1Numerous exceptions to the general reimbursable policy and guidance exist in Public Law, DOD directives, Army regulations and written agreements between components.

2Suppliers and receivers must research applicable policy to verify whether an exception exists.

1. Operation and Maintenance of Exclusively Assigned Facilities or Equipment The tenant contractor will provide personnel on a continuing basis in direct support of customer programs. The tenant unit provides support on a continuing basis for customer programs. These efforts include direct labor, allocable costs, and material costs plus other applicable direct costs (e.g. transportation, supplies and services).

Materials for repair of U.S. Government facilities may, upon prior approval of USAG-KA Command, be provided to individuals and private organizations.

2. Air Transportation Fixed and rotary wing aircraft are operated for the movement of passengers and cargo.

Flights to meet requirements of customers or tenants include the following activities:

support of major construction activities (MCA), movement of customers or tenant personnel, aerial surveillance and weather reconnaissance, beacon-carrying flights for radar calibration, and flights for launch of target spheres. Services will be provided within the overall resources available to meet the valid requirements of customers and tenants at USAG-KA. Services requested outside of available resources will be provided as a reimbursable service to the requesting organization.

3. Marine Transportation Marine vessels are operated for the transportation of personnel and cargo among the various islands of USAG-KA. Trips to meet requirements of customers or tenants include activities such as personnel transportation, support of major construction or major installation (e.g. a new radar), and transportation of project equipment in support of project requirements. Services will be provided within the overall resources available to meet the valid requirements of customers and tenants at USAG-KA. Services requested outside of available resources will be provided as a reimbursable service to the requesting organization.

4. Administrative Use Vehicles The use of automotive vehicles (including maintenance thereof) is provided within the overall resources available to meet the valid requirements of customers and tenants at

USAG-KA.

a) Vehicles must be used within the guidelines of the Commanding General, USASMDC; CDR, USAG-KA; and statutory provisions in accordance with Army Regulation 58-1.

b) Vehicles are to be used for official business only.

c) Reimbursement at established rates is required for vehicles dispatched.

5. Special Equipment The use of construction, maintenance, and materials handling equipment can be provided to the extent available to meet short-term requirements. USAG-KA cannot normally provide equipment for long term, full-time usage.

6. Service to Ships Pilot services, line handling, stevedoring, drayage, and limited emergency repairs can be provided for transient marine vessels.

7. Passenger Air Terminal Services Standard air terminal services are provided. Packing, crating, and baggage and cargo handling services are available.

8. Services to Aircraft Ground handling, refueling, custodial, passenger/baggage/cargo processing, inspection and limited maintenance and emergency repairs can be provided for transient aircraft.

Landing fees will be charged in accordance with AR 95-2 and/or specific Memoranda of Agreement with carriers.

9. General Supplies (Petroleum, Oil and Lubricants (POL)) Support will be limited to issue of those items normally stocked by the tenant contractor for USAG-KA mission support when such issues can be made without detriment to planned USAG-KA usages. Assistance in determining substitutes will be limited.

10. Electricity Electricity is provided within the capacity of existing USAG-KA power plants and distribution systems. For non-metered customers, electricity costs are included in facility charges and/or housing costs as specified in agreements. For metered facilities the most current electrical rate charges will apply.

11. Housing Housing (family and unaccompanied personnel) services are provided, subject to availability, as determined by the commander’s allocation.

12. Emergency Aid Services

a) Search and rescue (RMI) assistance rendered in response to U.S. Coast Guard (USCG) requests are on a non-interference basis with USAG-KA mission requirements.

