1. RFP OVERVIEW

This solicitation is intended to provide a mechanism for the Elk Grove School District (District) to procure the services of duly licensed and certified Athletic Trainers for their nine (9) high schools.

Athletic Trainers are often present when injuries or other acute conditions occur, or are the first healthcare professionals to evaluate a patient. For this reason, Athletic Trainers must be knowledgeable and skilled in the evaluation and immediate management of acute injuries and illnesses.

You/Your: Terms that refer to businesses/individuals submitting a response. The term may apply differently, as the context will indicate.

• Provider - A business entity, Supplier, or Vendor engaged in the business of providing parts & services.

• Proposer - A business entity submitting a response to this RFP. Suppliers who may express interest in this RFP but who do not submit a response have no obligations with respect to the RFP requirements.

• Contractor - The Proposer(s) whose response to this RFP is evaluated as meeting the needs of the District. Contractor(s) will be selected for the award and will enter into a contract for the provision of the materials, equipment, and/or services described in this RFP.

• Contractor’s Employee - All persons who can be offered to provide the services described in the RFP.

All employees of the Contractor shall be covered by the insurance programs normally provided to persons employed by a company (ex, Worker’s Comp, SDI, etc.).

2. BACKGROUND

The District is the fourth largest school district in California, covering 320 square miles in southern Sacramento County that includes urban, suburban, and rural communities. The District serves a culturally, linguistically, economically, and geographically diverse student population. More than 63,000 students attend 69 schools: 44 elementary schools, nine middle schools, nine comprehensive high schools, four alternative education schools (including a virtual academy), one charter school, one special education school, and one adult education school.

The Elk Grove Unified School District (EGUSD) has long been known for its excellent athletic programs. We are proud of this reputation and recognize that athletics support our students’ physical, social, and academic development.

The Athletic Department strives to achieve the same standards of excellence in its athletic programs as exist within the District’s academic programs. The athletic program has a firm belief that all participants are students first and athletes second, as is reflected by the District’s athletic eligibility policy. The Athletic Department recognizes a multiple commitment to serve the District, student athletes, alumni, and friends.

Further, it embraces the concept that the student is first and foremost a student possessing individual rights, academic abilities, personal interests, and ambitions comparable to those of other members of the student body.

Instructions for Proposers Page 4 of 14

The emphasis of the athletic program is to provide opportunities that encourage the pursuit of lifetime activities, a sense of commitment and teamwork, and the development of personal character while maintaining an environment that values cultural diversity and gender equity among its student athletes and athletic department staff. As a member, in good standing, of the California Interscholastic Federation, we are committed to the values inherent in CIF high school athletics philosophy and place preserving the integrity of the programs as the highest priority.

3. CONTRACT PERIOD

Any agreement resulting from this proposal shall be for a one (1) year term upon Board approval. The District reserves the right, upon mutual agreement, to extend any resulting agreement(s) for four (4) additional one-year terms with the same terms and conditions as the original agreement.

Initial Term: July 1, 2026, through June 30, 2027 – 12 months.

A. The District shall retain the right to add, delete, or change products purchased under an awarded

Agreement and may do so upon giving a thirty (30) day written notification to the Contractor. If these changes cause an increase or a reduction in the cost of an awarded Agreement, said cost shall be readjusted and, when agreed upon, incorporated into an awarded Agreement. The agreement is contingent upon Board of Education approval.

B. This RFP is not an offer by the District to enter into a contract under these or any other terms. Acceptance of a proposal neither commits the District to award a contract to any Proposer, even if all requirements stated in this RFP are satisfied, nor limits the District's right to negotiate in its best interest. The District reserves the right to reject all proposals and not decide or to contract for only a portion of the project. All costs for proposal preparation are the responsibility of the Proposer.

C. Pricing shall remain in effect throughout the initial term of the contract. The Contractor may negotiate pricing for subsequent extension terms after the initial term. All proposed increases shall be submitted in writing to the Director of Purchasing at least sixty (60) days prior to the expiration of the contract term. The Contractor must provide documentation in support of the request. Price increases accepted by the District will remain the same for the entirety of the extended term.

