About this file
This document is an Addendum (#01) issued by the State of New Hampshire's Division of Procurement and Support Services, Bureau of Purchase and Property for Bid Invitation 3068-26, soliciting bids for Fuel Supply and Delivery of Biodiesel, Diesel, and Gasoline via Tractor Trailer. The bid closing date is October 2, 2025 at 9:00 AM, and the contract appears to be a three-year agreement with potential options. The solicitation covers fuel delivery to various Department of Transportation (DOT) locations, with specific details about fuel types including B5 and B20 biodiesel, Ultra Low Sulfur Diesel (ULSD), and both conventional and reformulated gasoline. Delivery will be exclusively via tractor trailer (18-wheeler) to underground storage tanks, with the Durham UNH Location in Strafford County being the only site currently designated for B20 biodiesel.
The addendum provides extensive clarifications through a 58-question Q&A format, addressing pricing mechanisms including both fixed price and index-based (OPIS) pricing options. Vendors are not required to bid on all counties or fuel types but are encouraged to do so. Pricing will include all applicable taxes and fees, with the state reserving the right to split loads between sites based on tank volume and product needs. The state is open to contract negotiations with awarded vendors and is considering both fixed price and index pricing for award purposes. Biodiesel is considered an alternate product, with annual usage estimates provided in the offer sheet. The state will have 30 days after contract approval to exercise a price lock, anticipated to be within 60 days of the bid's due date.

DATE AND TIME OF BID CLOSING: 10/2/2025 9:00 AM
FOR: Fuel Supply and Delivery – Biodiesel, Diesel, and Gasoline Tractor Trailer
Question 1: Are common carriers considered subcontractors under this solicitation?
State Response: Common carriers are not considered subcontractors. However, failure of a common carrier to perform delivery functions does not absolve the contractor from all delivery requirements and responsibilities.
Question 2: What is the process of getting prior written county approval for subcontracting?
State Response: During the contracting process, if contractors wish to subcontract any portion of supported deliveries, subcontractor information shall be sent to DAS Bureau of Purchase and Property and DOT Fuel Distribution for review and approval.
Question 3: What locations/counties will order B20 biodiesel vs B5 biodiesel?
State Response: The Durham UNH Location in Strafford County is the only location that will order B20 at this time.
Question 4: Is B20 considered “premium” option on the bid form and “Premium Additive on Road Ultra Low Sulfur Diesel” on the delivery locations attachment?
State Response: Reference section 29.6 Premium Ultra Low Sulfur Blend Stock Specifications for both B20 and B5 fuel types.
Question 5: Regarding the “Diesel” referenced in section 39.2. with an “OPIS “Oil Price Daily” (Portsmouth, NH Low) is this B20 or B5?
State Response: Neither. The diesel referenced in bullet 39.2 refers to ULS Diesel column per the OPIS Oil Price Daily Sheet. See the screenshot below as an example:
OPIS Biodiesel Rack Pricing will be used for all biodiesel pricing. Biodiesel Rack Pricing is a separate communication provided by OPIS.
Question 6: Does Tractor Trailer Delivery mean every site will be able to fit a transport truck at the site?
State Response: Yes. The State has separate contracts for pedal truck delivery for listed fuel products.
Question 7: Do any sites require tank wagon trucks?
State Response: Tank wagon trucks are not clearly defined in this context; all sites will accommodate tractor trailers for deliveries.
Question 8: Will counties split loads between sites?
State Response: At times yes, the state will split loads between sites dependent upon the tank volume and product needs.
Question 9: Will counties require split product loads?
State Response: The state may require split product loads dependent upon the tank volume and product needs.
Question 10: What locations have tanks aboveground or underground tanks and are truck pumps required?
State Response: All DOT Fuel Distribution Delivery Locations listed in attachment 1 are underground storage tanks requiring gravity drop deliveries.
Question 11: Could you provide BOL, invoice, and OPIS Report examples from the previous solicitation?
State Response: OPIS report is provided above in question 5. BOL and delivery ticket are below.
Question 12: Could you provide bid tabulations from the previous solicitation?
State Response: Prior bid tabulations can be found at our Statewide Bids and Proposals website under
RFB 2614-23.
Question 13: Who was your prior vender and was there contract Indexed based or Fixed Price?
State Response: Information regarding the incumbent vendor and contract information can be found on our Statewide Contracts website under SoNH Contract 8003179.
