INDEFINITE DELIVERY/INDEFINITE QUANTITY (IDIQ) SOLICITATION

This is a notice that the resultant contract is for a 100% 8(a) set-aside requirement IAW FAR 19.805. Only proposals submitted by 8(a) companies will be accepted by the Government. Any quotation that is submitted by a Contractor that is NOT an 8(a) Business will not be accepted.

SECTION B -SUPPLIES OR SERVICES AND PRICE/COSTS

b.1.0 GENERAL The Small Business Administration (SBA) is issuing this Request for Proposal (RFP) under NAICS 541611 “Administrative Management and General Management Consulting Services”.

SBA intends on issuing a single award Indefinite Delivery/Indefinite Quantity (IDIQ) in accordance with Federal Acquisition Regulation (FAR) 19.805. ” This will be set-aside as an 8(a) competitive award.

b.2.0 INTRODUCTION The SBA is located in Washington, DC, and has a requirement for consulting services to support the SBA in its response to and role in disaster recovery.

b.3.0 Purpose This IDIQ establishes the terms and conditions applicable to orders awarded against it. Any task orders awarded against this IDIQ must generally be for services described in section C below. Specific items, quantities, and prices, if awarded, will be awarded via task orders against this IDIQ. Emerging requirements that fall within the general description in section C may be added without further opportunity to submit an IDIQ quote. If the Government determines that additional labor categories are required during the life of the IDIQ, the Government reserves the right to transfer the identified labor categories to the IDIQ to include any discounted rate which will be agreed to by both parties.

b.4.0 Method for Awarding an Idiq This requirement is a total 8(a) set-aside under NAICS 541611 - Administrative Management and General Management Consulting Services. A single award IDIQ Q’s will be awarded to the offeror whose proposal in response to this RFP provides the best value to the Government.

b.5.0 DESCRIPTION OF SERVICES The U.S. Small Business Administration (SBA) Office of Disaster Recovery and Resilience (ODRR) IT and Data Analytics Division (ITDAD) Data Analytics Branch advances data-to-actionable-insights. The ODRR mission includes inherent risks of uncertainty, unforeseeable needs, and/or other widely varying requirements in primary support of SBA’s disaster loan program, requiring robust, high-reliability technical implementations, frequent low-notice, short-turn-around, and high-impact deliverables by way of the Data Analytics Branch.

Inherently Governmental services as identified in FAR 7.503 or by the ordering agency are prohibited. It is the responsibility of the Contracting Officer placing the order to make this determination. Ordering activities must require prospective contractors to identify potential conflicts of interest and address those, prior to task order award. Personal services as defined in FAR 37.104 are prohibited.

b.6.0CONTRACT TYPE AND VALUE
B.6.0.1This is a single award Indefinite Delivery/Indefinite Quantity (IDIQ) in accordance with Federal Acquisition Regulation (FAR) 19.8 with one base year and four (4) one (1) year option periods and a 6-month extension IAW FAR 52.217-8. This Agreement will allow for Firm Fixed Price (FFP), Time & Materials (T&M), and Labor Hour (LH) with fixed labor rate task orders.

IDIQ Ceiling: $41,000,000.00 IDIQ minimum: $500.00.

IDIQ Call Limit: There is No Minimum or Maximum number of calls that can be issued.

B.6.0.2 Obligation The Contractor shall provide Disaster Recovery, Mitigation, Policy Support Services. The Contractor shall furnish all personnel, facilities, equipment, materials, supplies, and services (except as may be expressly set forth in this indefinite delivery/indefinite quantity (IDIQ) contract or any task order (TO) and respective modifications against this IDIQ contract as furnished by the agency) and performance of these requirements in accordance with the Statement of Work (SOW) of this IDIQ contract and all subsequent TOs and respective modifications issued against this IDIQ contract.

THE TOTAL MAXIMUM CONTRACT VALUE, defined as the sum of contractor payment streams associated with all task orders and respective modifications against all master IDIQ contracts, shall not exceed $41,000,000.00.

THE MINIMUM GUARANTEE for the BASE TASK ORDER(S) VALUE for all the IDIQs contract awarded is $500.00.

B.6.0.3 Resumes The IDIQ holder may be required to provide resumes for all or a portion of quoted personnel for orders. The orders will establish submission requirements and how submissions will be evaluated.

B.6.0.4 Contract Type for IDIQ Task Orders Contract type of any resulting IDIQ Order will utilize firm-fixed price to the maximum extent practicable, but depending on the nature of the work, may be a combination of Firm-Fixed Price, Time, and Materials, and/or Labor Hour, or a combination of types that best suits the work to be performed. IDIQ pricing will include fully burdened labor rates, established at the IDIQ level.