4. RFP CONTACT

All inquiries regarding this RFP must be submitted in writing to the EGUSD Online Bonfire Procurement Portal: https://egusd.bonfirehub.com for the subject RFP.

8. EVALUATION MATRIX

The District is interested in awarding to a Provider whose offer, in total, presents the greatest value, in our view, to the District from the standpoint of suitability to purpose, quality, service, previous experience, price, ability to deliver, or for any other reason deemed in the best interest of the District. Thus, the result will not be determined by price alone. Proposer shall submit information sufficient for the District to easily evaluate proposals with respect to the selection criteria. The absence of required information may cause the Proposal to be deemed non-responsive and may be cause for rejection. The evaluation process will be conducted in accordance with the following award criteria.

All proposals received by the specified deadline will be reviewed by the Evaluation Committee for content, proposed price, and capabilities of the Proposer. After initial screening, the Evaluation Committee may shortlist, for further evaluation, those Proposers deemed most qualified based on a review of the proposals.

Interviews may be conducted with one or more Proposers as part of the final selection process. Proposers are advised that the District, at its option, may award an agreement strictly on the basis of the initial proposals.

9. BASIS OF AWARD

The District reserves the right to reject any or all proposals, or to waive any irregularities or informalities in any proposals or the bidding, and to make its selection of items awarded based upon its best judgment as to which items substantially comply with the specifications, or which are most economical and/or best suited for the purpose for which they are intended.

The District reserves the right to make multiple awards or no award at all, and further reserves the right to reject any and all proposals and to waive any irregularity or discrepancy associated with this proposal.

Please submit prices on each item. In the event of equal proposals, the award shall be made to the Proposer located within the State of California, the County of Sacramento, and with whom the Purchasing Department of the District has had satisfactory business relationships, in the order named. All proposals shall remain open and valid and subject to acceptance for ninety (90) calendar days after the RFP opening date.

10. SUBMITTAL

All Proposers submitting an RFP shall be responsible for familiarizing themselves with the conditions and requirements of the RFP before submitting their proposal. All proposals must be submitted on the forms enclosed and submitted online.

A responsive proposal is one that meets all terms, conditions, and specifications of the RFP. The proposal must comply with the content requirements of the RFP documents. The Proposer must perform and do what is required by the RFP documents, whether it be pricing in a certain way, attending a mandatory pre-proposal conference, providing bonds, etc. Other examples where a proposal might be declared and found to be non-responsive include:

A. The proposal is substantially incomplete.

B. The proposal is delivered late.

C. No acknowledgement of critical addenda.

D. Significant discrepancies appear in the response.

RFPs will be considered valid for ninety (90) calendar days after the proposal closing date.

11. SPECIFICATIONS

Proposers shall thoroughly examine and be familiar with the specifications. The failure or omission of any Proposer to receive or examine any form, instrument, addendum, or other document or become acquainted with all existing conditions shall in no way relieve any Proposer from any obligations with respect to the Proposer’s offer or the award agreement. The submission of an RFP shall be taken as prima facie evidence of compliance with this section.

12. PRICES

Bid each item separately. Prices must be stated in units specified or trade standard. The right is reserved to waive any informality in proposals, to reject any or all proposals, and to accept or reject any item or combination of items. In case of a discrepancy between the unit price and the extension, the unit price will be considered correct. Quote prices net, including trade discounts, F.O.B. DESTINATION, FRT. PREPAID. Set up fees and artwork charges are to be included in the unit price quoted, not charged separately. Cash discounts, when offered, will be computed from the final date of accepted delivery or receipt of invoice, whichever is later. Sales tax will be applicable but not included in the bid unit price.

Instructions for Proposers Page 8 of 14

13. BRANDS

Brand names are included for descriptive purposes to indicate the quality, design, and utility desired by the District, but the specifications are not intended to restrict competition. Brands of equal make or type to those specified will be considered unless otherwise so indicated in the proposal. Each Proposer shall indicate the brand name and model number of the brand(s) being bid (even if indicated in the specification).