Question 14: Regarding the lock pricing option, how often does the State typically exercise the lock pricing option during a contract term?
State Response: This depends on whether or not current and anticipated future market conditions are beneficial to the State. This option has been utilized on different contracts over the past 10 years.
Question 15: What determines when the State chooses to lock in pricing?
State Response: The State communicates with the incumbent contractor(s) and, under their advisement, determines current and future market conditions and whether it is favorable or not to proceed with lock in pricing.
Question 16: Has the State used the lock pricing option in previous fuel contracts?
State Response: Yes, the State has utilized lock in pricing in previous fuel contracts.
Question 17: Is the lock price initiated and set by the State, or does the vendor propose it based on market trends?
https://apps.das.nh.gov/bidscontracts/bids.aspx https://apps.das.nh.gov/bidscontracts/contracts.aspx
State Response: The State communicates with the incumbent contractor(s) under advisement and to determine current and future market conditions and whether it is favorable or not to proceed with lock in pricing.
Question 18: Can a vendor decline a lock price offer?
State Response: Lock prices are not required at time of bid submission but are suggested. This gives the State additional options to consider during the review process.
Question 19: Is the lock price option different from the fixed price options we are submitting for 12 or 24 months?
Regarding: “The mark-up shall be, at a maximum, the mark-up prices offered in response to this RFB by the successful vendor(s) for the county and product” State Response: No. Lock and fixed pricing regarding the bid are the same. The quoted section above refers to bullet 40.4.3 and addresses pricing steps for fixed price usage volume if depleted by the State and additional fuel is required for purchase.
Question 20: In the past how has the state priced those additional gallons?
State Response: For lock in pricing the State guarantees a minimum number of gallons to purchase for the duration of the price lock. This number is 85% of the estimated annual usage for the lock duration for each fuel type per county.
Question 21: To confirm, is this only for fixed price options? If OPIS based pricing was originally used, would there be no change to pricing when guaranteed gallons are exhausted?
State Response: Guaranteed gallons are only affected by the lock in pricing option.
Question 22: If 12- or 24-months fixed price contract is chosen/awarded, what happens to pricing for the remainder of the contract period since it is 3 years long?
State Response: See bullets 40.9 Fuel Depletion of Fixed Price & Default Pricing and 40.10 Default Pricing Once Guaranteed Gallons are Depleted for additional information.
Question 23: Will billing be in gross or net gallons?
State Response: Billing will be calculated from the amount of fuel delivered per order.
Question 24: What percentage of overall diesel gallons will be Premium, B20, B5, Winter vs Summer etc for each county?
State Response: Winter blend vs Summer blend is roughly a 60/40 split; B20 is less than 5% of all diesel products purchased. Counties will switch between summer and winter in unison, typically occurring from October to March. The current USLD product we purchase may contain up to 5% biomass- Based/Renewable diesel and shall meet the requirements of ASTM D975. The biodiesel portion shall meet the requirements of ASTM D6751.
Question 25: How often will counties switch between the premium/B5 diesel?
State Response: Counties will not switch between the premium/b5 diesel. The current product we purchase may contain up to 5% biomass-Based/Renewable diesel and shall meet the requirements of ASTM D975. The biodiesel portion shall meet the requirements of ASTM D6751.
Question 26: Will you accept bids for Reformulated Gas if we do not also bid on Conventional Gas counties?
State Response: Bids will be accepted for just reformulated gasoline and not conventional, however, we encourage vendors to bid on as many products across as many counties as possible. If pricing is submitted as part of columns H or J, vendors are required to also provide pricing in the applicable diesel column.
Question 27: If we are bidding on all Reformulated Gas & all Diesel, do we also need to bid on the COMBINED Gasoline & Diesel for those counties or is that redundant?
State Response: No, vendors may bid on individual product categories. It is encouraged that bids be placed on as many categories as possible per country but is not required. However, if a vendor provides pricing in columns H, I, J, or K, they must provide pricing in the applicable other fuel type. For example, if pricing is provided in column H then pricing must be provided in column I.
Question 28: Is the shift to HIGH OPIS Index pricing based on Summer ULSD that is posted by OPIS, or do you expect to reference OPIS Winter ULSD posted pricing?
State Response: The shift to HIGH OPIS index pricing typically occurs in the winter when there are two prices listed. This is typically a temporary period then eventually transitions to a single price which is the
LOW OPIS.
