1. PURPOSE AND SCOPE:

1.1 Purpose. The purpose of this multiple award construction contract is to facilitate efficient acquisition of quality construction capabilities to satisfy project requirements on Holloman Air Force Base.

1.2 Description of Work.

1.2.1 Task Orders. All work shall conform to the requirements, terms and conditions of the MACC contract and subsequent task orders.

1.2.2 Type of work. The work to be performed consists of, but is not limited to, design-build construction of a broad range of maintenance, repair, paving, trenching, minor construction/alteration and renovation work on real property of low- to high-complexity at Holloman Air Force Base (HAFB) NM, including the airfield and federal real property within a 100-mile radius of the HAFB post office, excluding areas within the State of Texas.

1.2.3 Contractor Responsibilities. The Contractor shall provide all materials, labor, plant, tools, equipment, transportation, supervision, management, and other services (including engineering/technical design support), items and incidentals necessary thereto.

1.2.4 Contingency Support. In the event of an emergency or contingency requirement the scope may expand to include construction-related tasks or services not listed above and not normally contemplated in the conduct of routine operations and/or programming.

2. DEFINITIONS:

2.1 Contracting Officer (CO): The Government employee with authority to execute, modify and terminate contracts.

2.2 Contracting Officer Representative (COR): If designated in writing by the Contracting Officer, a COR (or Technical COTR) is a government employee with specific limitations and responsibilities such as inspecting, testing, and accepting contract line items, monitoring the Contractor's performance, controlling Government-furnished property, reviewing and approving and/or recommending to the contracting officer approval/disapproval of vouchers/invoices, etc.

2.3 Design-Build (DB): The process by which the same Contractor provides both the design and construction services for a project, completing the design before construction activity begins. In the Design-Build process, final design solutions are provided by the DB Contractor, not the Government. The DB Contractor is responsible for his or her own design, construction quality, and for full compliance with the FOPR and his or her accepted proposal.

2.4 Design Costs: A “design-build” task order is considered construction and not an Architect-Engineer design contract per FAR 2.1 and therefore design costs under this MACC are NOT limited by the 6% statutory limit.

2.5 Fair Opportunity Proposal Request (FOPR): A package of documents, to include Statement of Objectives (SOO), or Statement of Work (SOW), issued to the Contractor(s) requesting a cost proposal for construction and design documents for a project. Following submittal of the proposal and at the Governments option, interchanges may be held with the Contractor(s) to clarify and/or negotiate elements of the proposal. FOPRs may be issued on a build or design-build basis.

2.6 Government Furnished Equipment (GFE) / Material (GFM): Items of equipment or material which the Government will supply to the Contractor for performance under a TO.

2.7 Mandatory Criteria and Standards: Requirements established by executive orders, public laws, Department of Defense policy and guidance, Air Force policy and guidance, Holloman Air Force Base policy and guidance and other directives.

2.8 Government Project Manager (GPM): Government employee responsible for design conception, design reviews, design management and construction management for facility and infrastructure projects.

2.9 Off-ramping: The process of removing a MACC Contractor from the competition pool.

2.10 On-ramping: The process of adding a new Contractor to the MACC contract.

2.11 Project Superintendent (PS): Contractor employee responsible for the project.

2.12 Statement of Objectives (SOO): A document prepared by the Government in lieu of a SOW that states the overall objectives of the solicitation. It provides basic, top-level objectives with the intent of providing offerors the flexibility to develop cost effective solutions and the opportunity to propose innovative alternatives meeting the stated objectives. Contractors will use the SOO to develop a SOW unique to each respective TO.

2.13 Statement of Work (SOW): Whether provided by the Contractor in response to a SOO in the FOPR, or by the Government with the FOPR, a SOW is a document that defines the project’s performance criteria and any prescriptive requirements not already stated in the Contract’s Mandatory Criteria and Standards.

2.14 Task Order (TO): A Task Order is a document prepared by the Government and issued to the Contractor against the basic contract. Its purpose is to place an order for labor, materials, and other associated items as necessary to complete the Design-Build or Build of a specific project.

3. DESCRIPTION OF WORK:

3.1 Kick-Off (Task Order Review) Meeting. The Contractor Superintendent or CO-approved representative shall attend and participate in a meeting immediately after award to review the terms and conditions of the Task Order with the various stakeholders. This meeting will be scheduled by the Government.

3.2 Pre-Construction Briefing to Stakeholders. Prior to beginning construction work on site, the Contractor shall schedule, provide and coordinate (with the Contracting Officer) slides, and execute a briefing to inform stakeholders of the project about to begin. Stakeholders will include, at a minimum, customer or building occupants’ representative, the 49 CES PM and Inspector, and the Contracting Officer.

