About this file

Amendment 0003 for Solicitation 693C73-25-B-000009 provides updates to the Landslide Repairs in the West Region C1 project in Puerto Rico. The amendment modifies the bid schedule by deleting several pay items, revising the Utility Company Compensation (PRASA) pay item, and adding a new Temporary Shoring and Bracing pay item. It also includes an OGPe PRASA Endorsement for PR-453, Km 12.7 and reschedules the bid opening date to Tuesday, June 17, 2025, at 2:00 p.m. EDT.

The amendment addresses questions and clarifications from potential bidders, including details about specific pay items, rebar sizes, and project specifications. The project involves repairing landslides and road damage on multiple highways in Puerto Rico, with multiple schedule options available for bidding. The total project cost is expected to be between $10-20 million, focusing on embankment reconstruction, soil slope systems, gabion walls, retaining walls, drainage systems, pavement work, and related infrastructure improvements.

Questions/Clarifications

Questions/Clarifications

Bidders can send written questions or inquiries for clarification to: eflhd.contracts@dot.gov.

Questions can be submitted at any time, but questions submitted within 10 days of the bid opening may not be answered in time for the bidder to properly incorporate the responses into their bid.

The following questions and issues were asked via email. The Government response or clarification is provided. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised, and some questions not have been included.

The Government’s direct response to the sender may also have been updated below for better clarity.

1. Revising the Bid Schedule D, we notice that the following items present quantity zero (0):

Please clarify.

a. 60900-2000 => Line D0700 => Concrete Curb and Gutter (Shallow Concrete Gutter)

b. 61000-0000 => Line D0720 => Concrete Barrier, Case I, Type A

c. 62200-2000 => Line D0920 => Filter Blanket

d. 62200-5000 => Line D0940 => Filter Blanket Type A

e. 62201-7000 => Line D1000 => Grouted Riprap, Class III

Response: The pay items 60900-2000 Concrete Curb and Gutter (Shallow Concrete Gutter), 61000-0000 Concrete Barrier, Case I, Type A, 62200-2000 Blanket, 62200-5000 Filter Blanket Type A, and 62201-7000 Grouted Riprap, Class III were deleted through this amendment. Refer to the amended B pages for additional information.

2. Revising the Bid Schedule D, we notice that the item 63602-1000, line D1140, Utility Company Compensation (PRASA) with unit of measure CTSM does not have a unit price and therefore an amount. Please clarify.

Response: The pay item 63602-1000 Utility Company Compensation (PRASA) was revised to reflect the amount through this amendment. Refer to the amended B pages for additional information.

3. Reference is made to the project ER-HWY-73, specifically to Drawing GR/04, Note 14, which states:

"SUPPORT OF EXCAVATION SHALL BE A SUBSIDIARY OBLIGATION OF THE

CONTRACTOR UNDER UNCLASSIFIED EXCAVATION (SPEC. 203) PAY ITEM."

We would like to respectfully raise a concern regarding this note. As currently written, the language places full financial responsibility for excavation support entirely on the contractor, mailto:eflhd.contracts@dot.gov

Questions/Clarifications treating what could represent a significant and potentially complex scope of work as a subsidiary obligation under the general excavation pay item.

Given the specialized nature of the shoring systems likely required for the safe installation of the gabion walls — and considering compliance with OSHA 1926 Subpart P standards — we propose that the government establish a separate bid item for shoring support.

Response: The pay item 20600-5000 - Temporary Shoring and Bracing (HWY-73) with unit price LPSM has been added through this amendment. Refer to the amended B pages and SCRs Section 206 for additional information.

4. We are currently reviewing the drawings for Sites HWY-21 and HWY-80, both developed by Kimley-Horn. As specified, both locations call for the use of a secant pile wall with an anchored cast-in-place retaining wall system. However, upon examining the drawings— specifically pages RW/6 through RW/8 for Site HWY-21, and RW/18 through RW/20 for Site HWY-80, we note that while reinforcing steel is detailed, the specific rebar sizes are not identified. We kindly request clarification on this matter.

Response: The designated rebar size is clearly identified in the plans. For Sheets RW/6

– RW/8, the note on the bottom left states the if “*” is included the first number relates to the bar size. All 4 tables have “*” with “Designation”.

For sheet RW/18 – RW/20, sheet RW/18 does have a minor error. The 5W1 – 5W12, should be 5H1 – 5H12. Although that is an error, sheet RW/19 only has one table for horizontal bars. Also, the table “Vertical Rebar” on sheet RW/19 should have a “*” with the “Designation”. Designated rebar size will follow the same format as explained above.

5. While we acknowledge and appreciate the previously granted extension to June 10, we respectfully request an additional extension of at least two (2) weeks.

Response: The Bid Opening date was rescheduled to June 17, 2025, at 2:00 p.m. EDT.

BID SCHEDULE INSTRUCTIONS

PROJECT: PR ER DOT PRMNT RPR(25)

BIDDERS PLEASE NOTE: Before preparing the bid, carefully read the Instructions to

Bidders. While preparing the bid, comply with the following:

COMPLETING THE BID SCHEDULE

Complete the Bid Schedule(s) by handwriting in ink or typing. Specify a Unit Bid Price, in figures with cents to only two decimal places, for each pay item in the Unit Bid Price column for which a quantity is given. Do not enter or tender a Unit Bid Price for any pay item for which no estimated quantity appears in the Bid Schedule. Determine the products of the respective unit prices and quantities, and show them, in figures, in the Amount Bid column. If a Unit Bid Price and Amount Bid have been inserted by the Government for a pay item, do not change the Unit Bid Price and Amount Bid for the pay item. Determine the Bid Total for each specific individual Schedule of Work by adding the amounts of the listed items and show in the block provided for that individual Schedule of Work. In case of multiplication errors, the Amount Bid for the item will be based on the Unit Bid Price.

