About this file

This document is a Conflict of Interest Reporting Requirements notice issued by the City of Midland, Texas, for the FY27 Sweeping Project. The notice outlines mandatory compliance requirements under Texas Local Government Code Chapter 176, which governs the disclosure of relationships between vendors and local government officers. Vendors who have a business relationship with the City of Midland and meet the requirements under Section 176.006(a) must file a Conflict of Interest Questionnaire (Form CIQ) with the City Secretary no later than the seventh business day after becoming aware of facts requiring disclosure. The notice applies to all bidders responding to the City of Midland's request for the Arterial and Downtown Sweeping Project, which involves furnishing materials and labor for sweeping services.

Failure to comply with conflict of interest reporting requirements constitutes a Class C Misdemeanor under Texas law, and contracts awarded to vendors in violation of these requirements are subject to termination with no recourse to the City of Midland, with the vendor subsequently removed from the bidders list for a minimum of one year. The notice clarifies that Form CIQ submission is required only when a conflict of interest exists as defined by statute; however, if no conflict exists at the time of bid submission and one is subsequently discovered, the form must be filed immediately. By submitting a bid response, vendors represent their compliance with Chapter 176 of the Texas Local Government Code. The City of Midland maintains a current list of local government officers on its website at http://www.midlandtexas.gov/, and completed forms should be submitted with the bid or mailed to the City Secretary at the provided address.
