STATEMENT OF WORK

EASTERN REGION

DEFINITIONS

A. Government – The Eastern Federal Lands Highway Division (EFLHD) of the Federal

Highway Administration (FHWA) of the United States Department of Transportation.

B. Firm – The Architect-Engineering firm is awarded the contract to perform the professional services described in the articles.

C. Consultant Onsite Personnel (COP) – The Firms onsite personnel, which includes the Project

Office Engineer (POE) and/or Construction Inspectors (CI).

D. Statement of Work (SOW) – A contract Article containing a detailed description of the project or elements of work, an outline of the services required, responsibilities of the parties, and other information necessary to complete the contract work.

E. Contracting Officer (CO) – The person who has the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.

F. Administrative Contracting Officer (ACO) – The person who has the authority only to administer contracts and make related determinations and findings.

G. Contracting Officer’s Representative (COR) – The person who has the authority only to give the firm technical direction. The COR does not have the authority to change the terms and conditions of the contract or to give directions that incur additional cost. A copy of the COR Designation and Statement of Responsibilities will be furnished to the firm.

H. Project Engineer (PE) – The person who represents the Government at the Project level. The

PE will be in contact with the COP on a daily basis and will generally be the one who accepts or rejects work created by the COP.

I. Deliverable Items – Items that the firm provides the Government under the terms of the contract, including reports, documents, and other required items.

J. Contract Clause – Both the Solicitation Provisions and Contract Clauses are collectively referred to as Contract Clauses.

K. IDIQC – Indefinite Delivery, Indefinite Quantity Contract.

L. Task Order (TO) – An individual order issued in accordance with and described under, F.

PROSECUTION OF THE WORK.

STATEMENT OF WORK

EASTERN REGION

A. PURPOSE

This Indefinite Delivery, Indefinite Quantity Contract (IDIQC) is for engineering services to provide Consultant Onsite Personnel (COP), specifically, Project Officer Engineers (POE), Construction Inspectors (CI), and Project Managers (PM) to assist the Eastern Federal Lands Highway Division (EFLHD) field personnel in administering and managing highway and bridge construction contracts. The Eastern Region includes: Maryland, Virginia, the District of Columbia, North Carolina, South Carolina, Georgia, Florida, Alabama, Mississippi, Tennessee, Arkansas, Louisiana, Puerto Rico, and the Virgin Islands, Maine, Vermont, New Hampshire, Massachusetts, Connecticut, Rhode Island, New York, New Jersey, Delaware, Pennsylvania, West Virginia, Ohio, Michigan, Indiana, Kentucky, Wisconsin, Iowa, Minnesota, Illinois, Missouri, and other States within the continental United States as required. A Task Order will be issued as described in Part F. Prosecution of Work for each project the EFLHD requires a COP.

B. PROJECT LOCATIONS

The highway and bridge construction projects are located throughout the region. The Firm shall make every effort to locate potential personnel in the project area to eliminate per diem costs. If a COP cannot be found, and the CO or ACO agrees, a COP may be assigned and shall receive per diem in accordance with standard General Service Administration (GSA) per diem rates. These rates can be found at: http://www.gsa.gov.

C. CONTRACT WORK TO BE PERFORMED

The COP shall perform the duties described within the terms and limitations of the contract. The contract is for a period of one base year with four one-year options. During the life of the contract the Government will request the Firm to supply one or more POE, CI, or PM’s in accordance with Part F. Prosecution of Work. The number of COP needed will vary depending on the number and type of ongoing construction projects. It is anticipated that between 10 and 20 construction projects will require a COP; the number of COP required per project will vary between 1 and 4, and the duration on each project will vary from 4 months to 2 years.

D. GOVERNMENT PROVIDED DATA- to be provided to personnel on site

1. FLH Construction Manual

2. FLH Field Material Manual

3. Standard Specifications for construction of roads and bridges on Federal Highway

Projects, FP-14

4. Construction contract documents for each project on which the COP is assigned

5. Standard report forms including Inspector Daily Reports (IDR), progress estimate forms, etc.

6. Access to original cross-sections and earthwork computations for each construction project

7. An example of a Final Construction Report if required

E. PROGRAM MANAGEMENT AND CONTROL REQUIREMENTS

1. Oversite – This contract is under the overall direction of the CO at all times. The CO will designate an ACO and COR to provide normal contract administration and technical direction. At the COR’s discretion certain activities, such as approval of personnel and day-to-day assignments, may be delegated to other Government officials such as the Project Engineer. No Government personnel will act in a supervisory fashion to any COP. The Government personnel will provide technical direction and monitor contract performance. The Firm is responsible for general supervision of the COP and the quantity, quality, and timeliness of work, attendance, and overall performance.

