About this file

This is a Litigation History disclosure form for vendors bidding on the Highway Bridge Maintenance Division (HBMD) Administration Building Expansion and Renovation project in Florida. The form requires vendors to disclose all "material" legal cases from the past three years involving the vendor, its parent companies, subsidiaries, predecessors, or principals, where material cases include those related to similar work, fraud allegations, contract defaults, financial difficulties, or criminal business-related proceedings. Vendors must also disclose any litigation between the County and proposed subcontractors within the last five years, with completed forms required either with the initial submittal or within three business days of the County's request.

The County will consider litigation history information when determining vendor responsibility, and failure to fully disclose material cases may result in the vendor being deemed non-responsive. For joint ventures, disclosure requirements encompass all entities forming the venture. The form includes fields for case details such as case numbers, court names, disposition status, and opposing counsel information, with vendors required to attach copies of judgments, settlement agreements, and satisfaction documents. Confidential portions of settlement agreements may only be redacted if required under pre-existing confidentiality provisions, with vendor certification required for such redactions.
