FAR 52.212-2 Evaluation – Commercial Products and Commercial Services NOV 2021
The provision at FAR 52.212-2 Evaluation of Commercial Items is not applicable to this solicitation. In lieu of this provision, proposals will be evaluated in accordance with FAR 15.304 based on the criteria listed below. The Government will award one contract resulting from this solicitation to the responsible mailto:Steven.A.Goodwin@uscg.mil mailto:Steven.A.Goodwin@uscg.mil mailto:Monique.H.Swinson@uscg.mil offeror whose offer, conforming to the solicitation and the Statement of Work (SOW) will be most advantageous to the Government. Evaluation of proposals will be based on the following factors. Non-price factors are approximately equal to cost or price. (A0003)
Price
• Submission Requirements: Price proposals shall be evaluated for the following:
Evaluation for Completeness – The Contract Specialist will review the proposal to verify pricing was provided for the base and all subsequent option periods.
Fair and Reasonableness – It is expected that adequate price competition will be obtained. Prices will be determined fair and reasonable based on competition and comparison to the Independent
Government Cost Estimate. Total price evaluation will be for the base and all option periods.
Failure to propose pricing for the base period and all respective option periods on individual line items may result in a proposal being excluded from further consideration. Offerors pricing will be evaluated by using the proposed hourly rates multiplied by the estimated hours for the base period and each option period. There will be a few Firm-Fixed price line items that will also be added in the total of each performance period. This Firm Fixed Price (FFP) statement has been removed. This requirement will not have any FFP line items. (A0003).
• Minimum Requirement: Offerors will be required to submit a completed Schedule attached to the solicitation as an Excel spreadsheet. Failure to submit the price proposal using the
Excel document, including Base Year and all Option Years, may result in the proposal being removed from award consideration.
If needed, the Government intends to exercise the option or options under FAR 52.217-8 without further competition or need for justification for other than full and open competition [or limited source justification or sole source justification]. For purposes of evaluation, the potential need to exercise the option under FAR 52.217-8 to extend the period of contract performance for the maximum period of six (6) months beyond the last option period will be considered and evaluated the same for all offerors. In considering the price of the base period and any option periods, the Government will consider that if the extension of service clause (FAR 52.217-8) is exercised, it will be on the exact same rates and terms, other than length of performance, as the base or option period being extended and may only be adjusted as a result of revisions to prevailing labor rates provided by the Secretary of Labor for those positions not covered under the CBA. The
Government will determine whether the price, inclusive of all options (including the options available under FAR 52.217-8), is fair and reasonable.
Technical Acceptability
• Submission Requirements: Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. This will be determined by evaluating the ability of the offeror to provide an adequate proposal that meets all requirements listed in the Statement of
Work (SOW) and demonstrates a thorough knowledge and understanding of the requirements.
The offeror must provide the following minimum information and documentation with their quote:
• Minimum Requirements: Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable” based on the criteria set forth in this section. An acceptable rating means the proposal meets all requirements of the solicitation, while an unacceptable rating means the proposal does not meet any or some of the requirements of the solicitation. Tradeoffs will not be made, and no additional credit will be given for exceeding requirements. The Offeror’s Technical Volume shall convey to the Government that the offeror is capable, possess the adequate technical expertise and experience, possesses sufficient resources, and is able to plan, organize, and use those resources in a coordinated and timely fashion to meet the needs of the Government. The Technical Volume shall provide a detailed explanation of how the Contractor will accomplish the requirements of the SOW using its personnel. The Technical Volume shall not simply rephrase or restate the Government’s requirements. It is the Contractor’s responsibility to ensure that their proposal clearly demonstrates their ability to perform these requirements.
The offeror’s approach shall demonstrate the following to determine technical capability:
Sub Factor A – Management Approach
• The offeror shall provide a detailed explanation of their approach for managing a fully qualified and technically capable staff in performance of the SOW. The offeror shall describe their approach for directing and managing their personnel. This description should include items such as how work assignments will be communicated, work performance monitored, and sub-standard work corrected. The offeror shall include procedures for dealing with difficult situations that may arise, such as employee turnover and how those situations will be mitigated so degradation of performance does not occur. The description should include recruitment methods, retention incentives; leave management of the workforce, etc. The offeror shall provide a detailed explanation on how the On-Site Supervisor of the Contractor personnel will be managed, and the roles and responsibilities of the On-Site
Supervisor. These authority limits may include the ability to terminate employees or sign contractual modifications on behalf of the Contractor, etc. A simple statement of capabilities will not suffice. The offeror must address how they will accomplish the requirements of the SOW.
Sub Factor B – Staffing Approach
• The offeror shall provide a staffing plan that demonstrates to the Government that fully qualified personnel will be performing PDM support in accordance with (IAW) the SOW qualification requirements. Resumes and acceptance of contingent offers of employment for Key Personnel, including: Site Supervisor and the Program
Specialists (A0001) should be provided to determine these personnel meet the qualifications of the SOW. All resumes shall be available upon request for the
Government at any time before or after award.
• The offeror shall provide an explanation that demonstrates to the Government how they plan to recruit new personnel if needed, retain incumbent personnel, and minimize employee turnover. The offeror shall provide an explanation of how any additional personnel who may be required for any aircraft upgrades will be recruited and retained. This includes successes in recruitment and the methods used.
Past Performance
• Submission Requirements: To determine technical capability, the offeror’s Past Performance will be evaluated to determine if it is acceptable, unacceptable or neutral. A rating of unacceptable will determine the offeror as technically unacceptable. If an offeror has no past performance history, the offeror must affirmatively state that it possesses no past performance history. If an offeror possesses no relevant past performance, or if information is not available, the offeror will not be evaluated favorably or unfavorably and will receive a rating of neutral.
Attachment 7 – Past Performance Questionnaire shall be completed by each offeror and will be evaluated to determine if it’s acceptable or neutral. The Government may utilize information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s AMMIS system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval
System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS) to determine if the Contractor has acceptable or neutral Past Performance. The Government reserves the right to limit or expand the number of references it decides to contact.
• Minimum Requirements: Past performance will assess the offeror’s ability to fulfill the solicitation requirements. The evaluation will consider the offeror’s demonstrated record of relevant performance in performing the required services and will consider areas of quality, meeting delivery schedules, compliance with contractual requirements, and customer satisfaction.