2. Personnel - The Firm shall provide COP qualified in performing inspection and testing on various highway and bridge construction activities including but not limited to:

• Highway earthwork construction

• Drainage structures (ditches, culverts, inlets)

• Subgrade and base course construction

• Bituminous pavement construction

• Concrete pavement rehabilitation

• Structural concrete construction

• Post-tensioned concrete construction

• Highway materials testing

• Bridge deck rehabilitation

• Landscaping and seeding

• Installation of traffic signal systems

• Construction traffic control

• Installation of pavement markings

• Installation of miscellaneous highway construction features

• Building construction

• Railroad construction

• Cleaning and painting of steel structures

• Removal and disposal of hazardous materials

• Tunnel grouting and rock bolting

• Wetlands mitigation and replacement

The Firm shall assign a Project Manager (PM) to oversee the contract. The PM shall be a Registered Professional Engineer and shall be the Firm’s primary point of contact for the ACO and COR. The PM’s duties include supervision and coordination of the COP.

Qualifications: The personnel proposed by the Firm will be given preliminary approval based on a review of resumes submitted during the negotiation of this contract. However, before being assigned to a specific project, the COP will be approved by the COR after submittal of a resume and following a face-to-face or telephonic interview. All potential personnel will be evaluated for acceptance based on the Position Description and terms of the contract. The Government retains final authority in determining the acceptable competence of personnel based on actual performance. Previous approval may be revoked if the individual has been determined to be performing in an unsatisfactory manner. If approval is revoked, the Firm shall not resubmit the individual’s resume for another assignment unless requested to do so by the COR.

Security: COP may be required to complete Security Clearance checks prior to being assigned to a project, and may be required to complete the FHWA Information Technology Security training. The Firm must inform the COR at a minimum of 24 hours prior to the removal of a COP.

3. Position Descriptions – Positions are grouped into four categories; Project Office

Engineer; Inspector Level III; Inspector Level II; and Other. The POE and CI are expected to perform all duties with no direct supervision from the Government.

POSITION DESCRIPTION – PROJECT OFFICE ENGINEER

The POE will provide construction contract administration support to the PE, and is considered part of the PE staff.

Qualifications: The POE shall possess the following minimum qualifications:

• Bachelor Degree in Civil Engineering.

• EIT Certificate

• Minimum of 4 years experience in highway and bridge construction, including at least 1 year serving as Project or Resident Engineer or Assistant Project or Resident Engineer on State or Federal highway or bridge construction projects.

• This position requires a comprehensive knowledge of highway engineering principals, construction methods, traffic control, environmental compliance, surveying, equipment, trades, materials, schedules, and practices. The POE is expected to have direct knowledge and basic understanding of the latest editions of the Manual of Uniform Traffic Control Devices (MUTCD), AASHTO Policy on Geometric Design of Highways and Streets, ADA Standards for Accessible Design and AASHTO Standard Specifications for Transportation Materials and Methods of Sampling and Testing. The POE must be able to interpret project plans, specifications, contracts, regulations, schedules, submittals, and detailed cost estimates. This position requires an extensive knowledge of construction contract administration and contract filing systems.

• The POE must be proficient in the internet, Microsoft Outlook, Excel, Word, and Primavera or other scheduling software, and is required to have a proficient level of writing skills. The POE is expected to have good listening and both, oral and written communication skills, and must be able to coordinate and schedule the efforts of others.

Principal Duties and Responsibilities: The POE shall perform the following:

• Informs the PE of visits by the project owner representatives, media representatives, utility representatives, public representatives, or when permit compliance inspections have been performed. Keeps the PE informed of activities and concerns on the project on a daily basis. The POE is not authorized to make or approve changes to the contract, but is expected to recommend changes to the contract for clarification or improvements.

• Reviews and performs detailed analysis of complex or moderately complex

Critical Path Method (CPM) project schedule submittals using Primavera or other software.

• Reviews contractor monthly invoices, material submittals, shop drawings, As- Built drawings, contractor requests, and provide comments and/or recommendations to the PE. Reviews traffic control, environmental controls, construction methods, and all issues concerning the construction of the project. Determines the acceptability of the day-to-day work performed by the contractor. Reviews and recommends acceptance or rejection of daily reports submitted by the contractor.

• Responsible for seeing that daily activities are documented and project files are kept up-to-date. The POE may be responsible for completing the Project Diary, Monthly Progress Estimate, Material Register, status reports, and seeing that project files are properly maintained and complete.

• Drafts the final close-out prenegotiation memorandum, contract modification, and Final Construction Report.

• Informs the PE of possible changes, and recommends solutions. Develops independent engineer’s estimates. Reviews and provides comments on contractor price proposals. Drafts contract modification documents, including prenegotiation memorandums. Creates draft onsite correspondence for the PE signature to the contractor providing clarification of contract requirements.

Prepares drafts of correspondence for the PE and/or COE of official correspondence.

