About this file
This is Addendum No. 1 to an Agency Request for Quotation (ARFQ DEP25-20) issued by the West Virginia Department of Environmental Protection (WVDEP) for the Ethel Hollow project. The addendum serves to correct the ARFQ number on header attachments from ARFQ DEP25-16 to ARFQ DEP25-20 and to add Build America, Buy America (BABA) information to the solicitation. Vendors are required to acknowledge receipt of all addenda by completing an Addendum Acknowledgement form and submitting it with their bid to avoid potential disqualification. All other provisions of the original Agency Solicitation and any previously issued addenda remain in full force and effect.
The project is subject to federal Build America, Buy America requirements, which mandate that all iron and steel, manufactured products, and construction materials used in the project be produced in the United States. For manufactured products, domestic components must constitute at least 55 percent of the total cost of all components unless another standard is established under applicable law. The Buy America preference applies only to articles, materials, and supplies that are consumed in, incorporated into, or affixed to the infrastructure project, and does not apply to temporary tools, equipment, or movable furnishings not permanently affixed to the structure. The contractor must certify compliance with these requirements and acknowledges that the OSMRE is a third-party beneficiary to the agreement. Non-compliance may result in the WVDEP and OSMRE recovering damages, including attorney's fees and any loss of federal funding.

1. all iron and steel used in the project are produced in the United States--this means all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States;
2. all manufactured products used in the project are produced in the United States—this means the manufactured product was manufactured in the United States; and the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States is greater than 55 percent of the total cost of all components of the manufactured product, unless another standard for determining the minimum amount of domestic content of the manufactured product has been established under applicable law or regulation; and
