About this file

This document comprises the Contract Terms and Conditions for an Invitation to Bid (ITB) issued by the Broward Sheriff's Office (BSO) in Florida for Bottled Water Services. The ITB solicitation does not contain specific information regarding quantities, delivery schedules, response deadlines, bidders' conferences, or contract award dates within the terms and conditions document provided. The contract term will be specified in the Scope of Services section of the ITB, which is not included in this file. BSO reserves the right to cancel and re-solicit at its sole discretion, and the contract may be extended to other BSO departments without formal re-solicitation.

The pricing structure requires bidders to provide pricing that equals or is lower than that offered to BSO's most favored customers for similar quantities under comparable terms and conditions. BSO reserves the right to negotiate price reductions during the contract term based on market conditions, industry trends, and cost indices. The contract is subject to extensive compliance requirements including insurance coverage with minimum limits of $1,000,000 per occurrence for Commercial General Liability and Business Automobile Liability; Workers' Compensation; and various specialized coverages as applicable. Additional requirements include compliance with Florida Statutes regarding E-Verify employment verification, public records obligations under Chapter 119 of Florida Statutes, nondiscrimination provisions, intellectual property indemnification, and if federally funded, compliance with FEMA regulations, Davis-Bacon Act prevailing wage requirements, Clean Air Act and Water Pollution Control Act standards, and domestic preference procurement policies. BSO retains broad termination rights including termination without cause with thirty days' notice and immediate termination for material breach, public records violations, insolvency, nondiscrimination violations, or insurance lapses.