B.6.0.5 Time and Materials Task Orders For time-and-materials and labor-hours orders, IDIQ Task Order the Contracting Officers must follow the procedures in FAR 16.601 and 16.602.

B.6.0.6 Open Market Items The Government does not anticipate ordering open market items. The Contractor may utilize or offer open market items in their quote.

B.6.0.7 Other Direct Cost (ODC) Other Direct Costs will be identified at the Task Order level with a not to exceed (NTE) amount and will be identified on a separate CLIN.

SECTION C DESCRIPTION/SPECIFICATIONS/PERFORMANCE WORK STATEMENT

C.1.0 Background The mission of the Office of Disaster Recovery and Resilience (ODRR) is to connect individuals, businesses, and private non-profits with SBA disaster assistance programs and improve disaster recovery outcomes and economic resilience by helping communities prepare for, respond to, recover from, and mitigate against disasters of all types. The ODRR IT and Data Analytics Division (ITDAD) Data Analytics Branch advances data-to-actionable-insights. The ODRR mission includes inherent risks of uncertainty, unforeseeable needs, and/or other widely varying requirements in primary support of SBA’s disaster loan program, requiring robust, high-reliability technical implementations, frequent low-notice, short-turn-around, and high-impact deliverables by way of the Data Analytics Branch.

C.2.0 OBJECTIVES

This requirement will help SBA’s ODRR team provide incident management support, technical assistance materials development, and robust analytical support to inform decision-making processes in preparation for a disaster declaration and after a declared disaster event. This project will ensure that there is a highly refined and integrated flow of information from across the agency, interagency, national, and external sources to inform the Administrator’s economic recovery priorities.

C.3.0Task Areas
C.3.0.1Data Analytics Expert Products Support

The contractor shall provide a wide-ranging System-of-Systems products support: Analysis, design, development, systems re-engineering, Configuration Management/Change Management (“CM”), Extract, Transform, Load (ETL) optimization, API solutions, systems administration, Quality Assurance (“QA”), Test and Evaluation (“T&E”), various releases, deployments, and deliveries, wide-ranging Operations and Maintenance (“O&M”) across a broad suite of products and assessment of opportunities to incorporate Artificial Intelligence (“AI”) and Machine Learning (“ML”).

The Contractor must deliver a team of Personnel for Expert Products Support including, but not limited to:

a. analysis,

b. design,

c. development,

d. CM,

e. systems re-engineering,

f. ETL optimization,

g. API solutions

h. System-of-Systems administration

i. QA,

j. T&E,

k. privacy requirements,

l. cybersecurity,

m. assessment of opportunities to incorporate Artificial Intelligence (“AI”) and/or Machine Learning (“ML”) into DR&R efforts, both internally and externally facing. To review opportunities for, but not limited to:

· Predictive Analytics,

· Natural Language Processing (NLP) and Large Language Models (LLM),

· Generative AI,

· Training models, navigating access, compliance, privacy, and security concerns across all applicable platforms, data types, and use cases

n. various releases, deployments, and deliveries

o. wide-ranging O&M across a broad suite of products which may include:

i.AGOL,
ii.ArcGIS Hub,
iii.Tableau,
iv.MS Azure,
v.MS 365, and/or PowerBI workspace(s).

All deliverables, reports and plans must be sent to the COR and CO as identified in each task order issued against the IDIQ.

C.3.0.2 Standardization of Field Operations Center Policy and Procedures The standardization initiative/effort for field operations east (FOCE) and field operations west (FOCW) is intended to bridge gaps and create processes to streamline common practices such as field operational procedures, reporting, administrative functions, employee relation functions and other operational roles/duties/features within these two departments.

Weekly meetings are help with representatives of both field offices and their respective departments to discuss various ways to sync processes and ultimately, implement them. In addition to weekly departmental meetings, a scheduled meeting with senior management (FODR) is had to outline successes and roadblocks. Work is documented and captured within a spreadsheet and timeline created for this initiative.

The goal is to standardize the many procedures between both field offices to the greatest extent possible.

Standardization of Field Operations Center Policies and Procedures Deliverables:

a. Phase 1: Standardization efforts to ensure common practices with the reporting structure (templates, forms, reports, distribution lists).

Reports include but not limited to:

1. Daily Metrics and One-pagers

b. Phase 2: Standardized Efforts, including operational Standard Operating Procedure (SOP).

c. Phase 3: Management of the initiative – continued meetings, communication, provide updates to the documentation and processes.

All deliverables, reports and plans must be sent to the COR and CO as identified in each task order issued against the IDIQ.