3.3 As-Built Drawings. The Contractor shall provide record drawings for completed construction and repair projects. The Contractor shall maintain a complete set of drawings at the jobsite at all times with red-lined changes annotated, from review by Government personnel. The Contractor shall update red-lined changes contemporaneously.

3.4 Color Board. The Contractor shall provide a visual presentation consisting of samples of the various finishes, grouped together based on location within the project that may be required as directed by the Task Order. Samples shall be of adequate size to show the full pattern, texture, and color of each item and shall be submitted to the Contracting Officer in the standard submittal format.

3.5 Project Schedule. The Contractor shall provide an updated project schedule as part of the 100% design.

3.6 Professional Certification: The Contractor shall provide Professional Certification which consists of affixing a seal or statement to a drawing or design document to indicate that the work to which it is affixed has been performed by a person licensed as a professional, in that area of expertise, in the state of New Mexico.

3.7 Contractor Statement of Work (CSOW): The Contractor shall provide a Contractor Statement of Work that defines the project’s performance criteria and any prescriptive requirements not already stated in the MACC’s SOW and Mandatory Criteria and Standards. The CSOW shall comply with instructions provided in each FOPR.

3.8 Traffic Control Plan. The Contractor shall provide a traffic control plan that identifies signage, speeds, and routes to route vehicle and pedestrian traffic safely around construction activities. A traffic control plan shall be provided any time vehicle and/or pedestrian traffic is affected by the Contractor’s construction activities.

3.9 Constructability. Prior to proposal submission the Contractor shall thoroughly review the project request for constructability and advise the Government of possible problem areas.

3.10 As-Built Verification. Prior to proposal submission the Contractor shall field-verify all Government provided record drawings prior to submitting a proposal. The Contractor shall be responsible for the reproduction of these drawings if multiple copies are needed. The Contractor may make multiple site visits, conduct exploratory excavation(s) with an approved Work Clearance Request (AF Form 103), or other intrusive inspection(s) upon approval of the CO, and shall restore all disturbed areas to original existing conditions. The Contractor shall be responsible for scheduling site visits and obtaining all required permits, passes and approvals. All exploratory investigations shall be at no additional cost to the Government and are considered field overhead. The Contractor is responsible for accuracy of all measurements whether they are obtained in the field, or as existing drawing take-offs to develop accurate working drawings. It shall be noted that minor adjustments of new utility lines may be required to avoid existing underground utility lines or existing structures at no additional cost to the Government. All plans, labor, equipment, materials, and incidentals shall be furnished by the Contractor, unless otherwise specified. Since the Contractor is responsible for identifying and addressing any foreseeable complications, they shall thoroughly investigate the requirements of each RFP prior to submitting a proposal.

3.11 Hazardous Materials (Pre-Proposal). The Government will provide the Contractor with a copy of any known reports and/or surveys that lists ACM, LBP, and mercury containing materials that have been previously identified on the project site. If present, the Contractor shall include in its proposal a plan to remediate the hazardous materials in accordance with all applicable laws and regulations, Federal, State and Local.

3.12 Notice to Proceed (NTP). The Contractor shall commence work and complete the design and construction in accordance with the construction schedule accepted by the Government. Construction shall not begin until Government approval of the Final Design submittal and issuance of the Notice to Proceed, unless directed/allowed by the Contracting Officer.

3.13 Progress of Work: Upon receiving NTP, the Contractor shall submit for approval all work schedules to the Government within five (5) calendar days after start of work, unless otherwise specified. The reports contemplated by FAR Clause 52.236-15, Schedules for Construction Contracts, shall be accomplished on and in accordance with instructions pertaining to Form 3064, Contract Progress Schedule, and Form 3065, Contract Progress Report. This requirement is applicable to a TO when it exceeds $250,000.00 and the performance period is greater than 60 calendar days unless otherwise specified by the Contracting Officer.

3.14 Hazardous Materials Survey – Post Award. The Contractor shall conduct a survey prior to any demolition, repair, alteration or new construction, to determine if any additional Asbestos Containing Material (ACM), lead based paint (LBP), mold, mercury or other hazardous material are contained in the TO work area. The Contractor shall review the survey results and provide to the Contracting Officer a Hazardous Materials Report or Abatement Plan as required to address any additional hazardous materials found. If additional hazardous materials are identified during the survey, or if additional hazardous materials are encountered during construction, the Contractor shall notify the Government Contracting Officer immediately and follow the instructions provided.

3.15 Surveys: Topographic and/or Cadastral Surveys: Surveys/work as required for siting, grading, computation of quantities for excavation and fill, development of a particular project site, and the establishment of property lines in connection with a project shall be performed using conventional or other methods, such as a total station or Global Positioning Systems (GPS) for field data collection. All Survey data collected shall be provided to the Government in a digital format on CD, DVD, or Blue-Ray Disc with an attached Survey Report identifying survey method, equipment list, calibration documentation, survey layout, description of control points, control diagrams, and field survey data.

