About this file

This Addendum #1 modifies solicitation ARFQ DEP2100000062 issued by the West Virginia Department of Environmental Protection (WVDEP) for the Buffalo Creek (Slone) Portals project. The addendum publishes pre-bid meeting documentation, adds two commodity lines to the project scope, and includes additional specifications and drawings. Key project requirements include completing all construction activities within 7 days from the Notice to Proceed, with a $1,000 per day liquidated damages clause assessed for delays beyond this period. All contractor questions must be submitted to DEPProcurement@wv.gov by June 14, 2021 at 5:00 p.m., and all required contractor documents must be uploaded to the Vendor Self Service (VSS) site or the bid will be disqualified. The addendum introduces two new pay items: Section 9.1 for Traffic Control and Section 10.1 for Administration.

The Engineer's Estimate for the project is $66,050. Both Traffic Control and Administration line items are capped at a maximum of 3 percent of the total amount bid for the project and are paid on a lump sum basis with no adjustments regardless of final contract cost changes. Special insurance requirements apply for CSX railroad work, including Worker's Compensation and Employers Liability Insurance with $1,000,000 limits, Commercial General Liability Coverage of $5,000,000 combined single limits, Business Automobile Liability of $1,000,000, and Railroad Protective Liability Insurance of $5,000,000 per occurrence with $10,000,000 aggregate limits. CSX flagging costs will be paid directly by DEP AML, and all grout work is compensated by cubic yard. WVDOH signage and flagging requirements are specified per MM-109 permit conditions.
