About this file

This is a Bid Bond document prepared using the AIA Document A310-2010 standard form, applicable to the Fairmont Plaza Development project in Youngsville Borough, Warren County, Pennsylvania. The bid bond serves as a financial guarantee that a contractor who submits a bid will either enter into a contract based on the accepted bid or forfeit the bond amount if they fail to do so. The document establishes the binding obligation between the contractor, surety, and project owner, with the bond amount to be specified in the bid documents. The specific values for the contractor name, surety information, owner details, bond amount, and project details remain incomplete as this is marked as a draft document produced on September 24, 2024.

The bond document contains standard conditions requiring that if the owner accepts the contractor's bid, the contractor must enter into a contract and provide required performance and payment bonds with an approved surety, or pay the owner the difference between the bid amount and any higher amount the owner must pay to secure alternative contractors. The surety waives notice of extensions up to 60 days beyond the stated bid acceptance period but requires consent for any extension exceeding that duration. As a draft form, this document has important legal implications and consultation with an attorney regarding its completion or modification is recommended. No specific pricing terms, set-asides, funding sources, or contract renewal options are detailed in this bond form, which is designed as a preliminary document requiring completion with project-specific information.

The Contractor and Surety are bound to the Owner in the amount set forth above, for the payment of which the Contractor and Surety bind themselves, their heirs, executors, administrators, successors and assigns, jointly and severally, as provided herein. The conditions of this Bond are such that if the Owner accepts the bid of the Contractor within the time specified in the bid documents, or within such time period as may be agreed to by the Owner and Contractor, and the Contractor either (1) enters into a contract with the Owner in accordance with the terms of such bid, and gives such bond or bonds as may be specified in the bidding or Contract Documents, with a surety admitted in the jurisdiction of the Project and otherwise acceptable to the Owner, for the faithful performance of such Contract and for the prompt payment of labor and material furnished in the prosecution thereof; or (2) pays to the Owner the difference, not to exceed the amount of this Bond, between the amount specified in said bid and such larger amount for which the Owner may in good faith contract with another party to perform the work covered by said bid, then this obligation shall be null and void, otherwise to remain in full force and effect. When so furnished, the intent is that this Bond shall be construed as a statutory bond and not as a common law bond.