• Provides assistance in planning, organizing, and facilitating project meetings, including meetings with the owning agency, local utilities, landowners, designers, local officials, contractors, including formal partnering meetings.

POSITION DESCRIPTION – CONSTRUCTION INSPECTOR III

The Construction Inspector Level III (CI-III) shall serve as a technical assistant to the Government PE, and receives assignments, guidance, and direction from the

PE.

Qualifications: The CI-III shall possess the following minimum qualifications:

• One of the following certifications in the highway/bridge construction field:

1. NICET Certificate – Level III or higher, or equivalent state certificate

2. EIT Certificate

3. Associate’s Degree in Engineering Technology

• A minimum of 6 years of increasingly responsible construction engineering experience, including at least 1 year serving as Project or Resident Engineer or Assistant Project or Resident Engineer on State or Federal highway or bridge construction projects.

• This is a senior level position and requires a comprehensive knowledge of highway construction methods, traffic control, environmental compliance, surveying, equipment, trades, materials, schedules, and practices. The CI-III must be able to interpret project plans, specifications, contracts, regulations, schedules, submittals, and detailed cost estimates. This position requires an extensive knowledge and experience in highway construction inspection and monitoring. The CI-III must be able to monitor and evaluate the construction contractor’s quality control inspection and testing systems.

• The CI-III is expected to create and/or draft contract documents and is required to have a proficient level of writing and computer skills. This position requires good listening and communication skills. The CI-III must be able to coordinate and schedule the efforts of others.

• The CI-III must be proficient in the internet, Microsoft Outlook, Excel, Word, and Primavera or other scheduling software, and is required to have a proficient level of writing skills. The CI-III is expected to have good listening and both, oral and written communication skills.

Principal Duties and Responsibilities: The CI-III shall perform the following responsibilities:

• Performs inspections of traffic control, environmental controls, layout, construction methods and materials, and all issues concerning the construction of the project. Determines the acceptability of the day-to-day work performed by the contractor. When areas of non-conformance are identified the CI-III shall inform the construction contractor to take appropriate action to correct these areas. Review and recommend accepting or rejecting daily reports submitted by the contractor.

• Informs the PE of possible constructive changes, and recommends technical solutions. Develops independent engineer’s estimates when requested. The CI-III is not authorized to make or approve changes to the contract.

• Performs inspection of the contractor’s quality control procedures and material testing. Verifies that procedures are in conformance with the approved Quality Control Plan and established procedures. Reviews material submittals and testing procedures and results for conformance to the contract and updates the project Material Register.

• Measures quantities of materials placed. Performs takeoffs to determine conformance with required quantity amounts. May be required to assist with the finalization of quantities for the monthly progress estimate.

• Responsible for seeing that daily activities are documented and project files are kept up-to-date, including the Material Register and as-built drawings.

The CI-III may be required to maintain the daily project diary, complete Inspector’s Daily Reports (IDR), and other forms as required.

POSITION DESCRIPTION – CONSTRUCTION INSPECTOR II

The CI-II shall function as a construction inspector and technician. The CI-II is considered part of the PE’s staff and receives assignments, guidance, and direction from the PE.

Qualifications: The CI-II shall possess one of the following minimum qualifications:

• NICET Level II or higher, or equivalent state certificate

• EIT Certificate

• Associate’s Degree in Engineering Technology

• A minimum of 4 years of increasingly responsible construction engineering experience.

Principal Duties and Responsibilities: The CI-II shall perform the following responsibilities:

• Performs inspections of traffic control, environmental controls, layout, construction methods and materials, and all issues concerning the construction of the project. Determines the acceptability of the day-to-day work performed by the contractor. When areas of non-conformance are identified the CI-II shall inform the construction contractor and/or PE. • Informs the PE of possible constructive changes, and recommends solutions.

The CI-II is not authorized to make or approve changes to the contract.

• Performs inspection of the contractor’s quality control procedures and material testing. Verifies that procedures are in conformance with the approved Quality Control Plan and established procedures. Reviews material testing procedures and results for conformance to the contract.

• Measures quantities of materials placed. Performs takeoffs to determine conformance with required quantity amounts.

• Responsible for seeing that daily activities are documented. Completes IDR’s and other forms as required.

• The CI-II may be required to perform sampling and/or in-place testing of soil, aggregate base, concrete, and asphalt concrete pavement.

POSITION DESCRIPTION – OTHER

There may be a need for the creation of a technical engineering position not now anticipated that may later be obtained through the Firm. When the need occurs the Government will provide a position description and negotiate a rate. The addition of a needed position would be created through a contract modification.

4. Facilities and Equipment -

• Field Office – A field office with furnishings will be provided by the Government for the exclusive use of the Government’s staff and the COP. Sanitary toilet facilities will be maintained in close proximity to, or within the field office.