3.16 Designs: Design submittals shall be provided as required in the TO. The TO may require no design, a partial design, or a full design. Possible design submittals points are at 35%, 65%, 95% and 100% design, see para 4. “SUBMITTALS.”

3.17 Design Charrette: The Contractor shall lead a project design charrette or similar activity to build consensus between Government representatives and the Contractor’s design and construction team on the functional, aesthetic, technical, environmental, siting and layout, and other requirements.

3.18 10% Design (Project Definition): The Contractor shall provide a project definition design as the result of a design charrette or similar event. Provide preliminary schematics of floorplans and site layout, preliminary elevations, and a written narrative describing each aspect of the project. The narrative shall include discussion of functional, aesthetic, engineering, environmental, siting and layout and other requirements, meeting minutes, and documentation of any other communication between the Government and the Contractor that influenced the project definition design. This level of design effort shall equate to the final report prepared to document design charrette completion and represents approximately 10% of the design effort.

3.19 Design Review Comments and Meetings. The Contractor shall receive, reconcile, and incorporate comments provided by the Government into the project design. If requested or required, after the Contractor receives the Government design review comments, the Contractor shall lead a meeting between the Contractor’s design team and the Government to discuss the Government review comments prior to the Contractor’s submission of responses to the Government review comments.

3.20 35% Design (Preliminary): The Contractor shall provide a preliminary design as the result of the Contractor’s design efforts from 15% to 30%. Preliminary design shall begin after Government approval of the Contractor’s responses to the Government’s review comments on the project definition design (10% Design) which sets project at 15% design complete. The preliminary design shall include any changes necessary to comply with Government comments to the project definition design report; further development of site plans, floor plans, elevations, building sections, and wall sections; single line schematic drawings for mechanical, electrical, communications, etc.; color boards for interior and exterior finishes and materials; listing of proposed specification sections for the project; and a design analysis that includes design narrative and analysis including code analysis by all disciplines; environmental permitting; sustainable development requirements, listing of Government furnished materials; copies of previous design review comments and responses; previous meeting minutes; and documentation of any other communication between the Government and the Contractor that influenced the preliminary design.

3.21 65% Design (Intermediate): The Contractor shall provide, based on the 35% preliminary design, drawings and the complete text of the specifications based upon the Unified Facilities Guide Specifications (UFGS), design analysis as identified in the Task Order (TO) for Government approval. The intermediate design submittal shall reflect a 65% complete design effort including a design analysis, manufacturers Information, calculations, drawings, and specifications required to document the work. Major mechanical an electrical equipment items shall be shown on the drawings with single line diagrams. All utilities and structures shall be shown. Drawings shall also include the following as applicable:

3.21.1 The drawings shall advance an additional 30% progress in all disciplines including site plans, floor plans, elevations, wall sections, details, and all other areas as listed in the basis of design. All cut sections and details shall also be shown on the drawings at this time. Any updated or corrected design analyses of architectural, structural, civil, electrical, mechanical, and utility systems shall be included. Dimensions will be provided in imperial.

3.21.2 All required controlling dimensions shall be shown. Site plan showing location of work including access from main roads and surface or subsurface drainage concepts.

3.21.3 Floor plans with dimensions and functional arrangement of all areas; including corridors, exits, stairs, and utility spaces properly related to exterior access, applicable Architectural Buildings Act requirements, life safety, roads, parking, and service areas, etc. Individual treatment shall be given items involving special design and/or deviations from accepted standards and of complex design. Gross floor areas shall be shown for each floor and for the entire building. Floor and roof framing, and design dead/live, wind and all other applicable loadings shall be indicated. Built-in, installed, and specialized portable equipment shall be indicated to scale. Pertinent information regarding the prevention and safety requirements shall be shown.

3.21.4 Elevations shall include story heights, fenestration, and adaptation to finished grades at the site.

3.21.5 Sections of structures including framing, partitions, suspended ceilings, ducts, etc., shall be shown.

3.21.6 Typical detail sections shall be shown at a scale of no less the ¾ inch = 1 foot. Sections shall include material and thicknesses, methods of attachment, and type of windows with relation thereof to supporting structural columns or walls.

3.21.7 For heating, air conditioning, mechanical ventilation and plumbing, and special features such as fire suppression, elevators, hoists, kitchen equipment, etc., indicate the location, capacity, and space requirements for all major items of mechanical equipment. Single line indication and riser diagrams of ducts, pipes, and equipment and their approximate location shall also be shown. Indications shall be made as to whether piping and duct work are exposed or concealed. Functional areas where pipes are exposed shall be delineated. Approximate operating range or capacity for heating, ventilation, air conditioning, and refrigeration equipment shall be clearly stated.

