About this file
This is a Bid Questions and Answers document for Nevada Department of Environmental Protection (NDEP) Request for Proposals 70CNR-S3862, which solicits Permit Writing Assistance and Programmatic Support services across multiple environmental regulatory areas. The RFP was posted May 7, 2026, with proposals due June 11, 2026, and references require submission by June 8, 2026. The contract structure includes a two-year initial base period with two optional one-year extension periods. The contract encompasses ten primary task areas (Tasks A through J) covering permit writing assistance for air and water pollution control, compliance support, enforcement assistance, chemical accident prevention program support, small business assistance, technical training, and various programmatic support functions. Work assignments will be communicated to the contractor on a monthly or agreed-upon frequency basis, with anticipated volumes including up to 2 PSD permitting actions annually, 10 or fewer Class I air quality permits, 40 or fewer Class II air quality permits, 100 or fewer general/temporary determinations, and 1 to 3 water pollution control permits monthly depending on applications received.
The total anticipated contract value is $1,300,000 distributed equally at $650,000 annually across three budget accounts. Pricing for permitting-related tasks subject to Nevada Administrative Code 459.953475 is capped at $103 per hour plus 5 percent, with annual 2 percent increases beginning July 1, 2024 (reaching $105.06 plus 5 percent on July 1, 2025, and $107.16 plus 5 percent on July 1, 2026, unless suspended by the Director). The RFP does not currently utilize federal funds; however, future contract amendments may incorporate federal funding, at which point a compensation cap tied to the federal Executive Schedule Level IV rate of $88.22 per hour would apply. Vendors should submit cost proposals using the provided cost schedule or their own format with detailed rate structures for staff roles and task assignments. The RFP contains no identified set-asides for disadvantaged enterprises, does not restrict eligibility to specific organization types, and does not reference incumbent vendors. Insurance requirements include Commercial General Liability with $2,000,000 aggregate and $1,000,000 per-occurrence limits, Workers' Compensation at statutory limits, and Employers' Liability coverage through Nevada-licensed insurers with A.M. Best ratings of not less than A-VII.

| QUESTION_NBR | CREATED_BY | QUESTION SUBJECT | QUESTIONS | ANSWERS |
| 1 | BCANALES | SOW Section 7.1.1 states "Under NAC 459.953475.3., the Division accrues charges for activities related to the permitting of new processes conducted by contractors in an amount equal to the Division's cost (currently $103 per hour), plus 5 percent." Will contractors pricing be required to not exceed a rate of $103 plus 5% when completing tasks related to permitting of new processes? | The regulation (NAC 459.953475.4) states that "For the fiscal year beginning on July 1, 2024, and for each fiscal year thereafter, the Director shall increase each fee or charge set forth in subsection 2 and 3 (note this is the $103 per hour, plus 5%) by an amount that is equal to 2 percent of the fee or charge for the immediately preceding fiscal year. The Director may, during any fiscal year, suspend an increase in a fee or charge specified in this subsection." Therefore, the contract rate will not exceed the rate of $103 multiplied by 2% plus 5% each fiscal year beginning the preceeding fiscal year after July 1, 2024 when completing tasks related to permitting of a new process unless suspended by the director. Currently, the Director has not suspended the 2% increase for the previous years. If there is a suspended increase, this will be posted to our website. The rate on July 1, 2024 was $103 + 5%. The rate on July 1, 2025 was $105.06 + 5%. The rate on July 1, 2026 will be $107.16 + 5% if there are no increases suspended and so on for the following years. | |
| 2 | BCANALES | Specific to support provided under Section 7.1.1, does NDEP allow for permittees under its CAPP program to claim programmatic documentation as "Confidential Business Information?" Will respondents be expected and/or required to develop a plan subject to NDEP approval for handling documentation claimed as "Confidential Business Information?" | Yes, specific permittees may request and obtain approval on specific documents to be Confidential Business Information. Any documents that are sent to the contractor will not be confidential or the contractor will be provided procedures for handling this information. The contractor will be required work with NDEP prior to handling any of this information which may include developing a plan or an agreement before information is shared. | |
| 3 | BCANALES | Federal funds. NDEP Additional Terms & Conditions, Items 1 and 7 include conditions that apply to "contracts utilizing federal funds." Will this contract use federal funds? | The work identified in the scope of work will not be funded using federal funds; however if the contract is amended in the future federal funds may be used at that time. | |
| 4 | BCANALES | Upon completion of the initial two year base period, are contractors able to negotiate and provide escalated rates for the option years? | Cost changes can be negotiate in an updated Scope of Work if contract is ammended | |
| 5 | BCANALES | RFP section 5.1.7 mentions alternative scoring for the cost factor. An equation is provided based on the highest and lowest proposed costs provided. The Cost Schedule however provides pre-filled not to exceed values for the first two years of the contract. Can NDEP please explain how the ten points for the cost factor will be awarded? | The grading is based on the cost breakdown of deliverable that outline the expenses accociated with completing a project or task. | |
| 6 | BCANALES | Is the "cost proposal" mentioned in the RFP section 8 the same as the "cost schedule" form provided by NDEP? | Vendor's are encouraged to fill out the cost schedule attached, and vendor's can provide a cost proposal using their own standard format with consideration of tasks in Scope of Work | |
