ii. If the repaired and/or replaced product proves to be inadequate, or fails of its essential purpose, the Contractor will refund the full amount of any payments that have been made.
Nothing in this warranty shall be construed to limit any rights or remedies SNOW COLLEGE may otherwise have under the Contract or law. In addition, SNOW COLLEGE shall be entitled to the greater of the rights contained in this section or any warranty offered by Contractor or the manufacturer, including a warranty period of greater than one (1) year.
17. ACCESSIBILITY: Contactor represents and warrants that deliverables comply with Web Content Accessibility Guidelines (WCAG) Version 2.0 Level AA (or the most current version). If SNOW COLLEGE’s use of the Services is enjoined in connection with the Claim, Contractor may choose to either modify the Services to be non-infringing (while substantially preserving its utility and functionality), obtain a license to allow for continued use of the Services or Contractor may terminate this Agreement and refund any prepaid fees for unused Services. Contractor will have no indemnification obligation for any Claim to the extent the Claim arises from or is based upon the use of the Services in an unlawful or unauthorized manner. The provisions of this section state the sole, exclusive and entire liability of Contractor to SNOW COLLEGE with respect to any Claim described in this section.
