About this file

This document contains the Questions and Answers related to a Phase I solicitation (91003124R0005) for the Title IV Financial Aid Origination and Disbursement (TIVOD) System & Customer Services Transition Services contract.

The solicitation is for a short-term contract to maintain the current TIVOD systems, which includes the COD, EDMAPS, and NSLDS applications. The modernization of these applications will be released under separate solicitations in the future. The anticipated contract type is a Hybrid Firm-Fixed-Price (FFP) with a Time-and-Materials (T&M) CLIN for Other Direct Costs (ODCs) associated with the COD system. The Phase I solicitation will be evaluated based on Go/No-Go Criteria and Rough Order of Magnitude (ROM), and only the Offerors selected for Phase II will receive the Phase II solicitation. The solicitation indicates that the Department of Education, Office of Federal Student Aid, is conducting this two-phase procurement.

QUESTIONS AND ANSWERS (Q&As)

The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the Phase I solicitation.

Question No.QuestionRelated Section of Phase I SolicitationGovernment Response
1Our understanding from the PWS is that this procurement is strictly a short term contract to maintain the current TIVOD systems. Please confirm the modernization of these applications (COD, EDMaps and NSLDS) will be released under separate solicitations in the future? Please confirm that our understanding of the scope and intent of this solicitation is correct?TIVOD Phase I Solicitation: Section 2 Statement of Need, (pgs. 2-3).Modernization of COD, EDMAPS, and NSLDS will take place under separate solicitations in the future. The future solicitations may include combining similar systems together. The scope of this solicitation is to procure a short term contract to maintain the current TIVOD system.
2Please confirm that all modernization activities will be performed on a future, yet-to-be-issued contract and not as part of the contract resulting from this solicitation.Attachment J-1, Performance Work Statement (PWS):
This solicitation will result in the award of a short-term contract serving as a transition vehicle as FSA intends to award new contracts aimed at future modernization and transformation efforts (pg. 3).See answer to Question No. 1.
3Does FSA intend to award multiple competed task orders for modernization of the following, or will they be consolidated under a single, future contract:
•COD
•NSLDS, EDMAPS Infrastructure, pMDM, FTI DM, EDWA, Enterprise Document Repository
•Customer Service - PartnerTIVOD Phase I Solicitation:
FSA anticipates awarding a single contract with a COD period of performance of one (1), one-year base period and five (5) one-year option periods, and a period of performance of one (1) one-year base period and three (3) one-year option periods for NSLDS, EDMAPS Infrastructure, pMDM, FTI DM, EDWA, Enterprise Document Repository, and a period of performance of one (1) one-year base period and three (3) one-year option periods for Customer Service – Partner (pg. 3).FSA's intent is to issue separate contracts, which may include (multiple) task orders.
4To best determine the most accurate Rough Order of Magnitude (ROM), can additional information be provided on the state of FSA’s code-rights for COD, EDMAPS, and EDWA?TIVOD RFI Question and Answer Response:
Currently, FSA has rights to NSLDS and FTI Data Mart. FSA does not own the code for COD or EDMAPS/EDWA systems. However, we are in negotiations to obtain a license for them. Information regarding ownership of code will be in the RFP. FSA desires the rights to all COTS, custom code, deliverables for all systems (pg. 5).At this time, the vendor does not have rights to use COD, EDMAPS, and EDWA.
5Please confirm the contract type for this solicitation. There are FAR clauses that imply that this is a FFP solicitation (e.g., FAR 52.246-4 - Inspection of Services - Fixed Price), but then there is FAR 52.216.29 that implies that this is a T&M/LH contract.TIVOD Phase I Solicitation:

Offeror(s) shall review PWS Section 3.0 Contractor Quality Assurance for specific requirements regarding inspection and acceptance and FAR 52.246-4 Inspection of Services-Fixed-Price (AUG 1996) (pg. 3).

TIVOD Phase I Solicitation:

52.216-29 Time-and-Materials/Labor-Hour Proposal Requirements (NOV 2021) (pg. 45). The anticipated contract type for this procurement is a Hybrid Firm-Fixed-Price (FFP) with a Time-and-Materials (T&M) CLIN for Other Direct Costs (ODCs) associated with the COD system.
