About this file
This is a prerequisites and compliance document for the Utah Transit Authority (UTA) North Temple Escalator Design project solicitation. The document outlines mandatory certifications and requirements that bidders must satisfy prior to proposal submission and contract execution. Bidders must certify completion of nine key prerequisites, including submission of a W9 form, acknowledgment of UTA tax-exempt construction terms, agreement to conduct all questions through the Bonfire Q&A system, and compliance with qualified health insurance coverage requirements under Utah Code 17B-2a-818.5. The document specifies that design contracts with a prime contract value of $2,000,000 or greater, and subcontracts valued at $1,000,000 or greater, must comply with all stated health insurance provisions, including those applicable to change orders.
Prior to contract execution, all contractors and design consultants must provide separate written statements of actuarial equivalency (not more than one year old) from the Utah Insurance Department, a qualified actuary, or an underwriter demonstrating that qualified health insurance coverage meeting UCA 17B-2a-818.5 and UCA 26-40-115(1)(a) requirements will be provided to all employees and dependents. Contractors must also submit a signed Certificate of Compliance on the prescribed form, maintaining health insurance throughout the contract duration and ensuring all applicable subcontractors comply with the same requirements. Non-compliance renders a bid non-responsive. Penalties for intentional violations include three-month suspension for the first violation, six-month suspension for the second violation, potential disbarment proceedings for subsequent violations, and monetary penalties up to 50% of the cost of qualified health insurance coverage for non-compliant employees.

In the 2009 legislative general session a law was passed that requires that all construction contractors and design consultants (and their subcontractors) who enter into UTA design or construction contracts over designated contract/subcontract thresholds must comply with the qualified health insurance coverage requirement outlined in Utah Code Ann. (UCA) §17B-2a-818.5. In the 2016 legislative general session the law was revised to raise the threshold contract and subcontract thresholds.
