About this file
This is a Scope of Work attachment for a Request for Proposal (RFP) issued by the State of Utah Department of Corrections to secure movie licensing services for public performance in correctional facilities. The Department of Corrections seeks a single vendor to provide licenses covering motion pictures, documentaries, and televised programming for exhibition in prisons, community correctional centers, and other correctional facilities throughout Utah. The contract will have a term of five years, with vendors required to guarantee pricing for the initial two years. The RFP will result in a single contract award to the responsive and responsible vendor achieving the highest combined score from technical criteria and cost evaluation stages.
The vendor must provide all necessary licenses, permissions, and rights for non-theatrical, public, and institutional exhibition of audiovisual content, including coverage for continuous or repeated use and multi-location or facility-wide access where applicable. The vendor shall serve as an authorized licensing agent, distributor, or rights holder and must provide documentation verifying rights to distribute content for public and institutional use, studio or distributor agreements, and any associated limitations or restrictions. The Department reserves the right to audit licensing at any time during the contract period. The vendor must maintain a current, regularly updated catalog of available titles with ratings, licensing types, and usage restrictions, and shall notify the Department of any changes to licensing rights affecting content availability. The vendor is solely responsible for ensuring compliance with all applicable copyright laws and must indemnify the Department against claims arising from improper licensing or unauthorized use. Preference may be given to vendors with demonstrated experience providing licensed media services in correctional or institutional environments and maintaining direct relationships with major studios or authorized licensing entities.

Text version
Attachment C – Scope of Work Movie Licensing for Public/Institutional Viewing in Correctional Facilities Due to the nature of correctional facilities as non-residential, multi-user environments, any exhibition or distribution of audiovisual content constitutes a public or institutional performance under applicable copyright law. Accordingly, all media content provided must be properly licensed for such use. Ownership or purchase of media does not confer the right to publicly display or distribute content within Department facilities.”
The Utah Department of Corrections (UDC) utilizes movies, documentaries, and other televised programming as part of its facility operations, including programming, recreation, and educational services. Because these materials are protected by copyright law and are displayed in a non-private, institutional setting, UDC requires a contractual solution that ensures all content is properly licensed for public or institutional viewing by inmates, thereby maintaining full legal compliance and reducing risk to the Department.