C.3.0.3 Data Analytics Expert Services Support The contractor must provide the following analytic services:

C.3.0.3.1 Data Analytics The science of analyzing an organization’s raw data to make conclusions about that information to optimize its performance, perform more efficiently, and/or make more strategically guided decisions using a variety of software tools including workbooks, programming notebooks, data visualization solutions, reporting tools, and open-source languages for the greatest practicable data manipulation (“Data Analytics”).

C.3.0.3.2 Spatial Analysis Spatial statistics and other formal techniques which study entities using their topographical, geometric, and/or geographic properties (“Spatial Analysis”) for greater situational awareness across the “who, what, when, and where” of SBA’ s global (CONUS and OCONUS) operations which may interact with geographic context; and

C.3.0.3.3 Geographic Information System (GIS) Mapping Geographic Information System (GIS) supports environmental programs that include but not limited to: Both static and interactive/responsive assets helping users understand patterns, relationships, and geographic context (“GIS Mapping”); cultural resource GIS (CRGIS); groundwater monitoring; growth forecast modeling; habitat conservation plans; habitat modeling; image analysis support for emergency response; mapping, cartography, and mashups (e.g., combining data from more than one source into a single integrated tool to include aerial mapping); migration pattern analysis; natural resource planning; remote sensing for environmental studies; terrestrial, marine, and/or atmospheric measuring/management; vegetation mapping; and watershed characterization for mitigation planning.

The Contractor must deliver a team of Personnel for Expert Services Support including, but not limited to:

a. Data Analytics,

b. Spatial Analysis,

c. GIS Mapping which may include high-consequence ArcGIS deliverables such as:

i. design and delivery of responsive and/or interactive products, and

ii. creation of a wide range of geographic content including maps, scenes, apps, and layers for readily apparent insights that the SBA can rely upon to make strategically guided, and effective decisions.

d. The advancement of proposed requirements,

e. Wrangling, combining, and curating datasets -- utilizing best practice methods, tools, and functions for the greatest practicable data manipulation and visualization,

f. Development of data analyses, summaries, and visualizations utilizing leading platforms and solutions,

g. Advancing data-to-actionable-insights (whereby novel/non-obvious insights are of particular value to the Government),

h. Decision support -- supporting greater situational awareness for effective decisions.

C.3.0.3.4 Training SBA requires training across all levels of ODRR in primary support of the disaster loan program (which may include up to twenty-four (24) live large format trainings (e.g., 100+ attendee’s per training session), instructional video recordings, various technical job aids, update policies and procedures, and instruction manuals) on products and services including the development, enhance, Quality Assurance (QA), Test and Evaluation (T&E), and Operations and Maintenance (O&M) of a complex System-of-Systems.

All deliverables, reports and plans must be sent to the COR and CO as identified in each task order issued against the IDIQ.

C.3.0.4 Economic Impact Assessments And Analyses The contractor shall provide subject matter expert consulting in economic revitalization and data analysis to support SBA personnel in meeting with stakeholders to collect information for assessment, presenting findings from the assessment, and assisting with recovery strategies based on the assessment. The Economic Impact Assessment compares post-disaster activity and data to a baseline such as pre-disaster metrics to qualitatively, and quantitatively measure impacts. All activities related to the conduct of this task may be required to be conducted in a remote or in-person environment, including deployment to disaster locations and meetings with stakeholders. These assessments are descriptive in nature, describing the qualitative and quantitative data related to the Area of Interest (AOI). Sources from this information may be derived from SBA, Federal, state, tribal, territorial, local, private sector, non-profit, media and social media, and community sources. Below is a summary of the type of data typically included (but not limited to) in these assessments:

The contractor shall provide advisory analyses and services for, but not limited to,

a. Quantitative considerations:

i. SBA disaster loan application statistics;

ii. FEMA Individual Assistance and Public Assistance statistics;

iii. US DOL and state unemployment data;

iv. Data and information from other federal agencies and all Recovery Support Function partners;

v. Survey data gathered by the vendor with the assistance of ODR&R staff;

vi. Survey data from local regional planning commissions, economic development districts, chambers of commerce, etc.;

vii. Survey data from academic partners and sources;

viii. Demographic data;

ix. Industry data;

x. Business activity data; and

xi. State and local tax revenue data.

b. Qualitative considerations

i. Survey based economic recovery “issue” information;

ii. Community sentiments, social listening, and media analysis;

iii. Psychographic and ethnographic observation and analysis; and

iv. Programmatic capabilities from Federal, state, tribal, territorial, private sector, and non-profit sources;

The contractor shall also provide facilitation, advising, and documenting/memorializing of/for:

a. Needs assessment(s);

b. Options strategy document(s); and

c. Implementation of strategies including stakeholder engagement which may include listening sessions, webinars, small meetings as well as larger Economic Recovery Workshops and planning meetings; other technical assistance to build capacity and encourage inclusive participation in the recovery process; and assistance in facilitation access to economic recovery resources to support recovery needs as determined to be valuable by stakeholders and Economic Recovery Support Function (ESRF).