Maintenance of the field office and facility, including utility bills, will be the responsibility of the Government.

• Telephone System – The Firm shall be responsible for providing a cellular phone for each COP for official business use only.

• Laptop Computer – The Firm shall be responsible for providing a laptop computer for each COP. The computer shall include anti-virus software running and kept current with the latest virus signature files. The operating system and programs are to be compatible with Government systems (Windows 10). Software included will be Microsoft Windows Office 2016 (or later) Standard Edition, which includes Word, Excel, and PowerPoint; Primavera P6 scheduling software (for POE and CI-III); and Acrobat DC Pro. The system must be able to create ZIP files that can be opened by the Government using WinZip. The COP shall also have a personal or corporate email address for sending and receiving messages and attachments.

• Transportation – The Firm shall be responsible for providing construction vehicles for use by each of its COP. Vehicles shall be pickup trucks or other approved vehicles capable of providing access to portions of the projects where the COP are required to perform work. The vehicle(s) must be in good operating condition as determined by the COR. Maintenance of the vehicle(s) shall be the responsibility of the Firm and shall not occur during time charged to the project.

One vehicle shall be required for each of the COP. The Firm shall supply bodily injury and property damage liability insurance coverage for the vehicle for a minimum of $200,000 per person and $500,000 per occurrence for property damage.

• Testing Equipment – Most onsite testing will be performed by the construction contractor. However, if checks are required for standard highway tests, equipment and reference materials will be provided by the Government.

• Office Supplies – Office supplies and equipment (paper, survey equipment, pens, pencils, staplers, copier, etc.) will be provided by the Government. As needed, the Government will allow COP access to the Government computer located at the field office site after they have met the required security requirements.

• Personal Equipment – All personal equipment (hard hats, safety vests, safety boots, goggles, dust masks, personal calculators, etc.) for the exclusive use of the COP shall be the responsibility of the Firm. Equipment must be provided as required by applicable Federal and State law.

5. Cooperation and Performance of the Firm – The Firm shall cooperate with and assist the FHWA with inspections of the Firm’s performance. The FHWA may conduct interviews into the Firm’s operations to determine compliance with this contract to insure that adequate inspection of the construction contractor’s work is being performed and that the firm is properly charging costs to this contract. When deficiencies are found, the Firm shall be required to take the remedial action required by the FHWA, including the possible reorganization of inspection procedures or removal of COP.

F. PROSECUTION OF THE WORK

Assignment of the Firms Personnel – The Government will issue a Task Order for a specific project that will indicate the estimated number of each category of the COP required, describe the project and type of work, indicate the estimated date the COP will be needed, and establish a firm-fixed-price dollar amount for that order. The firm-fixed-price amount for that order cannot be exceeded unless a modification has been executed that increases the number of hours or personnel required. The firm shall not exceed the number of regular time or overtime hours included in a task order.

Upon receipt of the above information, the Firm shall provide the ACO the name of the COP and, if not previously approved by the COR for that order, supply a resume showing that the personnel meets the requirements of this contract. The COR or the PE will evaluate the personnel for approval including conducting an interview if necessary.

If the Firm does not provide this information in a timely manner, it may be considered in violation of the contract and subject to termination. The Firm shall follow the guidelines listed below regarding changes in COP, which are subject to the approval of the COR or the PE:

1. Changes in COP directed by the COR due to poor performance of the COP shall be made within one working day after receipt of a written notice. The terminated COP may be requested to leave the project immediately.

2. Additions of COP to a project shall be made within five working days following receipt of a written notice from the ACO.

3. Reduction in the number of COP for convenience of the Government shall be made within fifteen days following receipt of a written notice from the COR.

4. Changes in COP that are mutually agreed upon can be within 24 hours. If the COP is to be removed by the Firm the COR must be informed 24 hours in advance.

Working hours shall be set by the COR or Project Engineer to insure proper timely inspections are conducted. The COP may be required to work weekends or night work as required. A basic 40-hour work week will be scheduled except for weeks that contain an official Federal holiday.

Weeks with a Federal Holiday may only have 32 hours of scheduled work. The first 40 hours of work per week will be paid at the regular time rate. Work hours outside the scheduled 40-hour work week must have prior authorization by the COR and cannot exceed the number of hours of overtime in the order unless a modification is executed in advance to increase the number of hours.

PROFESSIONAL STAFFING

The Firm will provide a Project Manager to oversee the contract. Personnel will be assigned as requested and if it becomes necessary to replace personnel during the performance of the contract, it must be approved by the COR.

DIRECTION

No oral statement of any person whatsoever, including the COR and PE, and no written statement of any person other than the CO or ACO, shall modify the terms or meaning of the contract.

The COR will be designated with the issuance of each individual Task Order. The Firm will be given a copy of the designation along with a statement of the COR’s authority. Changes in the COR will be made in writing by the CO.
