Questions and Answers:

1. Amendment 1 Q&A #9 answer states "This effort is Lowest Price Technically

Acceptable (LPTA). ---- Amendment 2 Q&A #2 answer states "This award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors." ---- Attc 1 states "proposals will be evaluated in accordance with FAR 15.304" - FAR 15.304 states "Unless the exception at paragraph (c)(1)(ii)(A) of this section applies, the solicitation shall also state, at a minimum, whether all evaluation factors other than cost or price, when combined, are—

(1) Significantly more important than cost or price;

(2) Approximately equal to cost or price; or

(3) Significantly less important than cost or price.

Will the Government amend the solicitation (Terms and Conditions) to state the factors specifically called out in FAR 15.304?

a. Per FAR 15.304, non-price factors are approximately equal to cost or price.

Changes to the Terms and Conditions have been made as part of Amendment A0003. Please see UPDATED Attachment 1.

2. The Schedule Of Services Line 54 Item CLIN 0017 regarding Site Supervisor, ask for a rate quote. Is this to be billed to Government vs bidders Over Head?

a. Will be billed to over head.

3. Can you please confirm/clarify the effective dates for the provided rates? The header of the 3rd column lists "lxAdj Effective 12/19/2023" and the header of the 4th column lists "6%-Effective 12/19/2023" . Both columns have the same effective date but different rates.

a. The effective date is correct for both columns. The Government will use the

“6% Effective 12/19/2023” column for this requirement.

4. The answer to Q&A # 13 provided clarification on the input for the night shift categories. For clarification can you confirm the overtime categories should be the full rate and not the difference from the regular rate to the overtime rate? Furthermore, can you confirm the Overtime nightshift is the difference from the Overtime rate and the Overtime nightshift and not the actual Overtime Nightshift rate?

a. For the Overtime rate categories, the Government is looking for the full rate.

For the Overtime Night Differential categories, the Government is only looking for the increase in the rate compared to the Overtime proposed rate.

Offerors are not to input the full Overtime Night Differential rate, but the difference between the Overtime rate and Overtime Night Differential rate.

5. Is there any other required equipment that needs to be furnished by the contractor outside of the gas detection equipment (e.g. PAPR's, etc.) that is not provided by the government?

a. Offeror will furnish all needed respirators for the painters which may include a hood for supplied air, sheet metal PAPR helmets, and organic vapor respirators for brushing primer.

6. Attachment 1 states resumes should be provided to determine key personnel meet the qualifications of the SOW.

Please confirm offerors are required to submit key personnel resumes at the time of proposal submission as part of our Technical Acceptability response. If so, please update the language in Attachment 1 - Terms and Conditions to state key personnel resumes shall be provided.

a. Resumes shall be provided for all key personnel.

7. Please confirm how the Government intends to evaluate resumes to determine acceptability.

a. All resumes will be evaluated based on their qualifications to meet the criteria set forth in Section “3.0 Requirements” and Section “4.0 Positions” of the Statement of Work.

Request the USG disclose these items to facilitate bidder's assessment of performance risk, or put a CLIN(s) with a plug number(s) to standardize evaluation of offeror proposals.

a. This requirement will not have any Firm Fixed Price (FFP) line items. Changes to the Terms and Conditions have been made as part of Amendment A0003.

Please see UPDATED Attachment 1.

Please confirm whether the Government expects offerors to propose travel. If so, will the Government provide detailed travel requirements or a plug number for the Travel

14. FAR 52.222-41 Service Contract Labor Standards (SCLS) applies but the government has not marked to adopt 52.222-55 Minimum Wages Under Executive Order 14026.in attachment 1. The government has included the full clause but not marked the reference on page 34. Will the government adopt 52.222-55 into the contract and update the reference from EO 13658 to 14026?

a. The Government included a DHS class deviation version of the clause, beginning on page 44 of the Terms and Conditions, as required by DHS Class Deviation 24-02. That is what applies to this requirement, not the standard version of the clause.