3.21.8 For electrical systems, indicate lighting arrangements, type of fixtures proposed, general light intensities, special electrical requirements of the user, including communications and electronic facilities where applicable, light, and power service entrance and distribution arrangement. Conduits, including those to be wired by others, shall be shown together with indication as to whether conduits are exposed. Functional areas having exposed conduits shall be delineated. Riser diagrams, showing service equipment, feeders, and panels, other than branch circuits, shall be shown. Cable sizes, current demand factors and the switch and panel board descriptions are required at this time. Location capacity and space requirements for all major items f equipment shall be showing including interior substations with service equipment and panels. Power, communication, and electronic features will be indicated in sufficient detail to identify requirements clearly and to indicate the means of satisfying the requirements.

3.21.9 Identify all Government Furnished Equipment (GFE) / Material (GFM) to be installed by the Contractor and equipment furnished and installed by the Government; if applicable.

3.22 95% Design (Pre-Final): The Contractor shall provide the pre-final design as the result of the Contractor’s design efforts from 65% to 90%. Pre-Final Design shall begin after Government approval of the Contractor’s responses to the Government’s review comments on the intermediate design (60% Design) which sets project at 65% design complete. The pre-final design shall include any changes necessary to comply with Government comments to the intermediate design, complete plans and specifications, final design analysis, and color boards and finishes. The design analysis shall include design narrative and analysis, all design assumptions and calculations for all disciplines, code analysis by all disciplines, manufacturers’ material and equipment cut sheets for major equipment, fixtures; and finishes; completed environmental permit request forms; sustainable development requirements; specifications in rough draft; listing of Government furnished materials; final construction scheduled to include any work phases to accommodate Government operations; copies of previous design review comments and responses; previous meeting minutes; and documentation of any other communication between the Government and the Contractor that influenced the intermediate design.

3.23 100% Design (Final): The Contractor shall provide the final design as the result of the Contractor’s design efforts from 95% to 100%. Final Design shall begin after Government approval of the Contractor’s responses to the Government’s review comments on the Pre-Final Design (90% Design) which sets project at 95% design complete. The final design shall include any changes necessary to comply with Government comments to the pre-final design, complete plans and specifications, final design analysis, and color boards and finishes. Upon Government approval of the Final Design and Government approval of the Contractor’s proposed construction start date, the Contractor shall commence construction activities. The Contractor shall pre-coordinate all accesses, permissions and permits, and notify the Contracting Officer prior to the Pre-Construction Conference and prior to beginning work on site.

3.24 Design Review Meetings: If requested by either party, design review meetings shall be held within 7 calendar days after receipt of each design submittal. All comments will be documented by the Contractor and each item resolved at the meeting. Any comments that result in a cost change to the awarded TO shall not be implemented unless approved by the Contracting Officer. A list of attendees and minutes of the meeting shall be taken by the Contractor and copies shall be forward to each attendee.

3.25 Design Analysis: As specified in the TO, design analysis may be required to include Calculations, General Description, History, Assumptions, References; Analysis of Alternatives; Energy Conservation Analysis/Life Cycle Cost Analysis, and code references, as applicable for each discipline, to show compliance. Calculations shall be provided by the Contractor and included with the appropriate design submittal. The following is a list of calculations which might typically be required under this contract:

3.25.1 Civil/Site work:

3.25.1.1 Survey: Contractor shall survey the site to locate all existing conditions on the site.

3.25.1.2 Site location map and location plan showing geographic location of project relative to existing facilities, roads, streets, etc.

3.25.1.3 Demolition plans at a legible scale showing quantities, locations and type of materials to be removed and added.

3.25.1.4 Site plan: All roads, parking, sidewalks and loading zones.

3.25.1.5 Grading plan: showing all topographic and grading information.

3.25.1.6 Utilities Plan: showing connections, routing and capacities of all utilities.

3.25.1.7 Details: all civil engineering details required to complete the installation of the work.

3.25.1.8 Geotechnical report.

3.25.2 Structural:

3.25.2.1 Foundation sizes and reinforcing.

3.25.2.2 Superstructure framing.

3.25.2.3 Wind & snow loading analysis.

3.25.2.4 LL (live load) and DL (dead load) calculations.

3.25.2.5 Wall sizes and reinforcing.

3.25.2.6 Equipment supports.

3.25.2.7 Elevated platforms.

3.25.2.8 Floor member sizing / reinforcing.

3.25.2.9 Lintel sizing.

3.26 Specifications: Provide Contractor-originated design specification Unified Facilities Guide Specifications (UFGS) that, in conjunction with the drawings, demonstrates compliance with materials, equipment, execution, and field quality control requirements of the TO.

