About this file

This document is a Deviations or Exceptions to Sample Services Agreement form from the Incorporated County of Los Alamos Procurement Division, located at 101 Camino Entrada, Building 3, in Los Alamos, New Mexico. The form is designed for potential bidders to either certify that they have no deviations from the County's standard services agreement terms and conditions, or to formally submit any proposed exceptions for the County's consideration. The document provides detailed instructions for bidders who wish to propose modifications, requiring them to cite original language, suggest alternative language, and potentially include additional standard contractual terms or governing documents.

The form emphasizes that while the County may consider proposed deviations, it is under no obligation to accept them. Bidders are advised that any deviation from specifications not specifically addressed and accepted by the County may result in bid rejection. The document stresses the importance of noting all deviations in writing at the time of bid submission, with the understanding that without a written list of specification deviations, the bidder will be held strictly accountable to the original terms and conditions as written.

SAMPLE SERVICES AGREEMENT

Incorporated County of Los Alamos Procurement Division

Solicitation No.:

Solicitation Title:

Select one option below.

I certify that I have read and understand the County’s terms and conditions stated in the Sample Services Agreement provided and have no deviations or exceptions to submit.

Having read the Sample Services Agreement provided by the County, the following deviations and exceptions to the terms and conditions are hereby submitted for County’s consideration. I understand that the County may consider, but is under no obligation to accept, any of an Offeror’s contractual terms or provisions included in an Bidder’s Bid.

Instructions Bidder must cite the original language from the County’s standard terms and suggested language for any deviations or exceptions. Bidders should also provide with their Bid any of their own standard contractual terms or provisions the County will be asked to consider if Bidder is selected for award. This may include, but is not limited to, such things as a sample Master Services Agreement or Licensing Agreement and any additional governing documents referenced within those sample standard agreements. The inclusion of additional agreements alone will not be considered by the County to be a sufficient submission of deviations or exceptions. All deviations from the specifications, including but not limited to limitations of liability, must be noted in detail by the Bidder, in writing, at the time of submittal of the Bid. In the absence of a written list of specification deviations at the time of submittal of the Bid, the Bidder shall be held strictly accountable for the terms and conditions as written. Any deviation from the specifications as written, not specifically addressed in a Bidders submission and accepted by the County, may be grounds for rejection of the Bid. Bidders must note if their own standard contractual terms or provisions conflict with those provisions provided in the County’s Sample Services Agreement. If more room is needed, Bidders may submit additional pages with their Bids.
