About this file
This is an attachment to a Request for Proposals issued by Jordan School District (JSD) in Utah for a comprehensive K-12 Social Emotional Wellness Curriculum and related services. The attachment outlines specific requirements mandated by Utah Code 53G-4-402, effective May 3, 2023, which governs contracts between Local Education Agencies and providers of online or digital materials. The document establishes that offerors must comply with statutory notification requirements regarding material content changes, excluding routine updates on current events. If the JSD Evaluation Committee recommends a product for award, the district must provide an opportunity for public review and comment in compliance with state code.
To facilitate the public review process, offerors are required to provide five categories of materials and support: an emailable demo link offering access to both student and teacher experiences using generic login credentials with no personally identifiable information requirement; generic logins and passwords for demo accounts to be used on JSD computers during an in-person Teaching & Learning open house; comprehensive product documentation detailing features, usage, and benefits; physical product samples for display during public review; and vendor representation at open house events, if available, to answer questions from parents, teachers, and community members. All demo access must remain active for a specified period to be determined by the district. By signature on this attachment, offerors acknowledge their understanding of and commitment to these obligations.

Utah Code 53G-4-402 Requirements
Effective 5/3/2023, Utah Code 53G-4-402(26)(e) requires the following:
"If a Local Education Agency (LEA) contracts with another party to provide online or digital materials, the LEA shall include in the contract a requirement that the provider notify the LEA of any material changes to the content of the online or digital materials, excluding regular updates on current events."
Additionally, if the JSD Evaluation Committee recommends a product for award, Jordan School District (JSD) must, in compliance with Utah Code 53G-4-402, provide an opportunity for public review and comment. To facilitate this, the Offeror is required to provide, but is not limited to, the following materials for public review:
1. Demo Link for Public Access An emailable link to a demo account, offering access to both student and teacher experiences if possible. This link must remain active for a specified period (to be determined) and use generic login credentials that do not require any personally identifiable information.
2. Demo Access for In-Person Open House Generic logins and passwords for demo accounts to be used on JSD computers, enabling access to both student and teacher experiences during the Teaching & Learning in-person open house.
These logins must remain active for a specified period (to be determined) and must not require users to provide personally identifiable information.
3. Product Documentation Comprehensive product literature detailing features, usage, and benefits.
4. Physical Product Samples Samples for display during the public review process.
5. Vendor Representation A vendor representative, if available, to attend open house events and answer questions from parents, teachers, and community members.
