About this file
This document is Amendment 0003 to solicitation 697DCK-25-R-00096 for Fire Life Safety Maintenance and Testing services at three FAA facilities in Colorado: Denver ATCT/Base Building, Denver TRACON, and Rocky Mountain Metropolitan ATCT/Base Building. The amendment incorporates site visit sign-in sheets and a Q&A document, with drawings and inspection reports to be posted separately on SAM.gov.
The Q&A portion covers 65 detailed questions about system specifications, testing requirements, and contract terms. Key clarifications include: this is a SDVOSB set-aside following AMS (not FAR) regulations; the current incumbent is under contract 697DCK-20-C-00102; quarterly inspections are required following NFPA 25 and 72 standards; fire extinguishers are not included in the scope; five-year inspections must be completed in the base year (2025); and fire pump weekly tests are conducted by FAA personnel while other testing requirements fall to the contractor. The contract period of performance is April 1, 2025 to March 31, 2030. Two site visits were conducted - one on January 9, 2025 for D01 and DEN facilities, and another on January 16, 2025 for the BJC facility.

Ques ons & Answers – 697DCK-25-R-00096
1. [3.6.1-7] LIMITATIONS ON SUBCONTRACTING (JUL 2021)
(a) Definition - "Similarly situated entity", as used in the clause, means a first-tier subcontractor, including an independent contractor, that has the same small business program status as that which qualified the prime contractor for the award; and is considered small for the NAICS code the prime contractor assigned to the subcontract the subcontractor will perform.
(b) By submission of an offer and execution of a contract, the Offeror/Contractor agrees that in the case of a contract for:
(1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel must be expended for employees of the prime contractor or a similarly situated entity.
(2) Supplies (other than procurements from a nonmanufacturer of such supplies). The prime contractor or a similarly situated entity must perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials.
(3) General construction. The prime contractor or a similarly situated entity must perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees.
(4) Construction by special trade contractors. The prime contractor or a similarly situated entity must perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees.
(c) A joint venture agrees that in performance of the contract, the applicable percentage specified in paragraph (b) of this clause will be performed by the aggregate of the joint venture participants or a similarly situated entity.
END
I have never heard of this before. I am aware of the below;
1. 852.219-14 Limitations on Subcontracting
2. FAR 19.505 Limitations on subcontracting and nonmanufacturer rule
3. VA Notice of Limitations on Subcontracting - Certificate of Compliance for Services and Construction. Jan 2023 Is this statement saying we must be in Colorado to perform work? If this is the case, we cannot meet this requirement Mrs. Davis. We are based out of Florida and have partners in Colorado.
Please let me know if this is your requirement.
- This solicitation is set-aside for total SDVOSB so per the AMS, this clause is required. This procurement is for
Services though, not Supplies.
2. In 16 - 697DCK-25-R-00096 pages 69,71 and 77 Customer Satisfaction Survey I have a quick question regarding the requirement. We are a new start up working on solicitations at the moment.
We currently are still in the process of acquiring a past performance. Our subcontracts, however, do have a past performance.
The request for our company reaching out to customers to fill out this document and send to your officer doesn't seem feasible. With this requirement being in the hands of those who are on the past performance, it would be highly probable that one or more may not meet this requirement for whatever reason. We can ask them to do this;
however, if for any reason they do not get this information to you by the response date, it would reflect on us negatively. We have no control over whether anyone will respond to our request to provide your office with this information.
I would like to ask for consideration of the below option.
I would like to ask you to please consider having this requirement of verification of past performance and the CSS provided by your office to ensure you receive the information you are requesting. Once we submit the past performance document to your office, your office can then contact the customers and request them for the survey. However, if they do not respond, this should not be viewed negatively to our RFP submittal.
- The requirement in the solicita on under SA18 states “[ ] No less than three (3) fully completed Customer
Sa sfac on Surveys (CSS) must be submi ed by a third party prior to the proposal due date to meet the Customer Experience factor. The CSS a ached in Sec on J, a achment number J-2 is required to be used for the Customer Experience Submi als.” The Standard for Review of the Customer Service submission requirements states “Standard for Review: At least three (3) CSS must be received from third party references before the solicita on deadline with an average ra ng of Good or higher. The FAA reserves the right to contact customers listed as references and conduct a CSS in the event there is insufficient compe on due to the lack of surveys received. Any nega ve customer review may deem the proposal unacceptable and will be rejected from further considera on. Keep in mind that the FAA may use informa on other than that provided by the Contractor in connec on with this solicita on and apply that informa on in its final determina on.
- The FAA will not take on the responsibility of this requirement, but I am happy to let you know how many surveys are received if requested so you can follow up with your customers to ensure this requirement is met.
3. We are performing independent research on the Combined Synopsis/Solicita on (697DCK25R00096).
We would like to know if this is a brand new contract OR if there is (was) an incumbent performing these services.
If not brand new, could you please provide the current / previous contract number?
- This contract is to replace the current contract, 697DCK-20-C-00102.
4. I have a few more questions regarding this solicitation. Regarding the Limitations on Subcontracting on page 29
3.6.1-7 LIMITATIONS ON SUBCONTRACTING (JUL 2021)
However, there is a newer requirement in 852.219-14 Limitations on Subcontracting (OCT 2022) Please see the attached.
It is my understanding we are suppose to be following the most current regulations. Per your prior email regarding services the below should apply.
(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract;
I have seen this on all of the SDVOSB set a side solicitations over the last two years that I have read. When I did not see this in yours, I sent the first email regarding the requirements. I want to make sure we are understanding this and following it correctly.
- The FAA does not follow the FAR, we follow the AMS. AMS Clause 3.6.1-7 Limita ons on Subcontrac ng (July
2021) is the most current version of this clause in the AMS.
5. On page 77 Customer Survey I have a quick question regarding the past performance requirements. We are a new start up working on solicitations at the moment. We currently are still in the process of acquiring a past performance. Our subcontractors, however, do have a past performance.
