The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action under this clause.
(c) Exceptions to this prohibition are located at 9.108-2.

(g) Contractor selected sites. Prepare separate SWPPP and file separate NOI for all Contractor-selected sources and all waste, borrow, and staging sites not included in the contract. These SWPPP(s) and NOI(s) are solely the responsibility of the Contractor. Do not submit to CO for approval or for signature.
107.02 Protection and Restoration of Property and Landscape. Amend as follows:
Delete the third paragraph and substitute the following:
Do not disturb any area outside the construction limits unless authorized according to Subsections 105.02(c) and 107.10(d). Replace trees, shrubs, or vegetated areas outside the construction limits damaged by construction operations as directed and at no cost to the Government. Only remove damaged limbs of existing trees when directed by an approved arborist.
Add the following to the fourth paragraph:
Paleontological remains and archeological specimens found within the construction area are the property of the National Park Service and will be removed only by the National Park Service or designated representatives. Notify the CO within 1 hour of any discovery. Include a brief statement of the location and details of the finding.
Add the following to the sixth paragraph:
The plans show approximate locations of existing utilities. These utility locations have been determined from prior utility locates requested by the Government and as-built plans from past projects spanning the project limits. Before starting any excavation, locate utilities within the project limits. Provide 7 days’ notice to the CO before executing any utility disruption for construction of the Grant Contractor Camp. Limit utility disruption for power and sewer between the hours of 8:00 am and 4:00 pm, Monday through Friday. Perform work without disrupting water services.
For non-NPS utility locates:
Contact “One Call of Wyoming” at least 3 working days before starting any excavation. The utility notification phone number for Wyoming area is 1-800-849-2476.
For NPS utility locates:
Underground utility locates are required anytime the ground is disturbed in developed areas.
Contact Deb Guernsey at debra_guernsey@nps.gov or 307-344-2470 for instructions on how to submit your Locate request. Provide clear and accurate maps of the location of your dig. Clearly mark the specific area on your map. Email the map to debra_guernsey@nps.gov or bret_deyoung@nps.gov. Mark all dig locations with white paint or white flags BEFORE submitting your locate request. Submit all NPS locate requests to the park at least 7 days in advance. Call 307-344-2470 or 307-344-2070 if you have questions.

(e) Notify the CO at least 7 days before starting work in the critical geothermal area from 3005+35 to 3102+00.
(f) Blasting is not allowed.
(g) Ensure all vehicles and equipment have functioning mufflers meeting manufacturer’s recommendations.
107.12 Contractors Camp and Housing. (Added Subsection).
A Contractor trailer camps located at Canyon Contractors Camp providing 30 trailer sites, and Norris Contractors Camp providing 14 trailer sites for use in 2022 is available to Contractor employees and their immediate families only. A rental fee of $ 322.30 per site, per month in 2022 will be assessed and is payable to Yellowstone National Park. The 2022 trailer sites listed above are not available for use in 2023, but sites constructed at the Grant Contractor Camp may be used at the same rental fee specified above.
Utilities available include water, sewer, electric and trash facilities at all sites. To connect securely to the sewer hookups at this site, contractor employees are required to have an appropriate adapter.
Sewer hookup adapters shall securely connect using a tight-fitting, threaded fitting. Submit adapter for approval prior to connection to the Park sewer system. Disposal of trash from the receptacles will be performed by the NPS.
The Grant Contractor Camp will be constructed adjacent to the existing trailer camp at Grant Village as part of this contract. If the contractor wishes to occupy trailer sites before construction is complete submit a plan for approval to the CO to occupy the Grant Contractor Camp before completion.
E-29 DIVISION 100
Project: WY NPS YELL 10(23), Grand Loop Road - Old Faithful to West Thumb
Enter into a utility agreement with Yellowstone National Park for utilities at the sites. Utilities will be metered and charges assessed, per month, payable to Yellowstone National Park. Utilities at this site will be shut off and drained no later than October 21 of each year. An extension to this date may be considered if requested 30 days in advance of October 21.
Comply with the following requirements:
(a) Designate an on-site camp boss to ensure the Contractor Camp operation remains in compliance with Park regulations. Submit the name and phone number of the camp boss to the CO. The responsibilities of the camp boss include, but not be limited to, food handling and storage, solid waste storage and disposal, management of camp facilities, and acting as the contact for NPS personnel involved in bear management, parking, and camping.
(b) To prevent unnatural attractants to bears, no foods, pet foods, garbage, drinks, trash, or food and drink containers are allowed outside vehicles, pickups, trailers, or buildings except during actual use. Specific guidelines will be further outlined during Park orientation sessions presented by the NPS. Notify the CO of any grizzly bear or gray wolf encounters within the camp area.
(c) Notify CO two weeks before starting work so orientation sessions with Yellowstone National Park representatives can be coordinated. All Contractor and subcontractor employees, and their immediate families who will reside with them in the park are required to attend Park orientation sessions specific to the trailer camp, before commencing work.
(d) Any mishandling of garbage, trash, food, and other potential bear attractants described above will result in Yellowstone National Park issuing the appropriate level of law enforcement to the responsible person, or Contractor. Repetition of mishandling or any case of deliberate feeding of wildlife will result in loss of in-park residence privileges. If mishandling occurs and a specific individual is not determined, the Contractor will be held responsible.
E-60j DIVISION 150
Project: WY NPS YELL 10(23), Grand Loop Road - Old Faithful to West Thumb
155.12 Acceptance.
Schedule submittals will be evaluated under Subsection 106.02 and 106.03. The Government will complete its review of schedule submittals by the latter of the following: 14 days of initial receipt (when no schedule meeting is planned), 7 days following final receipt (from the schedule meeting), or 7 days following a resubmittal (if a submittal is rejected).
Approval/rejection of the schedule submittal will be solely based on the contract requirements.
The CO may review activity durations and resource allocations using historical data, industry productivity standards, or equivalents, to determine whether activity durations or the CPM BCM schedule, as a whole, appears to be practicable and comment accordingly. Address, as appropriate, provided comments when preparing resubmittals or future schedule submittals.
Work with the CO to obtain full approval when approved schedule submittals are “Accepted as Noted”.
Approval does not relieve the Contractor of the responsibility to schedule the work in a practicable manner that meets the contract requirements. Failure to include elements of work in the schedule submittal required for performance of the contract, even if previously approved by the CO, does not excuse the Contractor from being responsible for completion of the work by the contract completion date.
Failure to receive approval of a prior schedule submittal does not relieve the Contractor of the responsibility to meet the requirement to provide schedule update submittals.
Meeting minutes will be evaluated under Subsection 106.02.
CDR’s will be evaluated under Subsection 106.02 and 106.03.
Measurement
155.13 Measurement.
Measure the Section 155 items listed in the bid schedule according to Subsection 109.02.