Data in these assessments is augmented by analysis through Geographic Information Systems (GIS) and include practical recommendations for how the community(ies) can address their recovery challenges.

Economic Impact Assessments are to be prepared by working collaboratively with SBA regional (including field) and HQ staff to support the data gathering, analysis, and report preparation. When required, final work products are to be expected within an agreed-to timeframe. The Vendor will have the capacity to perform an Economic Impact Assessment anywhere in the United States and its territories when required by SBA.

All deliverables, reports and plans must be sent to the COR and CO as identified in each task order issued against the IDIQ.

C.3.0.5 Analytical Products On Diversity And Equity Initiatives (DEI) And Underserved Communities The contractor shall provide data analysis and consulting on diversity and equity related initiatives and underserved communities to support senior leader decision-making and the achievement of related initiatives or projects, such as those outlined in response to Government Accountability Office (GAO) audits related to Disaster Loan Making (DLM) in underserved communities.

This task includes both verbal consulting through meetings and in-person or virtual engagements and the production of written products. Written and analytical products may include but are not limited to:

a. Recommend responses to congressional inquiries (including Government Accountability Office);

b. Qualitative and quantitative analyses;

c. White papers based on research and analytical findings;

d. Advise on policy memos or notice;

e. Job aids;

f. Presentations;

g. Project plans.

C.3.0.5.1 Development and Maintenance of reports utilizing Data Collection, Analysis, and Reporting on Diversity, Equity, and Inclusion (DEI) Outreach Effectiveness The contractor will, in conjunction with ODR&R, develop a report framework for ongoing data management, which includes:

a. Implementing advanced data gathering methods to capture relevant information about the affected DEI businesses and the efficacy of current SBA programs.

b. Utilizing analytical tools to interpret data and provide insights that will inform the optimization of SBA’s services and outreach efforts.

c. Contributing to a unified system that integrates data from various sources, providing near-real-time insights and updates to stakeholders.

d. Ensuring consistent and accurate reporting to aid in decision-making, resource allocation, and data reporting.

C.3.0.5.2Monitoring and Evaluation
a.Leverage feedback from various stakeholders, including small businesses owners, trusted community partners, and other key stakeholders.

b. In conjunction with ODR&R, develop surveys, conduct focus groups, and utilize other methods to collect feedback from stakeholders to inform continuous improvement strategies.

c. The contractor must demonstrate subject matter expertise and experience developing projects or products that serve underserved communities, defined as including the following persons who/who are:

i. Asian American;

ii. Black and African American;

iii. Hispanic and Latino;

iv. Middle Eastern;

v. North African;

vi. Alaska Native;

vii. Native American;

viii. Native Hawaiian;

ix. Pacific Islander;

x. Other persons of color;

xi. Tribal communities;

xii. Have disabilities;

xiii. Lesbian, gay, bisexual, transgender, and queer (LGBTQ+);

xiv. Of religious minorities;

xv. Live in rural or underserved urban areas;

xvi. Veterans, military servicemembers, and spouses;

xvii. Women; and

xviii. Are otherwise adversely affected by persistent poverty or systemic inequality.

Deliverables: All deliverables, reports and plans must be sent to the COR and CO as identified in each task order issued against the IDIQ.

**The Tasks listed above are not exclusive of all types of services under the resulting IDIQ. Additional services from the corresponding NAICS, may be required, solicited, and ordered from the resulting IDIQ.

C.4.0 LABOR CATEGORIES

The following list of labor categories and qualifications are those determined by the government to be relevant to this agreement. The contractor may propose additional labor categories as appropriate.

(The Government may allow substitution of years’ experience or professional certifications for Graduate level master’s Degrees if the experience in the proposed resume demonstrates the necessary expertise and capabilities expected for the labor category requirements).

1. Senior Project Manager **Key Personnel The Vendor shall provide Project Management elements including, but not limited to:

Manages team of program area experts. Develops, directs, and manages strategic approach and strives to improve work processes, products, and services. Meets with client regularly to ensure work meets/exceeds client objectives. Provide deliverables and service(s), and/or Training support. Technical implementations assurance and support such as regular standups (standups will be scheduled at a minimum of one (1) meeting per week to include all personnel required by SBA). Provide oversight and executive level management consulting to overall contract operations involving multiple tasks and groups of personnel across ODRR’s global operations.