Terms such as “As spec” or Proposer’s item numbers instead of the manufacturer’s name and model number may be considered non-responsive.

14. INSPECTION AND ACCEPTANCE

All items provided under the contract shall meet or exceed the proposal specifications and shall comply with all Federal and California State laws governing their production, handling, processing, and labeling.

Inspection and acceptance of all items shall be at DESTINATION. Items found to be defective or not in accordance with the proposal specifications shall be replaced by the successful proposer at no cost to the District. Failure to replace said items shall be considered sufficient cause for default action under the DEFAULT provision of this proposal.

15. PUBLIC RECORD

All RFPs become the property of the District. All RFPs, including the accepted proposal and any subsequent award contract, become public records per the requirements of the California Government Code, Sections 6250-6270, and the “California Public Records Act”. Proposers submitting Proprietary information shall mark the information as such. The pricing and service elements of the successful proposal are not considered proprietary information.

The District will treat all information submitted in a proposal as available for public inspection once the District has an award contract finalized with the selected Proposer. If you believe that you have a legally justifiable basis under the California Public Records Act (Government Code Section 6250 et seq) for protecting the confidentiality of any information contained within your proposal, you must identify any such information, together with the legal basis of your claim, in your proposal. The Proposer agrees to defend and indemnify the District for any liability, costs, and expenses incurred in asserting such confidentiality as part of your proposal. The final determination as to whether the District will assert your claim of confidentiality on your behalf shall be at the sole discretion of the District.

16. ERRORS AND CORRECTIONS

Proposers submitting a proposal are responsible for carefully checking all conditions and specifications. The District will not be responsible for any errors or omissions on the part of the Proposer in submitting a proposal. No erasures are permitted. Mistakes may be crossed out and corrections made adjacent and must be initialed in ink by the person signing the proposal. Verify your proposal before submission, as it cannot be withdrawn or corrected after being opened.

17. ADDENDUM

Discrepancies in and omissions from the proposal documents or questions as to their meaning shall, at once, be brought to the attention of the District, in writing through the EGUSD Online Bonfire Procurement Portal, prior to the end date and time for questions. Any interpretations, changes, additions, or deletions will be made only by addendum duly issued, and a copy of such addenda (s) will be posted at https://egusd.bonfirehub.com. The District will not be responsible for any other interpretations or changes. Any addendum(s) issued must be signed and returned with other proposal response documents at the time and date set for the proposal opening. It is the Proposer’s responsibility to indicate acknowledgment, sign, and return the addenda with their response.

19. COST OF RFP PREPARATION

The cost of preparation of the response to this Invitation for RFP is solely the responsibility of the Proposer submitting a proposal. The District accepts or implies no liability for the cost of preparation.

20. PREVIOUS PERFORMANCE

Proposers submitting a proposal are advised that the District reserves the right to reject a proposal from a Proposer that cannot demonstrate the ability to provide the services required. Past service and delivery performance with a similar-sized organization and scope of work is a factor in the determination of an award against this proposal. Proposers submitting a proposal, past performance practices, and service to the District will be examined. Proposers submitting a proposal who have demonstrated unsatisfactory performance will be subject to disqualification as a responsible Proposer submitting a proposal, thereby disqualifying the Proposer submitting a proposal from an awarded contract.

21. COMPETENCY OF PROPOSERS SUBMITTING AN RFP

No proposal will be accepted from or awarded to a Proposer who is not licensed in accordance with the law, to whom a proposal has not been issued by the District, and who has successfully performed on projects of similar character and scope to the proposed work. It will be the responsibility of the Proposer to obtain any clearances necessary for the completion of the award contract.

22. RIGHT TO REJECT RFP

The District reserves the right to reject any and all proposals or any part of a proposal; to waive minor defects or technicalities; or to solicit new proposals on the same project or modified project, which may include portions of the original proposal document, as the District may deem necessary and in its best interest. False, incomplete, or unresponsive statements in connection with a submitted proposal may be sufficient cause for rejection. The District will be the sole judge in making such determinations.
