About this file

This is a State Environmental Review Process (SERP) Floodplain Compliance Memorandum prepared by AKS Engineering & Forestry, LLC for the City of St. Helens Wastewater Collection System Capacity Improvements Project, submitted to the Oregon Department of Environmental Quality (DEQ) Clean Water State Revolving Fund (SRF) program. The project involves the construction and replacement of sanitary sewer infrastructure within Basins 4, 5, and 6 in St. Helens to increase system capacity, improve reliability, and reduce sanitary sewer overflows. The memorandum addresses compliance with Floodplain Management Executive Order requirements and includes detailed Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps (FIRMettes) for the project alignments. The analysis concludes that Basins 4 and 5 lie entirely outside the 100-year floodplain area, while a small section of the Basin 6 alignment intersects the 100-year floodplain; however, no permanent aboveground changes in elevation will occur, and therefore no floodplain development permit is required per SERP Applicant Guide Section 4.3.3.

The memorandum also includes comprehensive pre-application conference notes from the City of St. Helens Planning Department dated October 30, 2024, documenting 32 questions and planning requirements relevant to the project. Key planning considerations include conditional use permits for Basin 6 segments on private property (2615 Sykes Road and 2400 Gable Road), impacts to city-significant wetlands and non-city-significant wetlands requiring Department of State Lands jurisdiction review, tree removal requirements and inventories, landscaping restoration standards, and street and sidewalk restoration protocols. The project is funded through the DEQ Clean Water SRF, with AKS Engineering working in coordination with Consor and the City to navigate environmental permitting, land use approvals, and engineering standards. Construction activities are anticipated to impact driveways, parking areas, existing landscaping, and street trees across multiple basins, with all temporary disturbances to be restored in-kind or rerouted to avoid impacts where feasible.

Date: 12/13/2024 To: Rebecca Kramer, Project Officer, Clean Water SRF, Oregon DEQ From: Julie Wirth-McGee, Senior Environmental Specialist Allison Law, Natural Resource Specialist Project Name: St. Helens Wastewater Collection System Capacity Improvements Project AKS Job No.: 10363-04 Project Site: St. Helens, Oregon

Subject: SERP Floodplain Compliance Memorandum

AKS Engineering & Forestry, LLC (AKS) is working with Consor and the City of St. Helens (City) to help design and permit the proposed Wastewater System Capacity Improvements Project (hereinafter referred to as the Project). The City plans to upgrade and increase the functional capacity of the wastewater management system and has received funding from the Oregon Department of Environmental Quality’s (DEQ) Clean Water State Revolving Fund (SRF). As part of the funding approval, the City is required to complete the State Environmental Review Process (SERP) to address the environmental impacts of the Project prior to construction. This includes complying with applicable environmental laws, consulting with appropriate environmental agencies, and incorporating any required mitigation measures. AKS has been tasked with helping the City navigate through the SERP by completing all required documentation as outlined in DEQ’s Applicant Guide to the State Environmental Review Process guide (SERP Applicant Guide)1.

The purpose of this SERP Compliance Memorandum is to demonstrate the Project’s compliance with the Floodplain Management – Executive Order (1977) federal cross-cutting authority. After thorough examination, it was determined that due to the location of the proposed Project, it will not result in adverse impacts to this resource, as discussed in further detail below. Detailed FIRMETTE maps with Basins 4, 5, and 6 alignments are included as attachments with this memo.

Floodplain Management The Floodplain Management Executive Orders are a series of presidential executive orders that protect floodplain function and federally funded projects from flood damage. The Project area is within the incorporated city limits of St. Helens (Exhibit 1). After reviewing the Federal Emergency Management Agency local Floor Insurance Rate Maps, Basins 4 and 5 lie outside of the 100-year floodplain area. A small section of the Basin 6 alignment lies within the 100-year floodplain area.

However, according to the attached City Planning Department’s Pre-Application Meeting notes, no permanent aboveground changes in elevation will occur. As a result, a floodplain development permit is not required. No further consultation or floodplain permit is required according to the SERP Applicant Guide Section 4.3.3.

Project/Location: Wastewater Capacity Improvement Project – Various

Pre-app date: 11/13/24, 1 pm

**Types of planning permits req**:

Basin 6 – Sheet C-120 & Sheet C-121 – Conditional Use Permit – New line on private property (2615

Sykes Road – Church and 2400 Gable Road – Avamere)

From submittal of CUP, application takes about 2 months to process with a public hearing before the PC scheduled approximately 1 month after submittal. PC meets every 2nd Tuesday each month. We need materials about 1 month in advance of scheduling. Please only include relevant sheets in submittal.