3.26.1 Modify the guide specification to fit the project.

3.26.2 Delete portions of the guide specification that cover work not included in the project.

3.26.3 When portions of the work involved are not covered in a guide specification, add requirements to the project specification, as necessary, using language and format similar that employed in the guide specification.

3.26.4 Use guide specifications only as source documents and do not reference them in project specifications.

3.26.5 Do not combine work covered by various UFGS into one section unless the work to be incorporated is of a minor nature.

3.26.6 The specified products, equipment, fixtures, devices, and systems submitted by the Contractor and accepted or approved by the Government shall be used to construct the project.

3.26.7 Any applicable manufacturer or industry specifications associated with materials, supplies, or systems shall be utilized. If a discrepancy exists between these documents, the Contractor shall bring this to the attention of the Government and shall utilize the most stringent requirement(s) in the preparation of the project design.

3.26.8 The Contractor shall provide one (1) sets of hard copy specifications and one (1) set of Adobe PDF electronic files to the Contracting Officer at each required design level.

3.27 Perspective Drawings: When required by the TO, develop a black-line concept perspective and/or rendered (color) perspective of the project. (May be computer or hand-generated).

3.27.1 The perspectives shall be approximately 14” x 28” in size and shall be mounted on a standard presentation board, complete with a small site plan and supporting data (i.e., size, cost of landscaping, site work, building, etc.) affixed to the presentation board.

3.27.2 The black-line concept perspective shall be provided with the Contractor’s proposal as part of the 35% submittal. The rendered perspective shall be prepared by the Contractor and delivered with the final design submittal when requested.

3.27.3 The Contractor shall also provide an Adobe PDF electronic file of each perspective.

3.28 TO Construction:

3.28.1 Red-Line Construction Drawings: During the progress of the work, the Contractor shall keep a careful record of all changes and corrections from the original design layouts shown on the drawings. These Red-Lined drawings will be maintained at the job site, available for inspection by the Government. Upon completion of the project the Red-Line Drawings will be used to develop the As-Built Drawings.

3.28.2 Professional Certifications: All life safety plans, fire suppression and alarm plans and pre- engineered structure plans shall be submitted with professional certification affixed for Build Task Orders and Design-Build Task Orders, regardless of the tasks design level requirements.

3.28.3 Seasonal Heating, Ventilating and Air Conditioning Requirements: The Contractor shall provide temporary heating or cooling to existing occupied facilities if the air conditioning system or heating system is shut down to perform any work. Any proposals to shut down heating or cooling without providing temporary service must be approved through the Contracting Officer at least five (5) workdays prior to interruption of service.

3.28.4 Airfield Work: Work on the airfield will require personnel to have adequate numbers of airfield drivers’ licenses (IMT 483), all other site personnel will have to go through airfield training (approximately 45 minutes). All Contractor vehicles will require personally owned vehicle (POV) passes for the airfield. The Contractor will be required to purchase airfield radios, at no cost to the Government. The Contractor will also be required to have a vacuum sweeper truck dedicated to the project to ensure there are no Foreign Object Debris (FOD) issues. Low profile airfield barriers will also be required to delineate the work areas. All work shall be coordinated with Airfield Management on a daily basis. The Contractor will provide lighted X’s to be placed at the ends of closed runways.

3.28.5 Free Zone: If the TO requires, the Contractor shall establish a Free Zone around the affected work zones by installing visible elevated interior and exterior barriers, to include Controlled Access Signs every 30 feet IAW the Free Zone Map that will be provided by the Government, and DAFI 31-101, Section 5.6. The barriers shall be at least 36” high.

3.28.6 Haul Routes: The Contractor shall use the West Gate for deliveries and off-site construction debris hauling. Additionally, the Contractor shall utilize Arizona and Forty Niner Avenues as the main haul routes to construction sites.

3.29 TO Closeout:

3.29.1 Pre-Final and Final Inspections:

The Contractor shall request from the Contracting Officer a final acceptance meeting. The request shall be in writing (email is sufficient) at least five (5) working days prior to the meeting. The meeting will be chaired by the Contracting Officer and attended by appropriate Government and Contractor personnel. It is mandatory the project Superintendent be in attendance. If any Contractor personnel are still working on the TO, the Contracting Officer will immediately cancel the final acceptance meeting and direct the Contractor to reschedule when the work is complete. If during the final acceptance meeting it becomes obvious to the Contracting Officer that the TO is not ready for final acceptance, the Contracting Officer will immediately cancel the final acceptance meeting and direct the Contractor to reschedule when the work is complete. The Government will generate a punch list of deficiencies that the Contractor must complete prior to the Government taking beneficial occupancy of the facility. During the final acceptance meeting, the Contracting Officer will ask the Contractor how much time they require to correct the deficiencies and both parties will come to an agreement on the number of days to correct the deficiencies. The Government will reschedule a meeting to verify the deficiencies are corrected.