2. Senior Consultant (Master’s Degree and 10 years’ experience) **Key Personnel Serves as project lead of a specific consulting assignments, to include leading a team of consultants or subject matter experts. Applies practical experience and theoretical knowledge and expertise to solution development. Ensures the accomplishment of project activities and objectives. Provides a broad range of consulting services, including program planning, strategy development, program execution, evaluation, and policy development. Utilizes experience and expertise to contribute to the development of deliverables. Leads or assists in discussions and meetings with the client or project team. Performs a variety of tasks that require both practical and experience and theoretical, state-of-the-art, technical knowledge in specialty areas. Manage the CM process and advance organizational best practices in Agile & DevSecOps.

3. Subject Matter Expert (Master’s Degree and 10 years’ experience or equivalent) **Key Personnel Serves as a subject matter expert in a specialized topic that supports health and social services recovery. Applies practical experience and theoretical knowledge and expertise to solution development. Ensures the accomplishment of project activities and objectives. Provides targeted support based on their discipline, conducts any necessary program planning, assessment, evaluation, and technical reports. Leads or assists in discussions and meetings with the client or project team. Performs a variety of tasks that require both practical and experience and theoretical, state-of-the-art, technical knowledge in specialty areas. Update/enhance, maintain, create, and provide value-added deliverables across adaptive Agile methodologies which may include, but are not limited to continuous iterative development, Kanban Approach, and Test-Driven Development (TDD). Provide unique and innovative ways to find, analyze, and present data to ODR&R leadership as required for SBA to serve its stakeholders. Examples may include the use and integration of tools like Esri; leveraging capabilities such as automation, AI, and Natural Language Processing (NLP). Advise the organization concerning IT modernization, AI, ML, and other emerging technologies.

4. Consultant (Master’s Degree and 5 years’ experience) Serves as subject matter expert of a specific consulting assignments, to include supporting a team of other subject matter experts. Applies practical experience and theoretical knowledge and expertise to solution development. Ensures the accomplishment of project activities and objectives. Provides a broad range of consulting services, including program planning, strategy development, program execution, evaluation, and policy development. Utilizes experience and expertise to contribute to the development of deliverables. Leads or assists in discussions and meetings with the client or project team. Performs a variety of tasks that require both practical and experience and theoretical, state-of-the-art, technical knowledge in specialty areas.

5. Lead Planner I (Bachelor Degree and 5 years’ experience) Manages and performs required analysis to validate or change, modify, improve and implement plans and procedures. Facilitates organizational dissemination of findings and resulting recommendations using appropriate techniques. Facilitates group briefings and discussions to enable the development of plans and other decisions.

6. Lead Planner II (Master’s Degree and 5 years’ experience) Senior expert that leads and performs required analysis to validate or change, modify, improve and implement plans and procedures. Facilitates organizational dissemination of findings and resulting recommendations using appropriate techniques. Facilitates group briefings and discussions to enable the development of plans and other decisions.

7. Analyst (Bachelor Degree and 3 years’ experience) Performs analyst functions including data collection, interviewing, data modeling, project testing, and creation of project testing, and creation of performance measurements to support project objectives. Records discussion content and related facilitation support services.

8. Junior Analyst (Bachelor Degree and 1 year experience) Performs junior analyst functions including raw data collection, interviewing, basic statistical analysis, conducts as needed research, and creation summary reports of mission activities to support project objectives. Records discussion content and related facilitation support services.

9. Writer/Editor (Bachelor degree and 3 years’ experience) Performs a wide range of design development, technical editing, and word processing, including graphics, websites, and spreadsheets.

10. Senior GIS Consultant (Bachelor Degree and 5 years’ experience) Serves as a senior member of consulting teams as a task manager or as a project leader on projects of limited scope and complexity. As a consulting team member, collects, analyzes, and interprets geospatial data. Produces high-quality mapping products to support recovery operations, designs and conducts geospatial analyses, and is highly proficient in the use of ESRI GIS products and other commonly used geospatial data platforms. Develops, or participates in the development of, assignment methodology.

11. Junior GIS Consultant (Bachelor Degree and 1 years’ experience) As a consulting team member, collects, analyzes, and interprets geospatial data. Produces high-quality mapping products to support recovery operations, conducts geospatial analysis, and is highly proficient in the use of ESRI GIS products and other commonly used geospatial data platforms. Develops, or participates in the development of, assignment methodology.

