About this file
This is an additional requirements document for a qualifications-based Request for Qualification (RFQ) issued by Pinellas County, Florida for professional engineering services on the Anclote Road Stormwater and Roadway Improvements project (PID 003897A). The procurement is governed by the Brooks Act (40 USC 1101 et seq.) for architect and engineer selection, with written questions due by March 26, 2026, at 3:00 PM Eastern Time and proposal submissions required by April 2, 2026, at 3:00 PM Eastern Time via the OpenGov platform. The contract term extends for 730 consecutive calendar days from Notice to Proceed with an estimated 12-month completion schedule. No mandatory site visit or bidders conference is required. The selected consultant will deliver comprehensive engineering services including NEPA compliance documentation, a Preliminary Engineering Report (PER), Environmental Information Document (EID), traffic analysis, drainage assessments, cultural resource surveys, contamination assessments, tree inventory evaluations, conceptual plans for build alternatives, geotechnical investigations, resiliency analysis, and regulatory agency coordination.
Compensation will be negotiated separately from qualifications and structured as lump sum compensation across fourteen task categories with monthly invoicing. The procurement mandates good faith efforts to solicit Disadvantaged Business Enterprises per 40 CFR Part 33, which is distinct from minority business status, and prohibits geographic preferences unless insufficient firms are available to compete. Evaluation criteria include firm ability and personnel qualifications (425 points), past performance (375 points), volume of work previously awarded (50 points), minority business status (25 points), Pinellas County Small Business Enterprise certification (100 points), and regional office location (25 points). The project is funded through an EPA State and Tribal Assistance Grant (STAG) from the Clean Water State Revolving Funds program totaling $2,240,000, with Pinellas County contributing $5,941,000 through the Local Infrastructure Sales Surtax (Penny for Pinellas) and total multi-year project costs estimated at $35,440,000. No incumbent contractor is identified. Contractors must maintain suspension and debarment checks on sam.gov, comply with E-Verify requirements, provide proof of Florida professional licensure, and carry specified insurance coverage with AM Best ratings of A-VIII or better.

Additional requirements
· This qualifications-based procurement is subject to the Brooks Act contained at 40 USC 1101 et seq. relating to the selection of architects and engineers (we just got dinged for CCNA NOT being the same as the Brooks Act for an FDOT project).
· The County needs to make good faith efforts to solicit proposals or quotes from Disadvantaged Business Enterprises as required by 40 CFR Part 33. This is not the same as Minority Business Status.
· EPA recommends 30 calendar days for the advertisement.
· Negotiation of profit must be a separate element of the contract. Per the Community Grants Procurement Guide “This provision also applies to “qualifications-based” procurement for Architectural and Engineering services where the price is not a selection factor as a means of ensuring that the compensation is fair and reasonable as required by 2 CFR 200.320(b)(2)(iv). In this situation, EPA may ask for more information regarding the contractor’s profit margin at a later date.”
· The procurement contract must contain the following term and condition: “The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.”
· A geographic preference may not be used, unless for A/E services IF there are an adequate number of firms to compete for the contract. 2 CFR 200.319(c)
· We may want to get an exemption from pre-procurement reviews by the EPA. This is found in the Best Practice Guide pg 12/13 2.d.
· Prior to contracting we need to check sam.gov and maintain those checks for suspension and debarment .