Basin 4 (Sheets CO02-C12) - No triggers for permitting here, all in RoW or upsizing existing on private property. Tons of mature trees, impacts to 5th Street trail, and impacts to a non-city-significant wetland

(DSL jurisdiction).

17.16 (definitions): Public facilities, Minor – means the following public service improvements or structures developed by or for a public agency:

Minor utility structures, except substations, but including poles, lines, pipes, or other such facilities

Sewer, storm drainage, or water system structures except treatment plants, reservoirs, or trunk lines, but including reconstruction of existing facilities, pump stations, manholes, valves, hydrants, or other portions of the collection, treatment and distribution systems located within public property or specified easement

Public facilities, Major – means any public service improvement or structure developed by or for a public agency that is not defined as a minor public facility

17.32 (zones): 2615 Sykes Road and 2400 Gable Road are both Moderate Residential (R7) which lists

Public facilities, Major as a conditional use

17.40 (wetland/riparian): Port Ave. Sheet C-105 – City-significant wetland MC-22. Upland protection zone appears to be within the right-of-way. 17.40.035 exempt acitivites and uses within a siginficiant wetland, riparian corridor and protection zone (h) (D) exempts replacement of existing public utilities within rights-of-way or public easements

17.44 (sensitive lands): None applicable to this project

17.72 (landscaping): Existing landscaping at church to be impacted – to be replaced like for like or rerouted to avoid impacts?

Much of this chapter is not relevant, but see SHMC 17.72.120 about revegetation of natural areas where natural vegetation has been removed by grading

If street trees are to be impacted and replanted, this chapter also provides guidance on tree spacing which is based on height at maturity

17.80 (parking): Impacts on existing off-street parking - striping to replaced like-for-like where existing.

Requires documentation of existing striping on plans.

17.84 (access): Impacts to existing paved accesses and drive aisles at church and Avamere - to be replaced like for like in dimensions?

17.96 (SDR): CUP includes all SDR standards for approval, but most SDR approval criteria are only relevant to multi-family.

The one important SDR standard is that tree over 6” DBH within impacted areas required to be preserved or replaced.

This means the plans should inventory them (only Sheets C-120 & C-121)

17.132 includes specific tree plan requirements for SDR/CUP application.

17.100 (CUP): 17.100.040 (1) (a) – (e) are the 5 criteria for CUP approval.

No special CUP standards for public utilities

17.132 (tree removal): 17.132.025 includes rules for tree plan requirement. Note that this is just for

CUP/SDR, not for all other trees on public property as below. Only required if impacted area subject to

SDR/CUP has more than 10 trees or any tree over 2’ DBH. Unclear because no tree inventory on Basin 6 plans was completed.

17.152 (streets/utilities): Trees within on public property in undeveloped RoW near Port Ave, RoW near

Nob Hill Nature Park/6th Street/Plymouth, Tualatin between 16th St./17th St. , along Gable Road, and in

Heinie Heumann Park are subject to protection.

Is it in Consor’s scope to inventory these? If no way to avoid tree removal, how do we want to address replanting? Side question: why did full tree inventory occur on Basin 4, but not Basin 6?

Existing trees along this landscaping strip - unimpacted? Not sure why this is showing a property line here - it still part of 2400 Gable Road (Avamere)

This is separate property (2390 Gable Road) also owned by Avamere, but served by same lot as 2400 Gable Road

RE: Pre-Application Conference Narrative and Questions Regarding System-Wide Improvements to the City of St. Helens Wastewater Management System

The purpose of this pre-application conference is to discuss future City of St. Helens municipal wastewater improvements in Wastewater Basins 4, 5, and 6 that will improve system capacity and reliability while reducing the frequency of sanitary sewer overflows as the City continues to grow. The 2021 St. Helens Wastewater Master Plan identified needed improvements to the wastewater management system, which was determined to be undersized to support current and future flows associated with recent and forecasted population growth. The City has identified improvements to Basins 4, 5, and 6 as high priority improvements. Replacing existing undersized pipes with larger pipes will help to alleviate stress on the existing system. A preliminary plan in Attachment A illustrates the alignments for the planned system improvements.

