About this file
This is a Litigation History disclosure form required by a Florida county for vendors responding to a solicitation for pool resurfacing services at Topeekeegee Yugnee (T.Y.) Park's Castaway Island Water Park in Hollywood, Florida. The form mandates that vendors disclose all material litigation cases filed, pending, or resolved within three years prior to the solicitation response end date involving the vendor, its parent or subsidiary companies, predecessor organizations, or principals. Material cases include those related to similar work being performed, allegations of fraud, negligence, error, omissions or malpractice, vendor default or termination, financial condition issues including bankruptcy, and criminal proceedings involving business-related offenses. Additionally, vendors must disclose any litigation cases involving proposed subcontractors or subconsultants against the county within five years prior to the solicitation response. Vendors must provide complete information for each material case, including case number, court or tribunal name, case type, claims, disposition, and judgment status, along with copies of judgments and settlement agreements with limited redaction rights.
Failure to disclose material cases or complete litigation history information may result in the vendor being deemed nonresponsive and ineligible for award. The form requires vendors to indicate whether material cases exist and, if so, identify the nature of the litigation and its outcome. If the form is not submitted with the initial solicitation response, vendors must provide it within three business days of the county's request. The form date is September 9, 2024, and vendors must ensure full compliance with all disclosure requirements and stated timeframes to maintain responsive status in the procurement process.
