About this file

Summary

This is a Bid Questions and Answers document for the Nevada Department of Employment, Training and Rehabilitation (DETR) Business Enterprises of Nevada (BEN) Case Management System RFP (90DETR-S3794). The state seeks a web-based, cloud-hosted Software-as-a-Service (SaaS) case management system to support blind and visually impaired food service and vending business operators and DETR staff across Nevada. The system must manage workflows for operator applications, licensing, site assignments, profit and loss statements, equipment inventory tracking, site reviews, equipment maintenance, loan applications, and health insurance enrollment for approximately 18 operators and 22 sites (with anticipated growth of 2 operators and 2 sites annually). Deliverables include project management, requirements discovery, system configuration and development, data conversion and migration of 13 years of historical records (10,000+ documents) from spreadsheets, PDFs, and Word documents, user acceptance testing with 2-3 operators, training for 8 staff and 18 operators in Las Vegas and Reno/Carson locations (delivered remotely), go-live support, and a minimum one-year warranty. The deadline for submitting questions was May 1, 2026, with answers posted by May 8, 2026; proposals are due May 22, 2026, at 2:00 PM Pacific Time; notice of intent is anticipated June 15, 2026; notice of award is expected July 2, 2026; and the estimated contract start date is September 8, 2026, with a preferred go-live date of June 30, 2027. The contract term is four years.

The state has not disclosed an approved budget range for this procurement. Pricing should follow vendors' standard commercial models, with pre-implementation milestones not exceeding 35 percent of total project costs and implementation costs (product installation and support) representing at least 25 percent of total project costs. The payment gateway must comply with PCI-DSS and Nevada banking regulations, with the State Treasurer's Office overseeing payment services; vendors may propose compliant alternatives to CyberSource. There is no incumbent vendor; the current environment consists entirely of manual processes using spreadsheets, PDFs, Word documents, and a separate Sortly system for equipment inventory. The project is self-funded through set-aside fees generated by the BEN program and is not federally funded. The system must be deployed on a FedRAMP or GovRAMP moderate-authorized cloud provider (AWS, Azure, or GCP acceptable), be WCAG 2.1 AA compliant with accessibility testing involving actual BEN operators, support Active Directory Single Sign-On, achieve 99.9 percent monthly uptime, maintain data encryption in transit and at rest, and enable data recovery within four hours. Vendor presentations are estimated for June 10-11, 2026, and will be conducted remotely. The Q&A clarifications address data migration scope, user volumes and roles, financial submission consolidation (by site monthly), payment transaction types (set-aside, loan repayment, reimbursements), equipment tracking requirements, workflow standardization (same workflows for all operators), training delivery preferences, security and accessibility testing expectations, and support SLA frameworks for response and resolution times.

Equipment invetory in stored in Sortly.
16BIDSMANAGER@AGATESOFTWARE.COMData MigrationFor data migration, how many years of data are expected to be migrated?13 years (2013 onwards)
17BIDSMANAGER@AGATESOFTWARE.COMSoftware CodeThe requirements state the vendor must provide workflow/configuration capability, but also state "software code will be maintained solely by the vendor." Please clarify the intended boundary between (a) State-managed configuration (forms/workflows/reports/security roles via admin tools) and (b) vendor-only changes (code/custom development).DETR needs to be able to request changes from the vendor and be provided with the process to do so. The vendor is the responsible party for code modification.
18BIDSMANAGER@AGATESOFTWARE.COMTrainingPlease define expectations for "post go-live training" versus "refresher training (2-3 times per year)," including: expected audience(s) (operators vs staff vs admin vs fiscal), format (live vs recorded), typical duration, and whether refresher training is included in annual subscription/maintenance pricing or treated as a separate service line.Live training for 18 operators and 8 staff. Refresher training should be at least once a year.
19BIDSMANAGER@AGATESOFTWARE.COMData RecoveryThe requirements state "Data must be recoverable within 4 hours of a disaster event." Please confirm whether this refers to data recovery objectives only vs full system availability restoration (RPO vs RTO).4 hours is an RPO.

21BIDSMANAGER@AGATESOFTWARE.COMImplementation CostThe cost schedule rules state that pre-implementation milestones (including Training) cannot exceed 35% of total project cost, and Implementation costs must be less than or equal to 25% or proposal is invalid. It appears that the Implementation Costs subtotal is being added into the pre-implementation total which makes these limits difficult. Can you confirm if this is accurate? There was an error in the formula on the pricing sheet that has been corrected. Installation and support costs cannot be less than 25% of the Total Project costs.
22BIDSMANAGER@AGATESOFTWARE.COMCost ScheduleThe cost schedule instructions state that pre-implementation milestones (Project Planning, Requirements & Analysis, Design & Development, Interfaces & Integration, Data Conversion, Testing, and Training) cannot exceed 35% of Total Project Cost, and that Implementation costs (including Product Installation & Support) cannot be less than 25% of Total Project Cost. When reviewing the cost schedule workbook, it appears the pre-implementation subtotal/percentage may be including the Implementation subtotal (or otherwise calculating in a way that makes compliance with both thresholds difficult). Please confirm:

Whether the State's compliance check for the 35% cap should exclude the Implementation section and include only the pre-implementation categories listed above; and

Whether the 25% minimum is calculated solely from the Implementation section lines. There was an error in the formula on the pricing sheet that has been corrected.

