11. CM/GC Work Phases
The CM/GC Work for the project consists of two phases: Preconstruction Phase Services and Construction Phase Services.
A. Preconstruction Phase Services. Preconstruction Phase Services are described in detail in Section 3.1 of the CMGC Agreement. Generally, this phase of the Work includes but is not limited to attending design meetings, estimating and cost control, schedule development, material and or equipment availability / lead times, and drawing and constructability reviews.
The Contractor shall assist the University, the User Group and A/E in maintaining the cost of construction within the Fixed Contract Price Limit and the duration of the construction within the Target Project Substantial Completion Date. The Contractor will be expected to provide in depth, accurate, and timely cost data for a rigorous life-cycle cost assessment, as required by the University’s Design Requirements, and the High-Performance Building Standard, Section 5.5.
This process began during programming and early schematic design phases of the project and the Contractor will be expected to review and verify the program and existing cost estimates for accuracy. This information will be coordinated with the University’s contracted energy modeling engineer, the University facilities staff, and the A/E to provide an accurate accounting of the upfront and replacement costs for various building systems and equipment, including but not limited to mechanical equipment, electrical equipment and building enclosure systems. Please note that the cost data needed will not be limited to energy performance equipment, it may also include data on various other building systems.
These costs will be provided based on programmatic level narratives and be revised as the design develops through the remaining design phases. This information will be used to help the project steering committee make an informed decision on the most lifecycle cost effective building systems and therefore needs to be as accurate as possible.
As part of the Preconstruction Phase, the Contractor will also provide ongoing review of the design documents for completeness and accuracy at each of the major design milestones and for constructability, clash detection, design errors and omissions. Any discovered error or omission will be tracked by the Contractor with the A/E until said issue is resolved. Any unresolved issues at the end of CD drawings will be reported to the University project manager. The Contractor will not be allowed markup on any such issue related change order during the Construction Phase of the project as a result of the aforementioned items.

The Contractor’s Preconstruction Phase Services Fee is to be bid by Contractor and is included in the Fixed Contract Price Limit, but not in the Adjusted Fixed Contract Price Limit.
Target Value Delivery (TVD), cluster groups, pull planning and preparation of A-3s will be required during the Preconstruction Phase. It is imperative that the Contractor enforce design based on the budget at all times. The Contractor will be required to provide live estimates that reflect the latest design decisions throughout design.
A constructability review process and deliverable will be required at each design phase. The format and function will be determined by the University and the User Group. The metrics and goals for this shall be to eliminate errors and omissions, reduce RFIs and streamline the build process.
It is vital that the Contractor communicate in writing any and all such noted issues with the University Project Manager immediately.
B. Construction Phase Services. Construction Phase Services are set forth in detail in section 3.2 of the CMGC Agreement. This phase of the Work consists of the Contractor furnishing and installing all Work as required in the Contract Documents. Please note that the Work of the Construction Phase may be bid in several packages, such as excavation, footings and foundations, structural steel, etc.
12. Fixed Contract Price Limit, Adjusted Fixed Contract Price Limit, and Guaranteed Maximum
Contract Price
A. Fixed Contract Price Limit (FCPL). The Fixed Contract Price Limit is the project’s construction budget as listed in the Notice to Contractors within this RFP’s Description of Work section. The University, the A/E and the Contractor shall work together to keep the cost of the project as represented in the design within the Fixed Contract Price Limit. (Cost Proposal and CMGC Agreement Item 1.1).
B. Adjusted Fixed Contract Price Limit (AFCPL). The Adjusted Fixed Contract Price Limit is the FCPL less the Contractor’s Preconstruction Phase Services Fee. (Cost Proposal and CMGC Agreement Item 1.3).
C. Guaranteed Maximum Contract Price (GMCP). The Guaranteed Maximum Contract Price is the final Contract Price that the Contractor agrees to accept in full performance of the Construction Phase established as provided in Section 3.1.8 of the CMGC Agreement.
Please note that since the Work may be completed in project phases and bid packages, the successful Contractor may be required to submit Bid Package Cost(s), as defined in the CMGC Agreement, for each of the phases and packages of the Work. The sum or total of all of the Bid Package Costs must be within the GMCP.
13. Cost Proposal, Fees, and Markups
Before submitting a Cost Proposal, each Contractor shall carefully examine the RFP documents, shall visit the site of the Work, shall fully inform themselves as to all existing conditions and limitations, and shall include in the Cost Proposal the cost of all items required by the RFP. If the Contractor observes that the RFP documents are at variance with applicable laws, building codes, rules, regulations or contain obvious erroneous or uncoordinated information, the Contractor shall promptly notify the University Representative and the https://pdc.utah.edu/contractors/ https://pdc.utah.edu/contractors/
