I certify that I have read and understand the County’s terms and conditions stated in the Sample Services Agreement provided and have no deviations or exceptions to submit.

Having read the Sample Services Agreement provided by the County, the following deviations and exceptions to the terms and conditions are hereby submitted for County’s consideration. I understand that the County may consider, but is under no obligation to accept, any of an Offeror’s contractual terms or provisions included in an Offeror’s Proposal.

Instructions Offeror must cite the original language from the County’s standard terms and suggested language for any deviations or exceptions. Offerors should also provide with their Proposal any of their own standard contractual terms or provisions the County will be asked to consider if Offeror is selected for award. This may include, but is not limited to, such things as a sample Master Services Agreement or Licensing Agreement and any additional governing documents referenced within those sample standard agreements.

The inclusion of additional agreements alone will not be considered by the County to be a sufficient submission of deviations or exceptions. All deviations from the specifications, including but not limited to limitations of liability, must be noted in detail by the Offeror, in writing, at the time of submittal of the Proposal. In the absence of a written list of specification deviations at the time of submittal of the Proposal, the Offeror shall be held strictly accountable for the terms and conditions as written. Any deviation from the specifications as written, not specifically addressed in an Offeror’s submission and accepted by the County, may be grounds for rejection of the Proposal. Offerors must note if their own standard contractual terms or provisions conflict with those provisions provided in the County’s Sample Services Agreement. If more room is needed, Offerors may submit additional pages with their Proposals.