35% cap for all pre-implimentation milestones, 25% minimum for product installation and support. Additional implementation costs can be included; however, the installation and support cost line cannot be less than 25% of the total.

76KEVINCHUGHAccessibility FeaturesIn requirement 5.2 of the document, it states "The system must include accessibility for visually impaired operators such as computer talking programs, screen readers, text-to-speech and screen magnification and web browser enhancements for users of all visual abilities." Our application is web based and as such, meets accessibility requirements by being WCAG compliant. It does not have built in screen readers, text-to-speech, but users can install plugins that use the WCAG compliant information to achieve this goal. Is this sufficient for this requirement?Yes, that is sufficient for the 5.2 requirement.
77KEVINCHUGHBudgetIs there an established budget for this project? If yes, can the State share the budget? We are not disclosing.
78KEVINCHUGHFundingIs this project funded? If yes, is it funded through state or federal funding?Self funded through set aside fees (profit based) generated through sites.
79KEVINCHUGHProfit and Loss StatementsIn Section 2.8.2 of the Case Management Requirements document, it requires Profit and Loss Statements. Can you give vendors more information about what this will look like in the system? Is a report showing revenues and expenses as they pertain to the BEN program sufficient, or must the system capture every single revenue and expense associated with BEN and generate a complete profit and loss statement? If yes, does that mean the system must allow the input of every single revenue and expense, including payroll, capital depreciation, etc.? Or is this exclusive to the revenue and expenses of the in-scope items for the system? Please see the attached Profit and Loss Statements.
80KEVINCHUGHResolution TimesIn Section 4.4 of the Case Management Requirements document, it states "The vendor shall respond/resolve reported issues as follows..." As some issues require further investigation to resolve, is meeting the response with acknowledgment of receipt with communication of an ETA on resolution acceptable with proposed workaround if resolution will take longer than the requirement? In other words, response time is within vendor's control, but resolution may not be due to the need to investigate issues, which often involve 3rd party systems such as SSO, CDNs, etc. Is it acceptable to meet the response time requirement, but in the response communicate resolution time, which may take longer than the times outlined in the table?DETR acknowledges that certain issues may require additional investigation, including coordination with third‑party systems, which can impact final resolution time. However, the response timeframes outlined in Section 4.4 refer specifically to the required time for the vendor to acknowledge the issue, begin initial triage, and provide communication back to DETR.

It is acceptable for the vendor to meet the required response time and, within that response, provide an estimated time to resolution along with any proposed workarounds if full resolution will exceed the timeframes listed in the table. Vendors should still make reasonable efforts to meet the resolution targets and clearly document their escalation and investigation processes in their proposal.

81KEVINCHUGHAnnual Security & Controls AssessmentIn Section 5.7 of the Case Management Requirements document, it states "The service must provide the ability for the department to perform an annual security and controls assessment." Would the State be open to putting in some response time? The assessment is carried out on meetings between the department and the vendor. Many items would be addressed on the call. Follow up items would be mentioned during the calls, and a timeline would be generated then. The ITPM assigned to assist would enforce any agreed timelines from the calls.
82KEVINCHUGHHypercareSection 8.1 of the Scope of Work and Deliverables Overview states "Provide a 3-month period for immediate post-implementation support to address any issues or challenges." Is the State open to decreasing this period of hypercare? The industry standard is more often 1 month of hypercare post-launch.DETR is open to decreasing the period of hypercare to 1 month.

89KEVINCHUGHAnnual Security & Controls AssessmentIn Section 5.7 of the Case Management Requirements document, it states "The service must provide the ability for the department to perform an annual security and controls assessment." Can the State elaborate what it envisions this might entail and would it be limited to reviewing the configuration of the application? These control assessments are going to be based on, at a minimum, the NIST moderate baseline from NIST SP 800-53B. The assessment is conducted in line with 800-53A. The controls that will make up the assessment will be clearly defined when the Shared Responsibility Matrix between the Department, vendor, and, if applicable/different, hosting party, is created. While the assessment should only address the configuration, if it is found that the vendor is responsible for platform or infrastructure control implementation, artifacts will be required to show compliance.
90AON.RANACustomization ExpectationsTo what extent does DETR expect customization versus configuration using out of the box capabilities?DETR prefers out of the box functionality as long as it meets
91AON.RANAPayment ProcessingIs CyberSource mandatory, or can vendors propose alternative payment gateways that meet compliance and functionality requirements? From a security perspective, all that DETR requires is a payment gateway/vendor that can meet compliance requirements in line with NRS 603A and other applicable compliance requirements (PCI DSS, for example).
