About this file
This is a Liquidated Damages Form issued by the Town of Palm Beach, Florida, establishing the framework for assessing financial penalties against contractors for failure to meet project completion deadlines. The form notifies contractors that timely completion is essential and outlines the Town's and contractor's mutual acknowledgment that damages resulting from delays are difficult to calculate precisely. Accordingly, the parties agree that the contractor and contractor's surety shall pay liquidated damages in amounts specified in an attached schedule based on the Florida Department of Transportation guidelines (paragraph 8-10) for each calendar day of delay beyond the scheduled completion date. The daily penalty assessment continues through any approved written change orders and persists even if the contractor is terminated for default prior to project completion, accumulating against the contractor until the work is fully completed.
The liquidated damages schedule references the Florida Department of Transportation's established penalty structure, which provides predetermined daily damage amounts rather than requiring the Town to prove actual losses from project delays. Contractors must acknowledge their understanding of and agreement to comply with the liquidated damages terms by executing the form with an authorized signature, company name, and date. This document serves as a binding commitment ensuring contractor accountability for schedule adherence on the North Lake Way Living Shoreline project, a living shoreline stabilization and enhancement construction initiative along the Lake Worth Lagoon in Palm Beach.
