10‐S‐0002 Amendment # 4
Additional Contractor Questions and Answers
1. I’ve downloaded all the information and noted that Section 71 references Material
Specifications 571, 572 and 573 in section 8 which I did not see. Can you send this information?
Material specifications 571, 572, and 573 weren’t included because we are using aluminum flap gates and none of these apply. Applicable information is found in Construction Specification 71 Item 8.b. and with the detail on Sheet 30 of the plans. The note with the detail on Sheet 30 states: “Flap gate shall be an automatic drainage gate with flat back to install on concrete headwall Waterman AF‐41, Gator GA‐40 or Equivalent.”
2. If we do not use the designated borrow pit, will you still require orange safety fence, erosion control at borrow pit and haul road improvements to borrow pit?
If the contractor opts not to use the designated borrow to obtain borrow or to dispose of unsuitable earthen material then it will not be necessary to install safety fence, erosion control or complete road improvements. However, the contractor will be required to complete moisture density testing to show us that their materials are acceptable as fill material.
3. Are there drawings or electronic files that provide the geometry for the alignment of the proposed project?
Yes, there are coordinate files in electronic format that define the alignment of the dikes and the work limits or permanent and temporary easements. These will be provided to the successful bidder.
4. Construction Spec. 7 Section 4 states 'the baselines and bench marks for primary control, necessary to establish lines and grades needed for construction are shown on the drawings and have been located on the job site'. Does this mean that someone else is laying out the alignment and stationing for us to work from and that is why no alignment geometry is given?
Bench marks are listed on Sheet 2 of the plans and the baseline has been established in the field. However, coordinate files defining this baseline alignment as well as the work limits or permanent and temporary easements will be provided to the successful bidder. All staking, layout and survey work of any kind will be completed by the contractor and is a part of Bid Item 3 – Construction Surveys.
5. Construction Spec. 7 Section 9 Item (8) states that the Contractor shall provide surveys necessary for the re‐establishment of any disturbed property corners or permanent easement monuments and that the re‐establishment shall be in compliance with the laws of the State of Indiana. There are seven (7) parcels along the left side (south) side and 16 parcels along the right side (north side) Does the NRCS have any prior surveys or documentation that might help with a field search through the proposed disturbed areas for any existing monuments so that they can be located prior to any construction activity?
Yes, we do have prior surveys that might help locate monuments prior to construction activity. This 13 page document is provided as a part of these questions and answers in the file: “Route Survey for Honey Creek Part C Thompson Ditch.pdf.” It is entitled “ROUTE
SURVEY FOR HONEY CREEK WATERSHED PROTECTION AND FLOOD PREVENTION PROJECT ‐
PART C VIGO COUNTY, INDIANA” and was prepared by Stradtner, Rowland and Associates, Inc. After construction, the baseline will need to be re‐established and is shown along with other existing monuments.
6. Are the work limit lines, defined on the drawing, the extent of the topsoil stripping, topsoil placement, and seeding limits for pay quantities?
The majority of the extent of topsoil stripping is defined on the cross‐section sheets. Work limits lines typically extend beyond the extent of the topsoil stripping lines. Other areas to be stripped would include earthfill stockpile areas, extent of structure sites, temporary construction entrances, or anywhere unsuitable materials might be temporarily stockpiled for removal, etc. Topsoil placement is required at locations described above along with all newly constructed earthfill dikes. Seeding limits will be the actual areas seeded including all disturbed areas so this could be the work limits depending how much is actually disturbed.
The contractor will provide surveys defining these areas for payment as a part of the supporting documentation for progress payments.
7. Is the project tax exempt (materials, fuel)?
We can issue a tax exemption certificate to the contractor but it will only be for federal taxes and would not include state and local taxes. Each state establishes its own rules concerning exemptions for federal contractors from sales or use taxes. The contractor will be responsible to find out what Indiana’s rules are. Sales to federal contractors are often considered indirect sales to the federal government, thus not exempt from sales taxes.
Exemption eligibility varies by state and the fact that a US Government contract is involved is not, in and of itself, determinative.
8. Would it be acceptable to rent an apartment in International Village instead of bringing in a job trailer? This would save the contractor having to install utilities at a separate location.
This would be acceptable as long as it is easily assessable on the northern area of the apartment complex and on the ground level. The contractor would need to assure that the first aid kit, posters, etc. are located within the limits of the job site.
9. The following information regarding the Vigo County Engineering Department’s bonding and permitting requirements is being offered in addition to that included in Amendment # 3 for informational purposes only:
a. Bonding of county roads will NOT be required if the contractor opts to limit traffic on
Halt Drive to access by light vehicular traffic only. This means that all equipment move‐ in and move‐out, all haulage of earthfill and unsuitable materials, and all removal of demolition materials or cleared and grubbed materials would occur at or through the 7th Street access and Halt Drive would not be used for any type of haulage purposes.
(1) A separate agreement or arrangement with the Vigo County Engineering
Department may be possible to allow demolition materials to be moved out utilizing Halt Drive.
(2) The county will require a certificate of liability.
b. The bonding requirement stated in Amendment # 3 will remain in place if the contractor chooses to use Halt Drive for any reason other than access for light vehicular traffic.
c. It is the contractor’s responsibility to confirm with the Vigo County Engineering
Department any and all statements contained within this amendment. All details of county road bonding and any separate agreements or arrangements are the sole responsibility of the contractor.
