Accrual Rate
1. Effective January 1, 2015, employee sick leave banks are frozen and no additional sick leave accrual occurs. Refer also to the agency’s Disability Coverage policies and Paid Time Off policy.
2. Per the agency’s Paid Time Off (PTO) policy, on December 31st of each year should an employee have a PTO balance in excess of the maximum accrual amount, the excess PTO hours will transition to a Sick Leave account to be accessed only as allowable under this Sick Leave policy.
Use of Sick Leave
1. Effective 1/1/2015, employees may access sick hours from their sick leave bank under the following circumstances: Employees approved to receive short term disability benefits for non-work-related disabilities through the agency’s employer paid Short Term Disability plan may elect to use hours from their frozen sick bank to bring their combined gross compensation to 100% of their regular base pay. Once the short-term disability claim is no longer active, hours from the frozen sick leave bank may no longer be accessed. For example, a fulltime employee receiving STDI benefits of 60% (which is equivalent to 24 hours/week of pay, based on a 40-hour work week) may elect to use 16 hours/week from their frozen sick bank to bring their combined gross compensation to 100% of their regular base pay.
2. Employees out on approved continuous FMLA to care for a family member may use hours from their frozen sick leave bank beginning on the 8th calendar day of continuous approved leave (with 40 hours of PTO/LWP utilized). Up to 40 sick leave hours per week may be used for fulltime staff. Employees will not experience a break in continuous leave for working intermittently during an approved continuous leave in order to minimize disruption to the work unit, so long as the intermittent periods of work meet the intent of this provision. The Director of Human Resources and the Executive Director will make this determination, should a question of intent arise.