12. Logistics Coordinator (Bachelor Degree and 3 years’ experience) Assists with the logistical aspects of meetings, conferences, and special events. Also assists with videoconferences, focus group meetings, field tests, and webcasts. Contribute to the marketing efforts –direct mail, radio, press, e-mail, and other channels to effectively communicate messages. Contribute to the preparation of invitations. Contribute to the maintenance of participant or applicant database. Field questions about registration and meeting agenda. Research travel arrangements for meeting planners. Track registration fees and payments. Send and collect reimbursement forms of meeting participants. Check honoraria and keeps list of payments. Contribute to the preparation, reproduction, and distribution of conference materials. Research information about possible room setup, audiovisual equipment, and other on-site meeting needs. Assist meeting planners on-site work including telephone, fax, transportation, and related requests from participants. Assist meeting planners in arrangements for video conferences, Web casts, focus groups, and field tests.

Note: Resumes for key personnel will be required at the IDIQ level and if required, identified at the task order level. The contractor must have the minimum qualifications as stated in the labor categories and qualifications above which will flow to the task orders and respective modifications. The Government reserves the right during TBD administration as needs emerge to add additional Pools of functional areas and labor categories that are within the general scope of these services to the IDIQ.

The only resumes and letters of commitments that will be provided at the IDIQ Level will be key personnel identified above. Awardee shall have all SMEs available.

C.5.0 Wage Determination The Contractor is responsible for adhering to the most current Wage Determination from the Department of Labor for each location, as applicable. Wage determinations can be found at the address below – https://beta.sam.gov/search?index=wd

C.6.0 Travel Travel identified at the task order level will be pursuant to the reimbursement schedule allowed by the Code of Federal Regulations for the Federal Travel Regulation System for federal employees. Should travel be required, all travel must be preapproved in writing by the COR and must adhere to FAR 31.205-46 Travel costs.

C.7.0 PERIOD OF PERFORMANCE

This IDIQ will be effective from the date of award for one base year and include four (4) one-year option periods which may be unilaterally exercised as required by the Government. Work on issued task orders may extend up to one (1) year beyond the effective period of this IDIQ. However, no new orders may be issued once the five-year period has expired.

The exercise of option periods is contingent upon receiving a Satisfactory CPARS rating under the Task Orders issued against the IDIQ during the performance period.

C.8.0 contract LINE-ITEM number (CLIN) Reference Attachment 3-Pricing Sheet for IDIQ and Attachment 4-Task Order 1 Task Orders issued against the IDIQ will be one of the following contract types or a combination of contract types–Firm Fixed Price (FFP), Time and Materials (T&M) or Labor Hour (LH) with fixed labor rates.

C.9.0 PLACE OF PERFORMANCE

The primary place of performance will be at the Government’s facility in Washington, DC, or field office locations throughout the United States on TDY basis. Work may be performed at the Contractor’s facility or remotely as required and approved by the COR.

C.10.0 TELEWORKING

Definition. The Telework Enhancement Act of 2010 defines telework as "a work flexibility arrangement under which an employee performs the duties and responsibilities of such employee's position, and other authorized activities, from an approved worksite other than the location from which the employee would otherwise work."

a. In practice, "telework" is a work arrangement that allows an employee to perform work, during any part of regular, paid hours, at an approved alternative worksite (e.g., home, telework center). This definition of telework includes remote work but does not include any part of work done while on official travel or mobile work. Remote work is telework whereby the employee resides and works at a location beyond the local commuting area of the employing organization's worksite or to describe a full-time telework arrangement. Mobile work is not telework and is characterized by routine and regular travel to conduct work in customer or other worksites as opposed to a single authorized alternative worksite. Examples of mobile work include site audits, site inspections, investigations, property management, and work performed while commuting and traveling between worksites.

b. There are two types of telework: routine and situational or ad-hoc. Routine telework is ongoing, regularly scheduled full or part time scheduled telework. Situational or ad-hoc telework is unscheduled telework approved on an occasional, one-time, irregular, or temporary basis. Unscheduled telework is typically utilized to facilitate continued work performance as a result of situations such as special work assignments, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers.

Telework Training. The Contractor is responsible to determine telework training requirements and approve or disapprove teleworking by its employees if telework. Although utilization is not required, Contractors may utilize Government telework training available at no cost at the Office of Personnel Management (OPM) website www.telework.gov.

Government Furnished Property (GFP). To the extent that the contractor allows its employees to telework or requires its employee to work offsite at the Contractor’s facility, hand receipts or other documentation in support of Receipt and Issue System for Government Material may be required upon issuance of a Government laptop. Such laptops are Government Furnished Property, and compliance with FAR clause 52.245-1, Government Property is required. The unit acquisition cost of each provided laptop is $2,000. Laptops will be provided to Contractor employees within 30 days of the date of contract personnel suitability is confirmed or within 30 days of first task order award, whichever is later.

Information Security Requirements. The Contractor must ensure compliance with SBA information security requirements as specified in Standard Operating Procedure (SOP) 90 47 4, Information Technology Security Policy. The requirements are specified in paragraphs (a) through (d) herein (and any SOP revisions).

