About this file

This document outlines additional requirements for a qualifications-based procurement issued by Pinellas County, Florida, for professional engineering services related to the Anclote Road Stormwater and Roadway Improvements project, subject to the Brooks Act for architect and engineer selection. The County is seeking qualified engineering firms to provide comprehensive engineering services including environmental assessment under the National Environmental Policy Act (NEPA), preparation of a Preliminary Engineering Report (PER) and Environmental Information Document (EID) meeting U.S. Environmental Protection Agency (EPA) guidelines, traffic analysis, drainage technical memoranda, cultural resource assessments, contamination assessments, tree inventory evaluations with ISA Certified Arborist supervision, geotechnical investigations, resiliency analysis, and public involvement coordination. The Request for Qualification (RFQ) was issued March 5, 2026, with submissions due April 2, 2026, at 3:00 PM Eastern Time via the OpenGov platform. Written questions must be submitted by March 26, 2026, at 3:00 PM Eastern Time, and no mandatory site visit is required. The contract is a non-continuing professional services agreement with a term of 730 consecutive calendar days from Notice to Proceed, with an estimated 12-month completion schedule. Evaluation criteria totaling 2,000 points include firm ability and personnel qualifications (425 points), past performance on similar projects (375 points), volume of work previously awarded (50 points), minority business status (25 points), Pinellas County Small Business Enterprise (SBE) certification status (100 points), and office location in the region (25 points).

Pricing and deliverables will be negotiated separately based on qualifications, with lump sum compensation structured across fourteen task categories and monthly invoicing tied to progress reports. The procurement is funded through an earmarked State and Tribal Assistance Grant (STAG) from the EPA's Clean Water State Revolving Funds program totaling $2,240,000, with total multi-year project costs estimated at $35,440,000 distributed across design ($2,941,000), acquisitions ($3,000,000), and construction ($29,499,000); Pinellas County is contributing $5,941,000 through the Local Infrastructure Sales Surtax (Penny for Pinellas). The procurement requires good faith efforts to solicit Disadvantaged Business Enterprises as mandated by 40 CFR Part 33, distinct from minority business status. Submittals must include Standard Form 330 (limited to 100 pages), proof of Florida professional licensure and corporate registration, and current certificates of insurance with specific liability limits. All consultants must comply with E-Verify requirements per Florida Statute 448.095 and provide proof of legal work authorization. Geographic preferences are prohibited unless insufficient firms are available to compete. No incumbent contractor has been identified, and the procurement prohibits the use of price as a selection factor in accordance with the Brooks Act, requiring separate negotiation of profit as a distinct contract element.

Additional requirements

· This qualifications-based procurement is subject to the Brooks Act contained at 40 USC 1101 et seq. relating to the selection of architects and engineers (we just got dinged for CCNA NOT being the same as the Brooks Act for an FDOT project).

· The County needs to make good faith efforts to solicit proposals or quotes from Disadvantaged Business Enterprises as required by 40 CFR Part 33. This is not the same as Minority Business Status.

· EPA recommends 30 calendar days for the advertisement.

· Negotiation of profit must be a separate element of the contract. Per the Community Grants Procurement Guide “This provision also applies to “qualifications-based” procurement for Architectural and Engineering services where the price is not a selection factor as a means of ensuring that the compensation is fair and reasonable as required by 2 CFR 200.320(b)(2)(iv). In this situation, EPA may ask for more information regarding the contractor’s profit margin at a later date.”

· The procurement contract must contain the following term and condition: “The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.”

· A geographic preference may not be used, unless for A/E services IF there are an adequate number of firms to compete for the contract. 2 CFR 200.319(c)

· We may want to get an exemption from pre-procurement reviews by the EPA. This is found in the Best Practice Guide pg 12/13 2.d.

· Prior to contracting we need to check sam.gov and maintain those checks for suspension and debarment .
