ADD: 1.1.2.9 Natural Gas Amenities: The existing natural gas utility system is not owned by the National Park Service. The contractor shall coordinate with the natural gas utility company to install new gas laterals to service the family housing units. Refer to RFP 01800-1.4 Civil for RFP requirements.
AMENDMENT ATTACHEMENT(s): General Decision No: NY20250003, Mod No. 09 dated 06/13/2025.
RFI Q&A Amendment 0002:
1. Amendment 0001, including RFI response 36, answers that award is based upon adequate funding but does not answer the period after award when Options may be exercised by the Government. The period after award to exercise options will have a significant impact on the bid price and needs to be provided. SF 1442, Block 13.d states the Government has 90 days for the Government acceptance of the Solicitation response from the Contractor. Please confirm this 90 days is for both the Base Items and the Option Items? If not, please provide the duration (number days) after award the Government has to exercise the Options?
Government’s response: See Task Order Announcement, pg. 23, III. BASIS OF AWARD, PRICE: “The order will consist of the Base Item and may include any single Option Item or combination of Option Items deemed to be in the Government’s best interest. Award will be made to the Contractor proposing the lowest total evaluated price. Price analysis will be used to determine fair and reasonable pricing.
The price shall be evaluated in accordance with 52.217-5 Evaluations of Options (July 1990).
Also see Task Order Announcement, page 23, under FAIR OPPORTUNITY SELECTION PROCESS. “In the event that one or more bid option items are not awarded under this task order, the government reserves the right to exercise the follow-on work exception to fair opportunity in accordance with FAR 16.505(b)(2)(C) in a later task order.”
2. In review of response to Amendment 0001, RFI 111 the response is different then the response provided in the previous Solicitation 70Z04724RPCNI0006 which provided direction and changed Specification section 01800, 1.1.2.2 to remove the requirement that sanitary sewer utility system to each family housing does NOT need to be metered. It is atypical for sanitary sewer utility service system to be meter at each family housing unit. Please confirm that Sanitary Sewer Services does NOT require metering for each family housing unit?
Government’s response: The Government does not concur that there is a change to the RFP requirements. The RFP uses the terms Building and Units. For example, RFP 01800-1.1 for the base says to 'Construct one (1) multiplex family housing building with four (4) Units'. The response to RFI# 111 ‘that individual units shall be metered’, that is both correct and consistent with the RFP. Nonetheless, each unit within the building shall have an individual sanitary sewer meter.
3. Amendment 0001 RFI responses 136, 141, 142, and 143 all unreasonably now define the term “related service activities, this should be viewed as minor incidental costs, but does not extend to the Contractor’s design costs, costs of meters, installation of mains, laterals or the established new services.” The reason for the allowances are to cover the unknown costs of the local utility service providers since they will NOT provide any pricing for their scope of work until post award and design progressed. We have attempted to obtain these costs but the local utility service providers continually refuse. We have assumed “related service activities” means all costs charged by the local utility service providers for the scope of work they perform. This includes natural gas, electrical, sanitary, telecom, and water. The allowances need to cover these unknown, unobtainable costs. Please consider revising the USCG RFI responses and allowing these costs to be part of the allowance that we assumed to be included under “related service activities”.
Government’s response: Bid per RFP.
4. RFI responses 136, 141, 142, 146 all reference “related service activities in accordance with Specification 01800, Paragraph 1.1.2 (Project Site)”. Please note that gas is not referenced in this specification section and that the gas utility provider, National Grid, will need to run all gas lines to the buildings, provide and connect to the meter. The Contractor performs work from meter into building.
Please add gas to the specification. Also, National Grid is adamant about not providing any cost for their scope of work until post award and our design and application is provided. Please acknowledge the gas utility provider scope is covered in the allowances provided on the Price Proposal Form since we cannot obtain the cost for the gas utility provider scope? We recommend increasing the allowances.
Government’s response: See Amendment 0002 language. The Amendment to RFP Specification 01800-1.1.2 intends to clarify that the Natural Gas utility fees and related services are inclusive to the existing $10,000 allocation. Note, there will not be an increase to the existing $10,000 allocation.
5. RFI responses 142 and 158 reference “related service activities in accordance with Specification 01800, Paragraph 1.1.2.4 (Electrical Distribution System)”. Please note the electrical utility provider's, Con-Ed, scope of work is to provide cabling from the existing transformer to the building meters and provide connections to the meters and transformers. The Contractor's scope of work is to provide the ductbank for Con-Ed's work and the meters. Also, Con-Ed is adamant about not providing any cost for their scope of work until post award and our design and application is provided. Please acknowledge the electrical utility provider scope is covered in the allowances provided on the Price Proposal Form since we cannot obtain the cost for the electrical utility provider scope? We recommend increasing the allowances.
6. In review of response to Amendment 0001, RFI 144 the demarcation location (connection points) for Telecommunications System (i.e. Telephone, and Internet Utilities) is still not provided for pricing. For pricing purposes, please confirm we are to assume demarcation is at the Limits of Disturbance for the project?
7. In review of response to Amendment 0001, RFI 145 and Specification 01800, 1.14, the Government still has not identified the location of the Coast Guard Police Department Office (Building 212). Please provide.
8. We identified that the Base Item Multiplex Building that includes ADA and non-ADA units do not fit in the designated location.
Amendment 0001, RFI responses 10 and 129 state the base building needs to stay where shown and alludes to the Contractor to redesign unit layouts possibly into a “L” configuration to make it work. We do not have time to redesign the Base Building, and our initial observations of an “L” configuration does not work. We recommend re-orienting the Base Item Multiplex Building with the RFP unit layouts to fit the RFP site. The existing transformer may need to be relocated, and we assume this work is not part of our scope per the RFP. Please confirm the Contractor has the design freedom to re-orient the base building location to fit in the required area?
Government’s response: Response is confirmed.
9. It is going to be extremely difficult to incorporate this significant amendment into our design-build proposal by 7/8/25. We have a 4 day week due to the holiday and many subcontractors are already challenged with the holiday and vacations and voicing concerns of not being able to bid. This gives us only 5 days to incorporate all this information into our design and get pricing over the holiday – this is unreasonable and exasperates the issue. Please reconsider extending the bid at least one week.
Government’s response: See Amendment 0002 language for Task Order Announcement.