3.29.2 Training the Government: On TOs where new equipment has been installed, the Contractor shall schedule and provide training sessions for Government employees.

3.29.3 Records Documenting the Contractor’s Work:

3.29.3.1 As-Built Drawings: Prior to completion of the project, the Contractor shall update the original electronic as-built drawing files or the Contractor’s final electronic design drawings as applicable and provide the Government with a draft of the as-built drawings in Standard D size, on paper for review. Upon Government approval of the draft As-Built Drawings, the Contractor shall provide one (1) set of Standard D size drawings in correct scale, one (1) set of Adobe PDF electronic files and one (1) set of Autodesk AutoCAD electronic DWG files on CD or DVD. The drawings shall indicate, in addition to all changes and corrections, the actual location of all subsurface utility lines. In order that the location of the utility lines and appurtenances may be determined in the event the surface openings or indicators become covered over or obscured, the as-built drawings shall be clearly defined to show the end of each run including each change in direction. This may be accomplished by offset dimensions to two (2) permanently fixed surface features. Valves, splice boxes, and similar appurtenances shall be located by accurate dimensions along the utility run from a reference point. The Contractor shall record the depth (below the surface of each run), in addition to the size and type of conduit or pipe used for the run. GIS Files: The Contractor shall provide to the Government an electronic copy of the site layout and site utility plan in ESRI’s GIS shapefile format on a CD or DVD.

3.29.3.2 Operations and Maintenance Manuals: The manuals shall contain complete instructions for operation, inspection, testing and maintenance of the system, and shall include part breakdown diagrams. If applicable, the manuals shall also contain complete wiring schematics and diagrams. The Contractor shall provide the CO all paperwork that was shipped with or attached to the product or material including installation or maintenance instructions for the product or material, part number listings, care and/or cleaning instructions, removing and replacing information, warranty information, toll or toll-free numbers for information and Operator manuals. Prior to completion of the project, the Contractor shall provide the Government with a draft Operations and Maintenance Manual Set on paper for review. Upon Government approval of the draft Operations and Maintenance Manual set, the Contractor shall provide one electronic set of Adobe PDF files.

3.29.3.3 Transfer and Acceptance of Military Real Property (DD 1354): At completion of the project, the Contractor shall fill out and submit a ‘Transfer and Acceptance of Military Real Property’ (DD 1354). The DD 1354 form can be obtained from: https://www.esd.whs.mil/Directives/forms/dd1000_1499/.

4. SUBMITTALS:

4.1 Design Submittals: The Contractor shall provide design packages as required by the TO.

4.2 Schedule of Material Submittals: The Contractor shall build out the Materials Submittal Schedule (Form 66) provided with the TO. The UGFS specification section and paragraph number applicable to each material submittal item shall be added to the Material Submittal Schedule. Consecutively number each page of the Schedule of Submittal, e.g., “Page 1 of X”. Use all line number rows on one page before starting another page. Ensure all items requiring submittals are annotated on the Schedule of Submittals with the anticipated submission date. The Contracting Officer will review the Schedule of Submittals to ensure all required submittals are annotated and track required submittals for each construction project.

5. MANDATORY CRITERIA AND STANDARDS:

5.1 The Contractor’s design and construction shall comply with the versions of the following references that are current at TO award. The references are available on the internet, except as noted:

5.1.1 Latest Version of Holloman AFB Design Compatibility Standards. Provided by 49 Civil Engineer Squadron through 49th Contracting Squadron for official incorporation into each Contractor’s respective IDIQ.

5.1.5 Occupational Safety and Health Administration (OSHA) General Industry Safety and Health Standards (29 CFR 1910), Publication V2206. 29 CFR 1910 is also included as part of OSHA Publication 2207 which combines of both Parts 1910 and 1926 as they relate to construction safety and health. 5.1.6 OSHA Construction Industry Standards (29 CFR 1926). 29 CFR 1926 is included as part of OSHA Publication 2207 which combines of both Parts 1910 and 1926 as they relate to construction safety and health. They are for sale by the Superintendent of Documents, U.S. Government Printing Office, Washington, DC 20402.

5.1.7 National Emission Standards for Hazardous Air Pollutants (40 CFR, Part 61).

5.1.8 Asbestos Containing Material or any Class 1 ozone depleting chemical compounds are prohibited. Any asbestos material or Class 1 ozone depleting chemical compounds installed by the Contractor shall be removed and disposed of by the Contractor at the Contractor’s expense and shall not be subject to a claim against the Government.