NOTE: All contract personnel working onsite or with SBA equipment/systems will be required to clear personnel security suitability. All work is unclassified, so a facility clearance is not necessary.

a. Ensuring that adequate protection is maintained on their workstation, laptop, smart device, or other Government-provided IT compute resources, including not sharing passwords, locking devices, and removing Personal Identity Verification (PIV) cards before leaving their workstation.

b. Ensuring Personally Identifiable Information (PII) and/or sensitive data stored on SBA IT resources, including but not limited to laptops, tablets, smart devices, external hard drives, USB drives, CD-ROMs/DVDs, personal digital assistants is encrypted with SBA provided encryption mechanisms. Contractors may access PII remotely [i.e., via remote access when the individual is not physically located in an SBA facility (e.g., when the individual is teleworking or working offsite at a Contractor’s facility)] unless explicitly prohibited by the SBA Senior Agency Official for Privacy (SAOP) and/or Authorizing Official (AO) for the particular information system. Access must be achieved from Government Furnished Equipment/Government Furnished Property (GFE/P) or through an approved SBA virtual interface (virtual private network). Authorized users must not download or store PII on non-GFE/P.

c. Authorized users must not download, print, or store PII on non-GFE. Utilizing assigned privileged access rights (e.g., system administrator, web site administrator, etc.) responsibly and based on need to know.

d. Authorized users are prohibited from home printing in all cases unless expressly authorized by the Office of the CIO.

Onsite Government Facility Non-Availability. Government facilities may be closed by OPM, United States Presidential Executive Order, or other official Government means. Facilities may also be closed on a per-Agency, per-facility, per-office, or other basis at the Government’s sole discretion.

a. Regardless of the conduciveness of the tasks to teleworking, the Government may notify the Contractor that onsite Government facilities are not or are no longer available. In that event, the Contractor must immediately notify the Contracting Officer in writing of either its plan or its inability to continue contract or order performance in accordance with contract or order requirements. Plans must clearly identify and detail any impacts to price, schedule and performance.

Authorization to Telework. The Contractor must ensure continuous successful performance of contract or order requirements. Telework is primarily an arrangement established to facilitate the accomplishment of work within business-related, operational needs and constraints. The contractor is responsible to ensure onsite participation in meetings and other collaborative venues as appropriate or requested by the government. The contractor is responsible to ensure employee productivity in completing tasks specific to the supported contract or order during all hours, including telework hours charged to the Government against the contract or order.

a. The Government has determined that the tasks required to be performed in support of this contract or order ☒ can be met ☐ cannot be met via routine full or part time teleworking. Unless prohibited by the contract or order, the Contractor is authorized to allow its employees to telework. This authorization is subject to revocation if the contractor fails to ensure successful employee performance while teleworking.

b. In addition to remedies provided in FAR Part 45, telework authorization is also subject to revocation if the government determines that government property or government information is misused or unprotected or potentially misused or unprotected. If government facilities are unavailable and telework for one or more contractor employees is not authorized by the contractor, the contractor must submit a proposed solution for continued successful contract or order performance to the Contracting Officer. Proposed solutions must clearly identify and detail any impacts to price, schedule and performance.

C.11.0Breaches and Credit Monitoring
C.11.1The Contractor must report ALL incidents involving PII breaches according to notification requirements for data classification to the Contracting Officer and the Contracting Officers Representative within one (1) hour of the initial discovery security. The Contractor is required to provide formal notification and credit monitoring for all affected SBA customers for a period of one year, at no cost to the government, in the event of an IT security breach associated with the Contractor’s IT system(s), irrespective of the root cause(s) of the IT security breach.

C.11.2 Impacted Individual: is defined as an individual who is impacted by a data breach who may or may not redeem provided identity protection services.

C.12.0 Hours of Operation Contractor personnel must be available and perform the services detailed in this PWS between the hours of 6:00am and 6:00pm local time Monday through Friday. The Contractor is not responsible to be available or for performing these services on Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government is not closed. When hiring personnel, the Contractor must keep in mind that the stability and continuity of the work force are essential.

C.13.0 Federal Holidays SBA observes the Federal holidays that are listed below and on the Office of Personnel Management website at https://www.opm.gov/policy-data-oversight/pay-leave/pay- administration/factsheets/holidays-work-schedules-and-pay/. Except as specified by the CO, services must not be required on the following Federal holidays:

New Year’s Day, January 1 Inauguration Day (Washington, DC only), January 20 Martin Luther King’s Birthday, third Monday in January President’s Day, third Monday in February Memorial Day, last Monday in May Juneteenth, June 19 Independence Day, July 4 Labor Day, first Monday in September Columbus Day, second Monday in October Veterans’ Day, November 11 Thanksgiving Day, fourth Thursday in November Christmas Day, December 25 Holidays falling on Saturdays are observed the Friday preceding the holiday, while those falling on Sundays are observed on the Monday following the holiday. Holidays must also include any additional day(s) granted by executive order.

