About this file

This document describes a two-phase design-build solicitation for the rehabilitation of approximately 10.3 miles of the Colonial Parkway within the Colonial National Historical Park in Virginia.

The Eastern Federal Lands Highway Division of the Federal Highway Administration, in cooperation with the National Park Service, is seeking design-build firms to participate in Phase One to submit statements of qualifications by July 12, 2022. Phase Two will involve issuing a request for proposals to the top three qualified offerors from Phase One.

The solicitation involves the design and construction of exposed aggregate concrete and asphalt roadways, bridges, tunnels, drainage, utilities, landscaping, and other work to rehabilitate the historic parkway. The estimated value is between $100-150 million. Key requirements include experience with historic preservation, cultural landscapes, permitting, and coordinating in a sensitive park environment. The awarded design-build contract is anticipated in the second quarter of fiscal year 2023.

Responses to Potential Bidders Questions

The following questions and issues were submitted to EFLHD at eflhd.contracts@dot.gov. The Government response or clarification is provided below in blue. The Government’s direct response to the sender may also have been updated below to improve clarity.

1. Will the specifications come from these two sites:

• General Specifications: https://highways.dot.gov/federal-lands/specs/archives/fp-03-usc

• Supplemental Specifications: https://flh.fhwa.dot.gov/resources/specs/fp-14/efl/

Refer to the draft RFP for the appropriate specifications to be used for the project.

2. For JVs, will only a signed JV Agreement need to be in place for the SOQ phase?

The JV will need to have a Unique Entity ID (UEI) and business profile registered in SAM.gov as we check that information during the SOQ evaluation phase to ensure it is a viable business. If you have a pending status, you can submit that information as well.

3. Factor 2; Offeror Past Performance; Item 2 states that “The lead design firm and lead contractor shall each list at least three (3) but no more than five (5) projects completed in the past ten (10) years similar in scope.....” Given the unique scope of this project, can the project list be expanded to 15 years?

Yes. An amendment will be issued to extend the past performance period to 15 years.

4. Factor 2; Offeror Past Performance; Item 2. In regard to the lead design firm listing “projects completed in the past 10 years…”, confirm that completed means design completed date and not construction completed date.

Projects that have been completed through the design phase and obtained final plan approval are acceptable.

5. Please confirm that item 2 of Factor 2 found on page 13 of the RFQ allows the Offeror to use the experience of a lower tier design subconsultant (identified in the SOQ) when presenting the Offeror’s past performance and experience.

Yes, the Offeror can use the design experience of subconsultants who are identified in the SOQ and are shown in the organizational chart.

6. Please confirm that the Offeror does not need to provide construction Quality Assurance nor a Quality Assurance Manager for the project and whether the Owner will be providing these services for the project.

No, the Offeror does not need to provide construction Quality Assurance nor a Quality Assurance Manager.

7. In reference to the requirement on page 8 of the RFQ to coordinate with an independent archaeological monitoring firm and independent tribal monitoring during construction, please confirm that the Owner will provide the independent archaeological monitoring firm and the independent tribal monitoring firm during construction, or otherwise clarify the requirement.

Yes, the Government will provide the independent archaeological monitoring firm and the independent tribal monitoring firm.

8. The RFQ currently requires a key person for the position of Geotechnical and Pavement

Engineer. Can the Offeror separate the Geotechnical and Pavement Engineer into two separate and distinct Key Persons (Geotechnical Engineer and Pavement Engineer) to better address the needs of the Project?

Yes, the Offeror can separate the Geotechnical and Pavement Engineer into two separate and distinct Key Personnel.

9. Please clarify the obligation to keep team intact, or otherwise clarify the requirement.

Specifically, please clarify the statement found on page 11 of the RFQ: “any in-house personnel, subcontractors, and outside associates or consultants will be limited to the individuals or firms that are specifically identified during the RFQ submittal process.” Shall the Offeror interpret this statement to mean that Key Personnel, subcontractors, associates, or consultants identified in the Offeror’s SOQ shall not be substituted without the Owner written consent or shall the Offeror interpret this statement to mean that Key Personnel, subcontractors, associates, or consultants NOT identified in the Offeror’s SOQ shall not be able to participate in the Project?

The Offeror shall not substitute Key Personnel, subcontractors, associates, or consultants identified in the Offeror’s SOQ without the Government’s prior written consent. In addition, the Offeror shall not use Key Personnel, subcontractors, associates, or consultants not identified in the Offeror’s SOQ without the Government’s prior written consent.

10. In regards to the past performance requirement, do the PPQs count to the 50-page limit?

No. Past performance evaluations are excluded from the page count.

11. Is it required to submit a CPARS or FHWA PPQ form, or can we use a Letter of Recommendation or client-specific evaluation form?

A Letter of Recommendation or client-specific evaluation form is acceptable.

12. Would FHWA extend the past performance time limit back to 12 or 15 years?

Yes. An amendment will be issued to extend the past performance period to 15 years.

13. For the 11x17 organizational chart, does that count as one page or two pages?

An 11x17 sheet for the organization chart will be counted as one page.

14. We would like more clarification on the Historic Landscape Architect: Does this position require the individual to be a licensed Architect or Landscape Architect or can it be an individual who meets the Secretary of the Interior’s qualifications in any category under 36CFR61 (Architectural Historian, Historian, Archaeologist, Landscape Architect, or Architect)?

This individual is to be a licensed Landscape Architect.

15. The margins on the SF-330-21, downloaded using the link provide in the SOQ, are slightly less than one-half inch. Will FHWA-EFLHD consider removing the one-inch margin requirement specified in the RFQ, given the current SF-330 has one half inch margins?

Yes. An amendment will be issued to revise the margin requirement.

16. Is there a list available of firms that submitted letters of interest for the Sources Sought phase?

Yes. Design Build, LLC, JPI Construction, LLC, NVServices, LLC, TAMRIO Inc., Island

Roads Corporation, Gill Engineering Group, Inc., and T1 Construction, LLC (Tribal 1).

17. Would it be permissible to use Times New Roman font size 10pt (instead of 12pt) on the SF

330 sections A-G?

No. Use Times New Roman font size 12pt.