5.2 Hazardous Materials: Refer to hazardous and toxic materials/substances included in Subparts H and Z of 29 CFR 1910 and to others as additionally defined in Fed. Std. 313. (Those most commonly encountered include asbestos, lead paint, polychlorinated biphenyls (PCBs), explosives, and radioactive material, but may include others. The most likely products to contain asbestos are sprayed-on fire proofing, insulation, boiler lagging, and pipe covering).

5.3 Drawing Criteria:

5.3.1 All drawings shall be prepared using the latest version of Autodesk AutoCAD computer aided drafting software. The AutoCAD drawing shall be independently referenced with all font and symbol sets incorporated such that the documents may be readily opened by the Government. When drawings are created using external references, perform a ‘bind’ of all the external references before submission in order to have all graphical information in one single DWG file.

5.3.2 Drawing sheets shall use standard English scales on either Standard D (24” x 36”) or Standard B (11” x 17”) paper size.

5.3.3 The Holloman AFB cover sheet and title blocks shall be used. Templates for these will be provided to the Contractor on disk in AutoCAD.

5.3.3.1 The title block shall contain project information including but not limited to Project number, TO number, Project Name, and date.

5.3.3.2 Survey Requirements: Accuracy level in accordance with “Geospatial Positioning Accuracy Standards, Part 2: Standards for Geodetic Networks,” published by the Federal Geographic Data Committee (FGDC), dated July 1998. (This document available upon request.) All geodetic data shall be collected using the coordinate and projection system – World Geodetic System (WGS) 84, Universal Transverse Mercator (UTM) 13 North, ellipsoid height, and orthometric height (EGM96). Data may also be requested in Military Grid Reference System (MGRS) coordinates. The Contractor shall use survey grade GPS, at an accuracy level of +/- 2cm.

5.3.3.3 Geographic Information System (GIS): GIS data shall be provided in ESRI’s ArcGIS 10.x shapefile (SHP) format. All additional attribution for the data will be based on the Spatial Data Standards for Facilities, Infrastructure, and Environment-Vector (SDSFIE-V) release 4.0 Gold Standard. 5.3.3.4 Entity naming conventions, attribute fields, and domain names shall be collected in the format defined by the SDSFIE-V DAF Adaptation 4.0.3.2, except where modified by the Government. For more information, go to https://www.sdsfieonline.org/

6. WARRANTY OF CONSTRUCTION:

6.1 Warranty. In addition to any other warranties in this contract, the Contractor warrants that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, workmanship or Contractor furnished design or that furnished by any subcontractor or supplier at any tier. This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes and/or fraud.

6.2 Warranty Period. This warranty shall continue for a period of one (1) year from the date of final acceptance of the work, unless otherwise specified in the individual TO.

6.2.1 If the Government takes beneficial occupancy of a portion of the project, prior to final acceptance of the entire project, the warranty for the portion occupied will commence on the date of its occupancy.

6.2.2 For all other portions not beneficially occupied, the warranty shall begin on the date of their beneficial occupancy, or final acceptance of the entire project, whichever occurs first.

6.2.3 In the event the Contractor’s warranty under this clause has expired, the Government may bring suit, at the Government’s expense, to enforce a subcontractor’s, manufacturer’s, or supplier’s warranty.

6.3 Defects. The Contractor shall remedy, at the Contractor’s expense, any failure to conform or any defect. In addition, the Contractor shall remedy, at the Contractor’s expense, any damage to Government-owned or controlled real or personal property when that damage is the result of:

6.3.1 The failure of the Contractor, subcontractor, or supplier at any tier, to conform to the contractual requirements; or,

6.3.2 Any defect of equipment, material, workmanship, or design furnished.

6.4 Work Repaired. The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The Contractor’s warranty with respect to work repaired or replaced will run for one year from the date of repair or replacement.

6.5 Notification Required. The Contracting Officer shall notify the Contractor, in writing, with a reasonable time after the discovery of any failure, defect, or damage.

6.6 Government Right to Replace. If the Contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the Contractor’s expense.

6.7 Subcontractor Warranties. With respect to all warranties, express or implied, from subcontractors, manufacturers or suppliers for work performed and materials furnished under this contract, the Contractor shall:

6.7.1 Provide only manufacturers’ warranties whose terms, exclusions, and limits are enumerated in the specifications and require that all work be covered under the warranty. Manufacturer’s warranties that require periodic inspections or repairs at the Government’s expense to maintain the warranty are not permitted.

6.7.2 Obtain all warranties that would be given in normal commercial practice.

6.7.3 Require all warranties to be executed, in writing, for the benefit of the Government if directed by the Contracting Officer and enforce all warranties for the benefit of the Government if directed by the Contracting Officer.