C.14.0 Excluded Functions and Responsibilities Functions and responsibilities directly involved or associated with the management of any SBA Office are expressly excluded from this contract or order issued hereunder. The parties hereby agree that any instructions, directives, or orders issued under this contract involving such management functions and responsibilities shall be null and void. The following activities are representative of the excluded functions and responsibilities that cannot be provided by the Vendor under this contract or order issued hereunder:

a)Policy making
b)Technical management of Government contracts.
c)Government purchasing, contracting, contract administration, acceptance of materials and/or performance, and payment and accounting.
d)Direction or supervision of other Government contracts or Government agencies, or otherwise acting as an agent to obligate or commit the Government in any capacity.
e)Clerical and other administrative type functions required to be performed by civil service personnel; and
f)Supervision of Government employees

C.15.0 transition In plan The transition plan is a comprehensive document that outlines the specific steps, timelines, and dependencies involved in the transition process. It is designed to ensure a smooth and efficient transition from the current state to the desired future state. To achieve this, the plan breaks down the entire process allowing for focused implementation and resource allocation. Throughout the plan, careful consideration is given to potential bottlenecks that may arise and appropriate contingencies are devised to minimize downtime and disruptions.

Deliverables: The Contractor must provide a transition in plan to Contracting Officer and COR. This plan must address the Contractor’s plan for minimizing impact such that continuity of services will be maintained without disruption. The Contractor must describe how it will achieve full staff support levels within 15 days of award of the IDIQ. A transition-in plan may be identified at the Task Order level. The final IDIQ Transition In Plan must be provided electronically within two (2) business days after award.

C.16.0 transition out plan In accordance with FAR clause 52.237-3, the Contractor recognizes that the services under this IDIQ /order are vital to the Government and must be continued without interruption, and that, upon IDIQ/order expiration, a successor may continue the effort. The Contractor agrees to furnish transition-in-training, and to exercise its best efforts and cooperation to affect an orderly and efficient transition to a successor.

The plan must address but not limited to:

1) The Contractor’s plan for minimizing impact such that continuity of services will be maintained without disruption,

2) The return, delivery, or destruction of SBA proprietary and non-proprietary data and other non-licensed data first created for this IDIQ and the respective Task Orders and Government furnished equipment,

3) The delivery of all documentation created under the IDIQ and respective Task Orders, including the delivery of all reports and performance metric, and

4) How the Contractor will transition work to a successor, if necessary.

The Contractor must negotiate in good faith a plan with a successor to determine the nature and extent of phase-in and phase-out services required. The plan must cover all facets of the Contractor’s requirements under the expired IDIQ/task orders, including the identification and utilization of all system software, code, data, procedures, policies, and protocols developed. The plan must be in a written format.

The plan must also specify a training program for employees of the new contractor and a timeline for transferring responsibilities for each task described in the plan. The timeline included in the plan must be subject to the approval of the COR prior to full implementation.

The Contractor must be required to provide sufficient experienced personnel during the transition-in, transition-out period to ensure that the services called for by this contract/order are maintained at the required level of acceptance as detailed in the IDIQ/order.

The Contractor must provide a transition out plan to the Contracting Officer and COR. The final plan must be provided electronically within 90 days before the expiration of the IDIQ and respective Task Orders.

C.17.0 Reporting Reporting must be as specified under the individual IDIQ Task Orders. Contractor must furnish reports via email to the Contracting Officer’s Representative (COR) or authorized Government representative.

1. The Contractor and its employees must only conduct business covered by this contract/order during periods paid for by the Government and must not conduct any other business on government premises or government time. The Contractor must not use government time, equipment, materials except for the express purpose of providing government support.

2. Personnel assigned by the Contractor to work on this contract/order must meet or exceed contract/order qualifications and must be acceptable to the Government in terms of personal and professional conduct. Contractor management must provide sufficient oversight and supervision to ensure direct and subcontracted employees fulfill their technical and all other responsibilities and do so ethically.

3. It is understood that any personnel assigned by the Contractor or subcontractor to the performance of the work hereunder, if in conflict with the best interests of the Government, must be immediately removed from the assigned position. The CO may elect to direct the retention of an individual on a task until a replacement has been approved, or reported, or until a transition has occurred.

4. Employment of qualified personnel and other staffing difficulties must not be justification…