We would like to discuss the following questions and any other points of interest from staff:

Land Use

1. Please discuss the required land use applications and permits required for the project described.

See pre-app notes

2. Please discuss the anticipated timeframe for City approval from application submittal to a final decision. See pre-app notes

3. Please confirm that planned improvements, including the restoration of streets and sidewalks temporarily disturbed by the planned improvements, are best characterized as “Public Facilities, Minor” by Title 17 of St. Helens’ Municipal Code (SHMC) and are a use that is permitted outright in all impacted zones. If in the public ROW, not subject to land use approval

4. Please confirm whether the planned improvements impact any historic sites or resources and if so, please explain relevant applicable decision criteria and procedures. N/A

5. Please confirm whether the planned improvements would impact any wetland areas identified in Ordinance 2807 or riparian areas identified in Ordinance 2824. If so, please provide a summary of the relevant development and approval criteria and procedures. See pre-app notes

6. If the planned improvements are subject to SHMC Section 17.40, do the planned improvements qualify for an exemption under the Legally Established Nonconformities in SHMC 17.40.035(h)(D)? see pre-app notes

7. Please confirm that the planned improvements qualify for an exception to the protection zone requirements of Chapter 17.40 per 17.40.040(6)(b). see pre-app notes

8. Please confirm that the planned improvements qualify for an exception to the resource zone and wetland and significant riparian corridor requirements of Chapter 17.40 per 17.40.045(5)(b). see pre-app notes

October 30, 2024

9. Please confirm that any requested exception/exemption to the provisions of Chapter 17.40 require findings in compliance with SHMC Section 17.40.055, including the identification of areas for restoration and enhancement on a 1:1 basis. If so, please confirm that restoration and mitigation could occur off-site of the impacted area. Not subject to 17.40 - no city-siginficant wetland impacted by project. see pre-app notes

10. The planned improvements encroach within areas that are identified as sensitive lands per Chapter 17.44. Please confirm whether any portion of the planned improvements would require review by the Planning Commission under 17.44.015(5)? See pre-app notes

11. The planned improvements would be located within public rights-of-way, within easements on private property, and potentially within areas on private property where easements currently do not exist.

Please confirm whether the City will require all affected private property owners to be listed as an applicant or consent to the subject land use applications? Property owners for NEW sewer lines will need to consent on the CUP application, not for upsizing.

12. The planned improvements are partially located within areas identified as floodplains/floodways. Please confirm whether such are subject to the Floodplain and Floodway standards in Chapter 17.46. No permanent above ground change, no floodplain permit needed

13. Please confirm whether the planned improvements are subject to Chapter 17.72 (Landscaping and Screening). See pre-app notes

14. Please confirm that the planned improvements are subject to the Site Development Review procedures in Chapter 17.96. See pre-app notes

15. Certain segments of the planned improvements are likely to necessitate tree removal. Please confirm whether the tree removal standards in Chapter 17.132 will apply to the planned improvements. See pre-app notes

16. Certain segments of the planned improvements will temporarily impact private improvements, including driveways, fences, and sheds. Please confirm what, if any, land use or related approval is needed for the reconstruction of such impacted improvements on private property. See pre-app notes

17. Please review the submitted plans for compliance with applicable development standards.

18. Please discuss whether there are any prior land use decisions regarding impacted properties that may have implications for the planned use. NA

19. Please discuss any planned updates to City codes or policies that may affect this project.

20. Please discuss what special studies, if any, are required. Tree plan if necessary

21. Please discuss the process for obtaining easements from property owners impacted by the planned improvements. Consor's scope outlines the CDBG compliance with Uniform Relocations Act

22. Please discuss the impacts to existing structures or uses which may become non-conforming as a result of the planned improvements. What structures or uses?

Street/Transportation The remaining questions are not related to planning.

23. Please discuss the permits required for construction activity that will disrupt public roadways.

24. Please discuss the City’s expectations for coordination with private property owners whose driveway access will be temporarily closed during construction.

October 30, 2024

25. Please discuss the process for acquiring needed permits for construction activity that will occur within the public right of way, including construction necessary for the replacement of streets, curbs, street trees, and sidewalks that are temporarily impacted during the installation of the planned improvements.

26. Certain segments of the planned improvements are expected to be bored beneath existing operating rail lines. Please solicit feedback from affected rail operators regarding their requirements for such boring operations.

Public Services/Utilities

27. Please provide any available as-builts for public sewer lines.

28. Please discuss any anticipated changes to the City’s engineering design standards or any other standards which may impact this project.

29. Certain segments of replacement sanitary sewer facilities are planned to be abandoned in place.

Please discuss the City’s expectations for such abandonment.

General

30. Please review the planned alignments as shown in the Preliminary Plans and discuss any concerns.

31. Please confirm whether landslide hazard areas exist along the planned alignments. N/A

32. Please discuss whether the City is aware of any historic, cultural, natural resources and/or features that might impact the development of the site. N/A

Please identify any other issues or constraints of which you are aware. Thank you in advance for your time and consideration of this project.

Sincerely, AKS ENGINEERING & FORESTRY, LLC
