About this file
Summary
This document is an addendum to FAR 52.212-2 that establishes the evaluation methodology for a Gaseous Helium, Grade A commercial acquisition. The Government employs a lowest-price-technically-acceptable (LPTA) approach, evaluating quotes in four sequential steps: price ranking from lowest to highest, technical acceptability review of only the lowest-priced quote, award determination if acceptable, and alternate review of progressively higher-priced quotes if the lowest-priced quote is rejected.
Factor 1 (Technical Capability) requires quoters to demonstrate acceptability across four sub-criteria: compliance with MIL-PRF-27407E standards via a completed Technical Capability Data Sheet; submission of a valid DLA Form 1889 identifying an active manufacturer/filling point; submission of a Trailer Filling and Safety Procedures narrative (maximum 2 pages) demonstrating safe handling of Government-owned trailers; and commitment to cooperate with Pre-Award Survey requirements, including timely submission of a third-party Letter of Commitment and manufacturer's Certificate of Analysis within two business days. Factor 2 (Past Performance) evaluates acceptability based on the quoter's performance record and Government database records, treating quoters with no recent or relevant past performance as "Neutral," which counts as acceptable. The price evaluation calculates Total Evaluated Price using a year-by-year methodology over five contract years, multiplying quoted unit prices for three Contract Line Items (CLIN 0001: Gaseous Helium at 200 MC annually; CLIN 0002: Expedited Delivery at 1 occurrence annually; CLIN 0003: Trailer Purge at 1 occurrence annually) and summing across all five years. The document prohibits unapproved exceptions to standard FAR clauses without formal Head of Contracting Activity waiver approval, with non-compliant quotes subject to technical rejection.

ADDENDUM TO FAR 52.212-2
EVALUATION — COMMERCIAL PRODUCTS AND COMMERCIAL
SERVICES
1. EVALUATION PROCESS
• Step 1: Price Ranking. The Government will review all price quotes received (Volume II) and rank them from lowest to highest based on the Total Evaluated Price (see Section 4).
• Step 2: Technical Acceptability Review. The Government will evaluate the technical quote (Volume I) of only the lowest-priced quote to determine if it meets the technical acceptability standards for Factor 1 and Factor 2.
• Step 3: Award Determination. If the lowest-priced quote is determined to be Technically Acceptable, and the price is determined fair and reasonable, the evaluation process stops. Award will be quoted to that quoter without further evaluation of any other quotes.
• Step 4: Alternate Review. If the lowest-priced quote is determined to be Technically Unacceptable, the Government will evaluate the next lowest-priced quote, repeating this process until a quote is found to be Technically Acceptable.
2. FACTOR 1: TECHNICAL CAPABILITY EVALUATION
The Government will evaluate the quoter's Technical Quote (Volume
I) as Acceptable or Unacceptable basis. To be rated "Acceptable" for
Factor 1, the quote must meet the following criteria:
A. Compliance with MIL-PRF-27407E
• Acceptable: The quoter completed and submitted the Technical Capability Data Sheet (Attachment A1), demonstrating the technical ability to deliver Gaseous Helium, Grade A, in full compliance with the strict physical, chemical, and packaging standards of MIL-
PRF-27407E (latest version).
• Unacceptable: The quoter failed to submit Attachment A1, submitted an incomplete sheet, or took exceptions to the MIL-SPEC requirements.
B. DLA Form 1889 Technical Pass/Fail Check
• Acceptable: The quoter completed and submitted DLA Form 1889 (Supplemental Quality Assurance Provision (SQAP) E33.10 Manufacturing & Filling Points) with their quote, identifying a valid, active manufacturer/filling point.
• Unacceptable: The quoter failed to submit a completed DLA Form 1889 with their quote, or failed to identify a valid, active manufacturing/filling point.