6.7.4 In response to an emergency warranty call the Contractor shall inspect the warranty item(s) and begin repairs or preparations for repairs within four (4) hours.

6.7.5 The Contractor shall respond to routine warranty calls in the same manner as emergency warranty calls within three (3) working days.

6.8 Unless a defect is caused by the negligence of the Contractor, subcontractor, or supplier at any tier, the Contractor shall not be liable for the repair of any defects of material or design furnished by the Government or the repair of any damage that results from any defect in Government-furnished material or design.

6.9 Manufacturer or other warranties in excess of one year, shall transfer to the Government. The Contractor, at the request of the Contracting Officer, shall execute assignment of any and all such warranties to the benefit of the Government.

7. CONTRACTOR STORAGE YARD AND FACILITIES:

7.1 Land: The Contractor is not required to have storage or facilities on HAFB. If the Contractor chooses to have storage or facilities on HAFB, the Government will provide a 50’ x 100’ lot within a reasonable distance of utilities. The Contractor shall restore the land to its original condition within thirty (30) days of contract completion.

7.2 Storage Yard: If the Contractor chooses to have a storage yard on HAFB, the Contractor will be required to provide and install a Government-approved fence to secure the area. The fence shall have a screen attached to conceal the materials inside in compliance with Holloman AFB’s color scheme and approved by the Government.

7.3 Facilities: If the Contractor chooses to have facilities on HAFB, the Contractor shall be responsible for any costs associated with their facilities to include mobilization, demobilization, trailers, skirting, utility lines, connections and site restoration. Contractor facilities shall be located within the 50’ x 100’ lot provided on HAFB. The facilities must conform to Holloman AFB’s color scheme, architecture standard and be in good repair. Contractor on-site offices shall comply with handicapped accessibility laws and regulations.

7.4 Utilities: Subject to available supply, the Government will furnish reasonable amounts of electricity, gas, water and sanitary sewer capacity from existing outlets and supplies, without charge to the Contractor. The Contractor shall conserve the utilities. The Government, at their discretion, can charge the Contractor for utilities if the Contractor is using poor conservation practices. The Contractor shall install, maintain and remove any temporary connections and distribution lines at their own expense. If temporary lines are associated with a specific TO, they shall be removed prior to the final acceptance meeting. Communications access is not available to the Contractor and the Contractor will be required to use wireless communications.

7.5 Batch Plant: If the Contractor chooses to set up a batch plant, land and utilities will be provided. The batch plant must conform and abide by all Federal and State environmental regulations and must be removed at the end of the contract.

8. CONTRACTOR IDENTIFICATION REQUIREMENTS:

8.1 Personnel: The Contractor and Subcontractor personnel shall present a neat appearance and be easily recognizable as Contractor employees when they are on Holloman AFB (HAFB). This shall be accomplished by providing each employee with a picture identification badge which shall be worn at all times.

8.2 Vehicles: Contractor and subcontractor vehicles shall have identification neatly stenciled or printed (not handwritten) on both exterior sides. Magnetic signs are acceptable. The identification shall be legible from 25 feet and be on the driver and passenger side of each vehicle. The sign shall include the Contractor (company) name, address, and phone number, at a minimum.

8.3 Contractor Storage Yard and Facilities Signage: Any storage yards or facilities (i.e., offices) shall have the following sign posted in a location amenable to public viewing:

8.3.1 The cost of this sign shall not be charged to any single Task Order as a direct cost, but rather shall be included in an appropriate indirect cost pool and recovered via a corresponding indirect cost rate such as Overhead or G&A expense, in accordance with the Contractor’s cost accounting procedures.

8.3.2 Size: No larger than 3’ x 4’.

8.3.3 Color: Sahara tan sign and posts with cocoa brown letters.

8.3.4 Letters: No larger than stenciled 4-inch-high letters for first line of sign; stenciled 3-inch-high letters for middle of sign; stenciled 2-inch-high letters for last line of sign.

8.3.5 The Contractor shall include this information:

8.4 Construction Site Temporary Signage: The Contractor shall furnish and install a construction sign for identification of the project in accordance with the guidelines, specifications, and drawing below. No other Contractor, subcontractor, or material signs is permitted on the site.

8.4.1 The sign shall be installed or emplaced at commencement of construction, prior to any other work being performed.

8.4.2 The construction sign shall be installed at the location shown on the approved 100% design unless otherwise directed by the Contracting Officer.

8.4.3 The sign shall be adequately supported with regard to site conditions and will be an adequate distance above the prevailing grade to permit public viewing. The Contractor should exercise care when installing the sign to minimize disruption to the grounds/landscaping.
