About this file

This is an Agreement Exceptions form issued by Broward County Seaport Engineering & Construction Division at Port Everglades, Florida, for use in conjunction with a Request for Proposal solicitation for architectural and engineering design services for a new multi-level cruise terminal parking structure. The form requires vendors to either affirm acceptance of all contract terms and conditions or document specific exceptions, proposed modifications, and justifications for each provision to which they take exception. Vendors must submit the completed form with their solicitation response; failure to submit constitutes acceptance of all stated contract terms and conditions. The solicitation is governed by Florida's Consultants' Competitive Negotiation Act and carries a County Business Enterprise participation goal of 25 percent, with proposals due June 26, 2026. The scope encompasses a comprehensive six-phase engagement including feasibility study, programming and conceptual design, construction documents at multiple completion intervals, permitting and bidding support, construction administration through substantial completion, and warranty inspection, extending 1,525 days from Notice to Proceed.

The estimated budget for the study, program, design, and construction administration is $7,500,000. Pricing is not evaluated in the technical scoring but is negotiated after firms are qualified and ranked. Technical evaluation is weighted 100 points across professional personnel ability, project approach and methodology, past performance, current workload capacity, location certification status, volume of previous work with Broward County, and commitment to time and budget requirements. Vendors must demonstrate at least three comparable multi-level parking garage or transportation facility projects completed within the past five years and provide minimum three non-Broward County references. Required insurance includes Professional General Liability ($1 million per occurrence/$2 million aggregate), Professional Liability/Errors & Omissions ($2 million per occurrence/$4 million aggregate with $100,000 maximum deductible), and Automobile Liability ($500,000 combined). Personnel accessing Port Everglades facilities must pass background checks and obtain permanent restricted-access badges; TWIC credentials are required for secure area access. If the contract is awarded on or after September 30, 2026, living wage, prevailing wage, and domestic partnership ordinance requirements do not apply.