C. Government-Owned Trailer Interface and Safety
• Acceptable: The quoter submitted a Trailer Filling and Safety Procedures narrative (not to exceed 2 pages) that demonstrates a clear technical capability to safely connect, pressure-test, and fill Government-owned trailers with Gaseous Helium at their facility, in strict compliance with the safety guidelines of the Statement of Objectives (SOO).
• Unacceptable: The quoter failed to submit a Trailer Filing and Safety Procedures narrative, or the submitted narrative failed to demonstrate adequate safety and technical procedures for interfacing with Government-owned trailers.
D. PAS Documentation (DEPI Appendix D)
• Acceptable: The quoter commits to fully cooperating with the DLA Energy Quality Assurance Representative (QAR) if a
Pre-Award Survey (PAS) is requested. This includes submitting a third-party Letter of Commitment (LOC) and a manufacturer's Certificate of Analysis (COA) within two (2) business days of the Contracting Officer's request.
• Unacceptable: The quoter fails to provide the completed
LOC or COA within the 2-business-day timeline if a PAS is initiated, or receives a negative PAS recommendation ("No
Award" or "Other than Full Award") from the surveying activity that cannot be resolved prior to the target
Procurement Acquisition Lead Time (PALT) deadlines.
3. FACTOR 2: PAST PERFORMANCE EVALUATION
Past Performance will be evaluated on an
Acceptable/Unacceptable basis. The Government will utilize past performance data submitted by the quoter (Attachment A2), as well as data retrieved from CPARS and other Government databases.
A. Evaluation Ratings and Standards
Rating Description
Acceptable Based on the quoter’s performance record, the
Government has a reasonable expectation that the quoter will successfully perform the required effort. This includes quoters with no recent or relevant past performance record, who will receive a
"Neutral" rating.
Unacceptable Based on the quoter’s performance record, the
Government does not have a reasonable expectation that the quoter will successfully perform the required effort.
B. Treatment of Neutral Past Performance
In accordance with DoD Source Selection Procedures, if a quoter does not have a record of recent or relevant past performance, or if past performance information is not available, the quoter will not be evaluated favorably or unfavorably. The quoter will receive a Neutral rating, which is defined as Acceptable for the purposes of this solicitation.
4. PRICE EVALUATION
The Government will evaluate price quotes (Volume II) for fairness and reasonableness.
A. Total Evaluated Price Calculation
The Total Evaluated Price will be calculated using a year-by-year methodology over the 5-year period of performance to account for annual price escalation:
1. Calculate Gaseous Helium Yearly Subtotals: For each of the five contract years, multiply the quoted unit price per MC for CLIN 0001 by the annual estimated quantity of 200 MC.
2. Calculate Expedited Delivery Yearly Subtotals: For each of the five contract years, multiply the quoted flat-rate price per occurrence for CLIN 0002 by the annual estimated quantity of 1 occurrences.
3. Calculate Trailer Purge Yearly Subtotals: For each of the five contract years, multiply the quoted flat-rate price per occurrence for CLIN 0003 by the annual estimated quantity of 1 occurrences.
4. Sum the Yearly Subtotals: Add the yearly subtotals calculated in
Steps 1, 2, and 3 to determine the total price for each contract year.
5. Sum all Five Years: Add the total prices of Year 1, Year 2, Year 3, Year 4, and Year 5 together. This final sum will represent the quoter's Total Evaluated Price for award selection.
5. EXCEPTIONS & COMMERCIAL TAILORING
In accordance with FAR 12.205(d), the Government seeks to acquire Gaseous Helium in line with standard commercial practices. Quoters are warned that taking exceptions to standard customary FAR clauses is highly discouraged.
• HCA Waiver Requirement: Under FAR 12.205(d)(1)(iii)(A), the
Contracting Officer cannot accept any proposed exception or tailored term that is inconsistent with customary commercial practices unless a formal, written waiver has been reviewed and approved by the DLA Energy Head of the Contracting
Activity (HCA). Quotes containing unapproved exceptions may be determined Technically Unacceptable and excluded from consideration.