To be eligible for award, bidders must submit prices for each pay item.

Review Subsection 109.05 of the Special Contract Requirements (SCR) regarding scope of payment for direct and indirect payment work.

Fill in the Bid Total(s) for each individual Schedule of Work as directed on the Bid Summary page. Fill in the Evaluation Total Price of Project in the space provided on the Bid Summary page.

The amount in Block 17 of the SF 1442 should be completed as follows:

Schedule A - $ .

Schedule B - $ .

Schedule C - $ .

Schedule D - $ .

SCHEDULES OF WORK

The Bid Schedule is comprised of the following separate schedules and options of work:

Schedule A (Base Contract) - Pages B-1 thru B-5 Schedule B (Government Option 1) - Pages B-6 thru B-7 Schedule C (Government Option 1) - Pages B-8 thru B-10 Schedule D (Government Option 1) - Pages B-11 thru B-14

The Government will award the project as a Base Contract (Schedule A) with the option to award Schedule B (Government Option 1), Schedule C (Government Option 2), and Schedule D (Government Option 3); see FAR Clause 52.217-5.

The purpose of the multiple schedules and options is to give the Government maximum flexibility in completing the project in a timely manner and at a cost-effective price, by proper utilization of programmed funds and upon receipt of any additional funds or permits required to award the contract. If complete funding is in place at the time of award of Schedule A (Base Contract), the Government may award Schedule B (Government Option 1), Schedule C (Government Option 2), and Schedule D (Government Option 3) at that time.

If additional funding is required for the award of Schedule B (Government Option 1), Schedule C (Government Option 2), and Schedule D (Government Option 3), and received after the award of Schedule A (Base Contract), the Government has the right to exercise Schedule B (Government Option 1), Schedule C (Government Option 2), and Schedule D (Government Option 3), at the unit prices bid no later than:

For Schedules B and D: 60 calendar days after the Notice to Proceed for Schedule A (Base Contract); and

For Schedules C: 365 calendar days after the Notice to Proceed for Schedule A (Base Contract).

COMPLETION OF WORK

The Government has estimated the number of calendar days necessary to complete all contract work from the effective date of the Notice to Proceed to contract completion for the various contract award scenarios. The maximum number of calendar days allowed (i.e., the contact performance period) is shown in Block 11 of the SF-1442 and described below.

If the Government awards the contract as Schedules A + B + C + D, the performance period to complete all contract work will be 1,365 calendar days.

If the Government awards the contract as Schedules A + B + D, the performance period to complete all contract work will be 1,185 calendar days.

If the Government awards the contract as Schedule A only, the performance period to complete all Schedule A work will be 895 calendar days and will start on the effective date of Schedule A’s Notice to Proceed.

If Schedule B (Government Option 1) is exercised after the award of the original contract, the performance period of the contract will not be extended and the performance of Schedule B work is to be simultaneous with the performance of the executed contract.

If Schedule C (Government Option 2) is exercised after the award of the original contract, the performance period of the contract will be extended 180 calendar days and the performance of Schedule C work is to be simultaneous with the performance of the executed contract.

If Schedule D (Government Option 3) is exercised after the award of the original contract, the performance period of the contract will be extended 290 calendar days and the performance of Schedule D work is to be simultaneous with the performance of the executed contract.

In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the Special Contract Requirements (SCR). Specific work limitations may be (but are not limited to):

National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed. Specific work items may include (but not limited to): those that require a minimum ambient air temperature (asphalt paving and surface treatment, pavement striping, stone masonry, etc); those that require maintaining a minimum surface temperature (concrete pavement, structural concrete, painting, etc); and those that have specific planting seasons (turf establishment, sod, trees, plants, etc). The Government also considered time required for preparing material and drawing submittals, and the allowable Government review times for those submittals (Subsection 104.03 of the SCR).

Bidders are to assume that the award of the contract and approval of the Contractor’s Performance and Payment Bonds (see Block 12a of the SF-1442 and FAR Clause 52.228-

15) may result in the start of construction activities to be no earlier than June 2025. See Subsection 108.01 of the SCR’s for additional details.

BASIS FOR AWARD

The contract will be awarded to the responsive, responsible bidder with the lowest Evaluation Total Price of Project, which is defined as:

Schedule A (Base Contract) Bid Total + Schedule B (Government Option 1) Bid Total + Schedule C (Government Option 2) Bid Total + Schedule D (Government Option 3) Bid Total.

B-0

Bidder/Offeror please note: Before preparing the bid, carefully read the Solicitation Provisions. Insert a unit bid price, in figures, for each pay item for which a quantity appears in the bid schedule. Multiply the unit price by the quantity for each pay item and show the amount bid. Should any mathematical check made by the Government show a mistake in the amount bid, the corrected unit price extension shall govern. When the word "LPSM" (Lump Sum) appears as a unit bid price, insert an amount for each lump sum pay item. When a sum based on a fixed rate appears for any pay item in the amount bid column, include the Government inserted amount bid for the item in the total bid amount. Total all of the amounts bid for each pay item and show the total bid amount.