In regard to non-interference, the Commander (CDR), USAG-KA must determine if commitment of USAG-KA resources to USCG search and rescue efforts will adversely affect the capability to satisfy USAG-KA mission requirements.

b) The costs associated with lifesaving transportation, search and rescue operations, and airlift or sealift of supplies rendered to Republic of the Marshall Islands (RMI) inhabitants whether by direct or indirect (via USCG) requests, will be recovered from RMI in accordance with the terms and conditions set forth in the USAG-KA/RMI Implementing Instructions as prescribed in the Compact of Free Association.

c) Urgent lifesaving missions will not be delayed pending receipt of a formal request (USCG or RMI), if the CDR, USAG-KA determines to the best of his/her ability and upon information available that immediate action is appropriate. USAG-KA activities will not compete with commercial capabilities for evacuation unless conditions dictate.

d) Requests for material and services from the RMI may be provided in accordance with the terms and conditions set forth in the USAG-KA/RMI Implementing Instructions as prescribed in the Compact of Free Association.

REIMBURSEMENT COSTS

Reimbursement costs not identified in the below categories will be calculated as actual for contract labor and materials. Approval of the designated Federal Government representatives having management responsibility for USAG-KA resources must be obtained prior to delivery of services, materials or supplies. This approval may be in the form of a specific provision, formal agreement, or in the case of unanticipated requirements, specific one-time approval.

Acknowledgement of Receipt. An authorized representative of the receiving activity or organization will be required to provide a written certification that services, materials, or supplies (as listed) were received and accepted.

2-13 VEHICLE MAINTENANCE

There are three (3) categories of vehicles used in determining services. The flat rate is updated annually and is located in Table 1 Vehicle Maintenance Flat Rate by Category.

a) Light Duty - Vehicles with a gross vehicle weight less than 14,000 pounds.

Includes truck classes one through three (Examples: Sedan, Forklift, Scooter, Aircraft Tug, Passenger Van, and Skidsteer).

Electric vehicles or equipment will be assessed a flat annual fee of $350 to cover the electricity cost of charging the vehicle to capacity.

b) Medium Duty - Vehicles with a gross vehicle weight between 14,001 and 26,000 pounds. Includes truck classes four through six (Examples: Bus, Forklift, Manlift, Runway Sweeper, and Step Van).

c) Heavy Duty - Vehicles with a gross vehicle weight greater than 26,000 pounds.

Includes truck classes 7 and 8. (Examples: Crane, Dump Truck, Forklift, Fire Truck, Dozer, and Refueler)

1. Light Duty Vehicles All electric vehicles are included in this category. All automobiles are included in this category.

a) Electric vehicles -Electric vehicles do not require the same services as petroleum fueled vehicles. Routine maintenance consists of performing checks of vehicle components and conducting minor component lubrication or fluid filling. Service is billed at the flat rate for each vehicle.

b) Automobiles - Automobiles require scheduled maintenance to ensure proper functioning. These activities will be billed at flat rate.

c) Other light duty vehicles - Vehicles that are neither electric nor automobiles will have any maintenance activities billed at flat rate.

d) Diagnostics & Repairs - All vehicle diagnostics and repairs will be charged at flat rate. Additionally, based on the quantity of hazardous materials generated by the repairs, there will be a hazardous materials disposal surcharge added to the cost of repairs. Any parts that need to be special ordered will be billed at the material cost plus shipping and procurement.

Any other maintenance repairs that fall outside of normal scheduled/unscheduled diagnostics, repairable fair wear and tear conditions, and periodic preventive maintenance repairs will be reimbursed at the actual cost of repairs, and any other associated cost of restoring the vehicle to it previous condition. For example, a damaged vehicle involved in an accident or vehicle estimated repair costs exceed the Maintenance Expenditure Limit (MEL), but tenant unit requested repairs to be done.

2. Medium Duty Vehicles

a) Maintenance activities will be billed at flat rate.

b) Diagnostics & Repairs - All vehicle diagnostics and repairs will be charged at flat rate.

3. Heavy Duty Vehicles Vehicles in this category require a minimum of two (2) service personnel to perform maintenance, diagnostics, and repair activities because of their size, complexity, and safety requirements. Additionally, specialized equipment is often required increasing the overall cost of maintenance and repairs.
