About this file

This document outlines additional procurement requirements for Pinellas County, Florida's Anclote Road Stormwater and Roadway Improvements project, a qualifications-based professional engineering services procurement subject to the Brooks Act. The County is seeking qualified engineering firms to provide comprehensive services for this 2.4-mile roadway corridor project extending from Anclote Boulevard to Alternate US 19 in Tarpon Springs. The scope encompasses 14 primary tasks including NEPA compliance, preparation of a Preliminary Engineering Report and Environmental Information Document meeting EPA guidelines, traffic analysis, drainage assessments, cultural resource surveys, contamination assessments, tree inventory evaluations, geotechnical investigations, resiliency analysis, and public involvement coordination with regulatory agencies. The procurement was issued March 5, 2026, with proposals due April 2, 2026, at 3:00 PM Eastern Time via the OpenGov platform, and written questions must be submitted by March 26, 2026. No mandatory site visit is required. The selected consultant will enter into a non-continuing professional services agreement with a term of 730 consecutive calendar days from Notice to Proceed, with an estimated 12-month completion schedule, and compensation will be structured as a lump sum across fourteen task categories with monthly invoicing tied to progress reports.

The procurement is a qualifications-based selection where pricing is not an evaluation factor; profit negotiation must occur as a separate contract element following selection. The project is funded through an EPA State and Tribal Assistance Grant (STAG) from the Clean Water State Revolving Funds program totaling $2,240,000, with total multi-year project costs estimated at $35,440,000 distributed across design ($2,941,000), acquisitions ($3,000,000), and construction ($29,499,000); Pinellas County is contributing $5,941,000 through the Local Infrastructure Sales Surtax. Evaluation criteria totaling 2,000 points include firm ability and personnel qualifications (425 points), past performance (375 points), volume of work awarded (50 points), minority business status (25 points), Pinellas County Small Business Enterprise certification (100 points), and regional office location (25 points). The procurement encourages good faith efforts to solicit Disadvantaged Business Enterprises as mandated by 40 CFR Part 33, distinct from minority business status. Submittals must include Standard Form 330 (100 pages maximum), proof of Florida professional licensure, corporate registration, current certificates of insurance with specified liability limits, E-Verify affidavits for all post-January 1, 2021 employees, and W-9 forms. The County must conduct suspension and debarment checks via sam.gov prior to contract award, and the contract must include non-discrimination provisions and compliance requirements per 40 CFR Part 33. Geographic preferences are prohibited unless insufficient firms are available to compete.

Additional requirements

· This qualifications-based procurement is subject to the Brooks Act contained at 40 USC 1101 et seq. relating to the selection of architects and engineers (we just got dinged for CCNA NOT being the same as the Brooks Act for an FDOT project).

· The County needs to make good faith efforts to solicit proposals or quotes from Disadvantaged Business Enterprises as required by 40 CFR Part 33. This is not the same as Minority Business Status.

· EPA recommends 30 calendar days for the advertisement.

· Negotiation of profit must be a separate element of the contract. Per the Community Grants Procurement Guide “This provision also applies to “qualifications-based” procurement for Architectural and Engineering services where the price is not a selection factor as a means of ensuring that the compensation is fair and reasonable as required by 2 CFR 200.320(b)(2)(iv). In this situation, EPA may ask for more information regarding the contractor’s profit margin at a later date.”

· The procurement contract must contain the following term and condition: “The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.”

· A geographic preference may not be used, unless for A/E services IF there are an adequate number of firms to compete for the contract. 2 CFR 200.319(c)

· We may want to get an exemption from pre-procurement reviews by the EPA. This is found in the Best Practice Guide pg 12/13 2.d.

· Prior to contracting we need to check sam.gov and maintain those checks for suspension and debarment .