| 7 | BCANALES | Can NDEP confirm that the awardee of this solicitation will receive a subcontract and will not be a subrecipient held to grant recipient special reporting requirements. | The work specified in the scope of work is not funded using federal funds at this time; however if in the future the contract were to be amended and federal funds were to be used the awardee would not a subrecipient of the grant, but as a contractor. | |
| 8 | BCANALES | The Cost Schedule provides amounts, annual totals, and contract total by category. However, the Scope of Work does not provide specific details that would help bidders estimate relative effort across tasks (e.g., number of permits to be drafted each year, number of technical responses/guidance/ or trainings to be provided, etc). If the provided "cost schedule" and mentioned "cost proposal" are meant to be two separate documents, can NDEP provide clarification or guidance for how costs are anticipated to be built up by contractors between categories? Would it be more beneficial for contractors to simply provide a list of rates for staff members applicable to this solicitation? | The cost schedule reflects the maximum amount of funds by category for the contract, unless later amended. A list of rates for staff or roles and the number of staff that can be assigned for each task A through J. For tasks that cover more than one media type (i.e., air, water, waste) please specify how many staff can be assigned for each media type and their respective rates if they are different. | |
| 9 | KAUXIER@TEAMUES.COM | Estimated Backlog and Anticipated Annual Volume | Can NDEP provide estimates of the backlog and anticipated annual volume for AQOP/OPTC permits, NPDES permits, UIC permits, and compliance/enforcement tasks? How many permits are expected to be assigned monthly or quarterly per contractor? | For the Bureau of Air Pollution Control, the number of applications the contractor will be asked to complete may depend on the types of applications received and the priorities at the time. Currently, this is not known. This will be communicated with the contractor on a monthly or agreed upon frequency basis. This is expected to be 2 or less/year PSD permitting actions, 10 or less/year Class I AQOP/OPTC (non PSD) permitting actions, 40 or less/year Class 2 AQOP permitting actions, and 100 or less/year General/Temporary/SADs/applicability determinations. As each type of application may be more or less complex, this would be taken into account for the number of applications requested for assistance. For the Bureau of Air Quality Planning with Air enforcement, it would be the one-time project as identified in sections 6.1.1 through 6.1.3. Development of the PSD increment area source inventory referenced in row 6 of Table 1, Task B is anticipated to be 0-1 time per year. For the Bureau of Water Pollution Control, the number of permit application for UIC and NPDES assigned each month will depend on the number of permit applctions submitted but is anitcpated to be between 1 and 3. Compliance tasks such as inspection support will be 2 or less per year. |
| 10 | KAUXIER@TEAMUES.COM | Compensation Cap | The Terms & Conditions reference a compensation cap tied to the federal Executive Schedule Level IV rate of $88.22/hour. Can NDEP clarify how this limitation will be applied to contractor billing rates? | This contract will not be using federal funds for the tasks described in the scope of work, so it would not be applicable at this point in time; however it is possible that if the contract were to be amended in the future that some work may be funded using federal funds. The application of this limitation would be consistent with applicable state and federal law and regulations, grant specific terms and conditions. |
| 11 | KAUXIER@TEAMUES.COM | NDEP Credentials | For inspection, compliance, and source test observation activities, will contractor personnel be issued NDEP credentials, and what authority will contractor staff have when representing NDEP during these activities? | For the Bureau of Air Pollution Control, if assistance with an inspection or source test observation is necessary, the contractor will be joining another NDEP staff member during an inspection and provide drafts of documents to NDEP staff members for final approval from NDEP staff members. If credentials are required during an activity and NDEP agrees, NDEP and the contractor will verify and provide authorization before the activity. The Bureau of Water Pollution Control will use a similar process to the Bureau of Air Pollution Control. |
| 12 | KAUXIER@TEAMUES.COM | Work Assignments | How will work be assigned to selected contractors, and will contractors have the ability to decline or defer specific assignments due to potential conflicts of interest or workload constraints? | Work will be assigned to selected contractor by the appropriate NDEP management and/or supervisors for the particular work area. Contractors are expected to notify the designated NDEP management of any potential conflicts of interest prior to completing work on the assigned project. The designated NDEP management for the project area will determine if the project needs to be reassigned. Contractors are expected to provide advance notice to the appropriate NDEP management and/or supervisors of reasonably foreseeable constraints on workload and promptly notify NDEP management and supervisors of unforseeable constraints. Contractors are expected to consult with appropriate NDEP management and/or supervisors prior to reassgining projects for workload balacing. Contractors are also expected to ensure appropriate work materials and other relevant information is provided to appropriate people in a timely manner as part of the handoff of a reassigned project, and that all appropriate parties are notified of the reassignment of the project. To the extent practicable, projects that have been started should not be reassigned for workload management purposes. |
