About this file
This is a Questions and Answers document for a Federal Highway Administration (FHWA) construction contract opportunity for NV FLAP NYE 10(1) Bob Ruud Memorial Highway & Bell Vista Avenue project in Nevada. The document contains clarifications issued during the advertisement period from May 4 through June 1, 2026, addressing contractor inquiries regarding bid requirements, project specifications, and implementation details.
Key clarifications include: Amendment A001 will address bid schedule extensions, hydraulic mulching requirements, and clearing and grubbing phasing constraints. Amendment A003 clarifies temporary barrier rail placement for the 8-foot widening section. Amendment A004 addresses pre-milling requirements for asphalt overlay work to achieve specified ride quality. The contract does not permit Hveem JMF submissions, use of off-site permanent laboratory facilities (contractors must use mobile field laboratories per Subsection 154.04B), herbicide use for noxious weed control, pre-NTP NDOT Temporary Occupancy Permit procurement, force account bid items for weed management plan implementation, or contractor opt-out from asphalt oil escalator/de-escalator clauses. The anticipated award will be issued within 60 days of bid opening pending available funds, with Notice to Proceed (NTP) issued after acceptable performance and payment bonds are received. The project requires compliance with specified material gradations, pay factor determinations per Subsection 106.05, QCM and testing personnel requirements per Section 153, and permitting per Section 107. No formal site visit was conducted. Physical data files are available in SAM.gov Attachments section.

Questions and Answers during Advertisement for NV FLAP NYE 10(1) Bob Ruud Mem Hwy & Bell Vista Ave
May 4, 2026
Questions Answers 1 At the Contractor’s option, will you allow a Hveem JMF to be submitted in accordance with Section 402?
No
2 After review of the bid documents, the time allowed to bid this job is not enough time based on 6/2/26 bid date. An industry standard for this jobs’ scope & size would be six weeks. Can you please push the bid date (to 6/11/26) to allow more time to bid this project?
Amendment A001 will address this

1 There are two bid items for hydraulic seeding; A0630 and
B0690. These two bid items total 94 acres. This environment needs to have hydraulic mulching to get successful seed establishment. Will hydraulic mulching be added to the bid schedule? (We recommend adding per 625.08 (b) Bonded Fiber Matrix.)
Amendment A001 will address this
2 Can you please let us know the anticipated NTP for the project so we can review the completion dates in the SCR’s more thoroughly against the NTP?
The contractor may expect an award to be issued within 60 days of bid opening, assuming funds are available. A NTP will be issued within a reasonable amount of time after acceptable performance and payment bonds are received.
3 Page E-12 of the SCR’s, 107.10(c), second paragraph, the contractor can bid to develop the weed management plan pre-bid and put those costs into the bid, but the costs to follow the plan cannot be bid until the plan is developed. Can you please add a force account bid item for this item to follow the plan once developed? We have no way to bid something we have no information on.
No. A site investigation is recommended – see FAR clause 52.236-3.
4 107.01, NDOT Temporary Occupancy Permit, can FHWA get this permit prior to NTP? This is a time-consuming permit and will only delay the start of the project waiting until NTP to get this permit. It could also affect the completion date depending on when this permit is actually procured.
No
5 Can you please review (Page E-38) to eliminate that only 5-acres of clearing & grubbing at a time can be done? With your completion dates, we need to be able to work on the entire project at one time not break it into 5-acres phases. Can you please clarify more on this one if it cannot be eliminated?
Amendment A001 will address this
6 Can you please let us know how we can access these files as stated in Section 102.02A Physical data.
All the files have been uploaded in the Attachment section in SAM.gov.

1 If the contractor furnished field laboratory option is exercised, may we use our permanent materials laboratory facility in lieu of a mobile field laboratory? Our materials laboratory is located in Las Vegas, Nevada, approximately 50 miles from the project site.
Please let me know if this would be an acceptable substitution.
See Subsection 154.04B

1 At Station 718+85, there is a staging area with a Nye County sign, can this be used for staging? According to Nye County, they have given FHWA permission to use it for this project.
See Subsection 105.04 FP-14.
2 You have a traffic control bid item for temporary barrier rail for 2,500’. Can you explain where you intend for this to be used? It shows from 564 to 1382, but what about from 303+60 to 564 where you have the 8’ widening with a 15” drop off once to subgrade? Will you require this 5-miles +/- to have temporary barrier rail?
See Subsection 635.04 FP-14 and Section 156

1 After reviewing Section 304.03 & 304.05 in the SCR’s, what is the reason for hauling the pulverized material offsite then bringing it back? After pulverizing, it should remain inplace while doing widenings & reconstruct then moving it as needed to locations it is required. You seem to indicate that it needs to be hauled off &
A0002 – Remove Section 304 stored then brought back. Can you explain more on this item so we know what you are looking at and for?
2 Will you consider using new precast barrier rails in lieu of CIP cut off walls at the three 601 locations?
Bid as shown in plans

1 Is the 350 ft desert tortoise buffer for preconstruction and clearance surveys, or is the 350 ft buffer for preconstruction and the immediate disturbance area is for clearance?
Refer to Sub-section 107.10
2 The solicitation says the Noxious Weed Management Plan shall include applicator certification. The Biological Opinion says that herbicides will not be used in the work area. Can herbicides be used as an eradication/control method for noxious weeds?
No
3 Are there water and power connections available in close proximity to the field office location?
Refer to Section 637.

Refer to material gradations described in Plans, SCR’s, and FP-14
9 If the proposed gradation values are found to differ from materials typically used locally for highway construction and maintenance by Federal or state agencies, would FHWA consider using a state DOT’s gradation instead?
Refer to material gradations described in Plans, SCR’s, and FP-14
10 Does the QCM and Tester have to be 2 separate individuals? Refer to Section 153 of FP-14 and SCR’s 11 Can we shut down the road for the duration of construction? Refer to Sections 108 and 156 of FP-14 and SCR’s 12 Please provide the site visit attendee sign in sheet. A formal site visit was not conducted. There is no attendee sign-in sheet.

Refer to Section 105 of FP-14 and SCR’s
19 Please provide staking data points for the project. Refer to Section 102 of FP-14 and SCR’s for provided physical data 20 Are red, yellow, and blue tops required? Reder to Section 152 of FP-14 and SCR’s 21 Question No. 3 dated 5/5/26: a site investigation will not work to establish bid costs to manage a weed management plan. A weed management plan by a certified company has to be done prior to developing costs to bid with depending on what is onsite. A weed management plan is a costly plan that needs to be done after award to establish costs or by FHWA pre-bid so we can bid from the plan. Will you please look at adding a force account bid item for this work otherwise it cannot be bid until the weed management plan is completed?
No. Bid as specified.
23 Question No. 1, dated 5/15/26: Subsection 105.05 FP-14 does not answer the question asked. Nye County has told us via phone call they gave FHWA permission to use their staging area at 718+85 for staging equipment & materials only.
Can you please confirm this will be ok to use?
There is no approved staging area. The response has been revised.
24 Question No. 2, dated 5/15/26: the subsection and section does not answer the question as to where this barrier rail is to be used. It appears to be very short based on the length of drop off in the 8’ widening area, can you please clarify?
See Amendment A003.
